This is the Introduction of the Act I have crafted.

Read it, tell me and others what you think about the language. Let us forego the fact some think Michigan Voters wont Vote for it. So Far no one is screaming for MORE Government Taxes and Authority over ANYTHING! lol
Please read the Act, ask any questions you have about it you may have. But keep in mind, the only reason this can not be on the 2016 ballot is if you and those you know do not sigh the petition to put it on the ballot in 2016 when they are available.

Now the only real question is, If this Was on the 2016 Ballot, would you vote to put it into law.
Lets keep the conversation to that aspect of this. I know many believe it is a Big Step. but baby steps never get you anywhere, especially when there is always a bully there to push you back down.
We need to forget the nonsense of Baby Steps. the MMM Act was our Baby Step and the Bully was there just waiting. Thus this is the only Actual and True Redress we have in the State, as a State.

Over the next month, I think you will come to find the number of those in our own community that agree with this position is overwhelming.

Introduction:



Bring prohibition of any and all cannabis, and any cannabis associations to an end in its entirety, in our beloved state. Return cannabis to the pre 1937 non criminal status, when it was in the disciplines of Botany, Agriculture, and the daily use of the common person, requiring only their free will to do so for any non violent purposes, as they see fit. It is well past time we return cannabis back to when there was no criminality attached to this historically documented, multifaceted use, highly beneficial, and benign plant, in its entirety by ending Cannabis Prohibition in Michigan.



Michigan can do its honorable and responsible part to bring an end to the wasteful, brutal effects from the War on Drugs, and halt the increasing hostility that the War has had on our Michigan families, communities, personal, local, and state finances, not to mention the damage to them, and to the State, in and of itself.




Findings:



Cannabis can be traced back 5000 yrs as documented in historical Chinese records. Its uses are still today, as beneficial as they are as vast. Cannabis has been used as medicine, food, oils, lubricants, textiles, materials like canvas, rope, or naturally antibacterial cloth, fragrances, healing ointments, salves, fuels, fabrics, concrete, and much more. The etymology of the word canvas is derived from cannabis, as that is what canvas was manufactured from, and that canvas was turned into Sails for nearly all sea faring vessels prior to the invention of the steam engine. All the rope on these ships and used on land were made from hemp fibers. Cannabis was a staple of everyday life nearly everywhere on the face of the earth, and was ingested in one form or another by pretty much every man, women, and child since our existence.
From the industrial revolution era, cheap paper, plastics cellophane, and composites have been derived from Cannabis.

Henry Ford created a car which utilized hemp throughout where ever possible. Run with a Diesel engine that operated on hemp biomass based fuels, and was lubricated by hemp lubricants throughout.

The far reaching benefits with Cannabis/Hemp are potentially limitless.

As shown by Patent #US6630507-Cannabinoids as antioxidants and neuroprotectants , cannabis has undeniable beneficial health implications and benefits for all peoples from newborn infants that receive massive dosages of anandamide, the bodies naturally made cannabinoid via breast milk, to the young and old alike. Even our pets are known to receive the very beneficial healing effects of cannabis when properly used as they too have a functional endocannabinoid system.

Conclusions:



The significance of this scientifically documented and verified information shows the paramount importance of cannabis to the health and well being of every man, woman and newborn child, and can not be more overstated.

Due to this irrefutable information, We the People of Michigan hereby call for the immediate repeal of Cannabis Prohibition in all form and manner, and a complete and comprehensive statewide decriminalization of all cannabis/cannabis associations whatsoever in Michigan as outlined herein.

"
(A) Title:

(1) This Act shall be titled; "The Comprehensive Act for Total Repeal of

(2) Cannabis Prohibition, and Statewide Cannabis Decriminalization in Michigan"




(B) Clarifications:

(1) Cannabis is the English word that is documented throughout history in the

(2) Botanical, Scientific, and Agricultural disciplines, and is considered the

(3) correct and proper terminology when referring to the cannabis,

(4) marihuana/marijuana, or hemp plant.

(5) Cannabis will be the word used for the purposes of this Act, but for general

(6) understanding for all concerned, marihuana/marijuana and hemp

(7) are all acceptable synonyms for cannabis, as are many others not noted,

(8 ) such as cannabis sativa, cannabis indica, and/or cannabis rudialis to

(9) name a few.




