same charge for freshly cut bud

i know someone has had to have already asked this Q. but i couldn't find anything after searching
anyway iwas curious as to wether or not its the same charge for a couple of freshly cut buds vs second hand weed
lets say its obvious to an officer that the misdemeanor amount of bud that he just confiscated was freshly harvested
would that mean a manufacturing charge?

I think that would depend on if the buds where still on the stem with fan leaves and if you had grow pots and equipment out he could see. I think here in Michigan a plant is considered one when rooted but I am medical. Other the that its personal you just keep it really fresh and smoke it from a bowl.

It would be the actual weight at the time of arrest, but once you are over a 1/4 lb, it is the same as having a pound as far as penalties go That's why I never sell more than a 1/4 lb at a time, It's a big difference in penalties.
Less than a quarter, it's a misdemeanor, above that it's a felony.

in your state. mine has very different rules.
point is, a pound loses 75% weight when dry. I wondered how that effects charges, evidence.

..doesn't matter anyway i live right in the middle of a bible belt state and it'll b my 2nd charge so I'm fucked either way .. i had to spend a week in jail when i was 18 just for having some shake in the bottom of a pill bottle and a pipe..and they put me n there with a coke dealer and a guy convicted for fucking kidnapping

In most places, yes, it would greatly affect the charges. To the point that it may get the case thrown out, as any decent lawyer would delay as long as possible, then demand the evidence be shown in court, and measured. If 3/4 of it magically vanished... well... not only is the charge different, it makes the cops look guilty as fuck...

IF the weed even lasts that long b4 cops really DO steal it, lol....

but if its in an airtight container, it was all for nothing.

no insurance, tag, and 1lb of fresh kind b.... haha my public defendant would get me put under the fucking jailhouse

Unfortunately they are schooled to obfuscate and confuse a jury.

D: "You weighed everything, including stalks and stems"
Cop: " Drug dealers, like HIM (pointing to def), chop it all up and sell it all"
D: "You weighed it wet, it doesn't weight 1/4 pound now"
Cop: "Drug dealers like HIM (pointing to def), sell by weight, they sell it wet"
D: "You weighed DIRT"
Cop "We weighed what drug dealers like HIM sell"

and so it goes.....

So what if you have a sack of young dead vegged plants, chopped at the base? Could they add those on top of any lives ones even though the root ball is missing and they're dead? No proof to show whether it's 1 plant or 20 right? And what if there were no other live plants, just dead ones that haven't been pitched yet, still manufacturing?
