Donald Trump and his co-defendants in the Fulton County racketeering case are demanding that Judge Scott McAfee reconsider his decision that District Attorney Fani Willis can remain on the case.

McAfee ruled last week that, lead prosecutor Nathan Wade is removed from the case, Willis could remain. He had been considerign an ethics complaint from the defendants concerning a romantic relationship between the two.

"The March 15 Order is of exceptionally great importance to this case, substantially impacting Defendants' rights to due process. Additionally, given the lack of guidance from the appellate courts on key issues, and the fact that any errors in the March 15 Order could be structural errors that would necessitate retrial(s), the grant of certificate of immediate review is both prudent and warranted," Monday's nine-page filing says.

"Basically, they want permission from Judge McAfee to appeal his ruling on DA Willis' disqualification," explained reporter Tamar Hallerman of the Atlanta Journal-Constitution.

Trump was cited along with co-defendants Rudy Giuliani, Mark Meadows, Robert Cheeley, Michael Roman, David Shafer, Harrison Floyd, and Cathleen Latham in the paperwork.

Commenting on the matter on social media, former prosecutor Joyce Vance explained, "For there to be an unusual interlocutory appeal — one that occurs before trial — requires approval from Judge McAfee, who has until Monday. If he blesses an appeal, it's still up to the Court of Appeals to decide if it wants to take the case."

"A little tea-leaf reading," she continued, "although it's nothing certain: Judge McAfee dropped a footnote in his opinion dismissing 6 counts in the indictment last week saying he’d permit an appeal. He didn’t do that with the disqualification motion. Make of that what you will."
McAfee's dropped the indictments, saying they were too vague, though several others remain. That decision was separate from the hearing regarding Willis' disqualification.

Critics called the appeal request another case of Trump attempting to delay things, while others pointed out that innocent people don't make moves like that.

Trump's lawyers alleged that Willis' relationship with Wade resulted in gifts paid for with his salary from Fulton County. Willis disputed the accusations and told the court she repaid Wade in cash, a story substantiated by her father and a winery server.

The judge allowed Trump's team to appeal, a meaningless gesture because their argument lacks evidence and will be rejected, again. Meanwhile, Judge McAfee has a lot of work to do and is not slowing down the pace of progress toward a trial. This appeal is just a waste of time and money for Trump's team and has no effect otherwise.

None of this makes sense to me too. Give it time. I'm convinced that this is just another criminal act and its just a matter of time before evidence is presented to a grand jury leading to another indictment for financial fraud. Given the facts available, none of this makes sense because it shouldn't. This will all make sense after we learn more.

Trump has been able to move ahead of the justice system because the system moves slowly and Trump has enough money to pay legal fees to keep stalling efforts but not even his lawyers say he's innocent. As awesome of a win as it is for him, this junk stock play is just a delaying tactic. He can only delay for so long. There are only possible four outcomes ahead of Trump. He wins the election and kills the justice system or he goes to jail or he flees the country or he dies before justice is served. We'll see. A lot is still at stake. Still, though, only the first and most unlikely outcome will hand him freedom. I like our chances.

I want to see him unable — even under Maximum Weasel Drive — to break free from the relentless inevitability of criminal conviction.

He really messed with our judicial system, but I remain confident he didn’t damage it enough.
At this point I'm down for ANYTHING that knocks this reckless, arrogant MF off his self elevated perch/pulpit,I so badly want schadenfreude at his expense. I hate that my hatred has been so stoked during his rise,I can honestly say that I NEVER perceived this scenario in the good ol US of A thought we were built better than this. Just the simple fact that this incompetent,open book con artist could gain this level of prominence and adulation of so many is sobering/alarming/eye popping. AT best he should be a fringe level outsider that a few retards write onto a ballot as some kind of protest vote,I'd have thought the odds of a asteroid destroying earth would be on par w/were we are at presently.

They are confident enough that they are now showing their hand and endorsing Project 2025 — a roadmap for ending the republic by, of, for the people.

Special counsel Jack Smith aired frustration at U.S. District Judge Aileen Cannon, arguing she is giving credence to a “fundamentally flawed legal premise” from former President Trump that the classified documents recovered from his Florida home were his personal property.

The filing Tuesday night comes as Cannon has asked both sides to propose jury instructions that would take into account Trump’s view of the Presidential Records Act (PRA), which dictates how records created during a president’s term must be handled and later archived.

The law does allow for some records to be considered personal property of the president, but legal experts have rebuffed Trump’s argument that the more than 300 highly classified records recovered from his property could in any way be considered personal.

Smith’s team argued that accepting Trump’s theory “would distort the trial.”

“The PRA’s distinction between personal and presidential records has no bearing on whether a former President’s possession of documents containing national defense information is authorized under the Espionage Act, and the PRA should play no role in the jury instructions,” prosecutors wrote.

“Indeed, based on the current record, the PRA should not play any role at trial at all.”

“It would be pure fiction to suggest that highly classified documents created by members of the intelligence community and military and presented to the President of the United States during his term in office were ‘purely private,’” prosecutors added later.

Trump is largely being prosecuted under the Espionage Act, which prohibits the willful retention of national defense information. He is also charged with obstruction of justice for seeking to conceal the records from authorities after they demanded their return.

Legal observers were baffled by Cannon’s recent instructions, asking both sides to weigh two scenarios that largely embraced Trump’s view of the PRA despite having failed to consider an earlier motion from him seeking to toss the case on those grounds.

The indecision on that matter and numerous other motions have created a backlog of issues in the case, including Cannon’s consideration of a new trial date.

“It is purely a question of law that must be decided promptly. If the Court were to defer a decision on that fundamental legal question it would inject substantial delay into the trial,” prosecutors wrote of Cannon’s need to rule on the underlying PRA motion before leapfrogging to jury instructions based on the matter.

It’s unusual for prosecutors to be so direct in countering a judge’s directions, but numerous lines in the filing suggested impatience with the slow pace of the proceedings.

At another point in the filing, Smith called it “vitally important” that Cannon “promptly decide” the matter, noting their ability to pursue a future appeal of erroneous jury instructions.

Smith’s team also spent ample time undercutting Trump’s claims that the records could be his personal property, noting he has yet to provide any evidence he sought to designate them as such, even as he’s mounted a legal defense based on that argument.

“The Court should be aware at the outset that Trump’s entire effort to rely on the PRA is not based on any facts. It is a post hoc justification that was concocted more than a year after he left the White House, and his invocation in this Court of the PRA is not grounded in any decision he actually made during his presidency to designate as personal any of the records charged,” prosecutors wrote.

“Importantly, Trump has never represented to this Court that he in fact designated the classified documents as personal. He made no such claim in his motion to dismiss, in his reply, or at the hearing on March 14, 2024, despite every opportunity and every incentive to do so. As discussed below, the reason is simple: he never did so. Instead, he has attempted to fashion out of whole cloth a legal presumption that would operate untethered to any facts.”