(C) Definitions:

(1) All words contained in this Peoples Initiative shall be given their most broad

(2) and general definitions as understood by any voting citizen and as outlined

(3) in Article XII of the Michigan Constitution.


(D) Purpose:

(1) We the People of Michigan, on this day hereby fully and openly declare an

(2) immediate end too, and full repeal of the statewide prohibition

(3) of cannabis, cannabis use or associations of any kind, type, or manor. We call

(4) for full and complete repeal of all penalties, fines, and/or fees, for any and

(5) all non violent cannabis associations throughout the state. This shall include,

(6) but not be limited to cannabis in all of it's raw, biological, agricultural, natural

(7) or modified variety, diversity, form, type, strain or linage, for the use by any

(8 )adult that has obtained the age of 18 yrs or older, the right to possess,

(9) use, ingest, apply, mix, create, deliver, sell, transfer, gift, grow, manifest,

(10) produce and/or fashion or manufacture into any form, or product, or item,

(11) including but not limited to the use and/or development of, any plant material

(12) thereof, and/or extract thereof, preparation thereof, salts thereof, mixture

(13) thereof, composite thereof, or compound thereof, for any personal, agricultural,

(14) industrial, medical, botanical, textile, research, manufacture, or for any

(15) product/s or service development and or use, for any means or purposes,

(16) so long as they are non violent in nature.

(17) Anything that inhibits, prohibits, or otherwise makes illegal or infringes

(18 )upon any citizen of Michigan, and/or visitors to Michigan, their

(19) Constitutional Right to possess, own, grow, use, cultivate, deliver, create,

(20) research, develop, process, ingest, consume, propagate, test, sell, or

(21) manufacture into any from, any cannabis or item or product whatsoever, in

(22) any amount whatsoever, are hereby recorded as null and void from this

(23) day forward.


(E) Scope and Terms

(1) For any and all associations to cannabis in Michigan, all the following shall

(2) be true, except as outlined below in; Exceptions/Exclusions:

(3) Complete removal from the Michigan Controlled Substances Act and will remain

(4) unscheduled in perpetuity, as well as removal from Public Health Code in

(5) total, striking all cannabis and/or hemp prohibition and criminalized status.

(6) Cannabis in any from, shall no longer be cited or allowed as reason to

(7) remove any child or children regardless of age, from any parent/s or duly

(8 ) appointed guardian/s custody for any reason whatsoever, by any private,

(9) local, state, federal, or international body or agency, unless physical

(10) violence, or other abuse can be proven in a jurisdictional court to have

(11) occurred. No other changes are inferred or implied in consideration to

(12) the protection of any and all children in Michigan State.

(13) To be blocked in perpetuity from prohibition in any form or by any manor

(14) by any governmental or private entity from within or outside of Michigan.

(15) No crime/s will be associated to cannabis for non violent acts for any reason

(16) whatsoever, in perpetuity.

(17) No felonies, no misdemeanors, no civil infractions or penalties of any kind

(18 ) will be assessed, issued, or allowed from this day forward.

(19) No forfeitures of any kind of any inalienable rights, properties or

(20) possessions or professional qualifications whatsoever.

(21) Only standard State Retail Sales Tax Code shall apply to cannabis, or any

(22) cannabis products, based in part or in whole of any cannabis or cannabis

(23) derivatives, including but not limited to related cannabis paraphernalia.

(24) All current product/business/industry/discipline standards will apply as

(25) they do for any non cannabis related product/business/industry/discipline.

(26) Any changes that effect cannabis or cannabis based or related products,

(27) must be applicable across all products or items available in the state

(28 ) whether or not they have any cannabis relation or association
(29) No legislation allowed for excluding/prohibiting any use/products/business

(30) for cannabis or cannabis association of any kind.

(31) No denials for cannabis or cannabis association for anybody in the

(32) pursuit of life, liberty, health, and happiness.

(33) No denial of any medical services/products/tests is allowed.

(34) No special permits, licenses, permissions, or other authorizations required

(35) for any cannabis use by minor, except that of the parent/s, and/or

(36) appointed guardians.


(F) Exceptions/Exclusions:

(1) Any Impairment/s for any forms of travel and/or public appearances,

(2) and/or motor vehicle use/operation/s shall be determined on the grounds of

(3) standardized field sobriety test only, and will be the only allowable

(4) tests applied to prove impairment from any use or associations. There

(5) will be no chemical tests, no blood level gravity tests, or other test

(6) allowed or applied, other than as listed herein for proofs of impairment.

(7) No limits will be set forth for the purposes of assessing automatic

(8 ) impairment/s for the use or ingestion, or internal cannabinoid levels.

(9) Anyone found guilty of acts of violence or crime, that may have an

(10) association to cannabis, or related use, or business, or professional

(11) licenses, will upon a verdict of guilt of any said act of violence or

(12) crime, immediately relinquish and forfeit all protections as

(13) outlined and provided for in this act.


(G) Pardons:
(1) Let it be stated that from this point forward, all persons currently held in

(2) state or local custody on any non violent cannabis only related felony,

(3) misdemeanor, and/ or civil infractions, and/or criminal charges, sentences,

(4) or probation, are to be hereby fully commuted to time/sentence/probation

(5) served, and immediately released of their own personal recognizance,

(6) unless there is extenuating circumstances can be well documented by a

(7) Licensed Medical Professional. All minors held in any state or local custody

(8 ) for any non violent cannabis only crime, are to also be immediately

(9) released, and remanded to the custody of their legal parent/s or

(10) guardian/s, unless the parent/guardian indicates otherwise for any minor

(11) being held. All cannabis related charges will be permanently expunged

(12) from juvenile records. Anyone on probation or other state or private

(13) managed rehabilitation program are hereby allowed the right to use

(14) cannabis for personal needs with no penalty of any kind whatsoever.

(15) All current non violent cannabis crimes and cases being investigated or

(16) held for trial are to be dismissed forthwith. Non violent cannabis use or

(17) association is no longer actionable offense to arrest, ticket and/or fine for

(18 )any amount whatsoever.



(H) Protections:

(1) All other acts, policies, rules, laws, mandates, legislation, or other forms of

(2) local, state, federal, or internationally implemented governance that do not

(3) comply with this act, or anything contained therein, are hereby superseded

(4) by this Act in Michigan State.



(I) Reaffirmations:

(1) We the People hereby Reaffirm; Section 333.26421 MICHIGAN MEDICAL

(2) MARIHUANA ACT (EXCERPT) Initiated Law 1 of 2008, and mandate that it

(3) shall be reverted and returned to its full and original verbiage throughout, as

(4) passed in November of 2008, and fully implemented as originally passed.

(5) Any and all changes since its passage in the November 2008 election cycle,

(6) are hereby null and void and ordered to be fully reversed in their entirety.

(7) Nothing in this Reaffirmation section (I) shall have effect for anything

(8 ) except for Section 333.26421 MICHIGAN MEDICAL MARIHUANA ACT

(9) (EXCERPT) Initiated Law 1 of 2008.



(J) Amendment:

(1) From this point forward, only one Dr. Authorization shall be required for "use"

(2) by a minor under Section 333.26421 MICHIGAN MEDICAL MARIHUANA ACT

(3) (EXCERPT) Initiated Law 1 of 2008. Nothing in this Amendment section (J) shall

(4) have effect for anything except for Section 333.26421 MICHIGAN MEDICAL

(5) MARIHUANA ACT (EXCERPT) Initiated Law 1 of 2008.



(K) Modifications, Changes, Repeal:

(1) Let it be further stated and codified in perpetuity, This Act shall stand in full

(2) virtue and compliance and in support of, as well as with the full and broad

(3) support and protections of the Michigan Constitution.

(4) This Act, or anything contained herein from this day forward can only be

(5) modified, changed, updated, or repealed, previously, now, or at any time in

(6) the future, by a valid Peoples Referendum Process as per Article XII of the

(7) Michigan Constitution.



(L) So say We the People of Michigan, on this day, November 9, 2016."

Feeding a kid a constant supply of brownies daily is not violent. Watching a toddler fall into a vat of oil and drown is not violent. There are thousands of other non-violent hypotheticals I could come up with that could have tragic or disgusting outcomes for which there could be no penalty due to a law like this. It ain't going no where.

Simple is the Key Nurse Nancy. Though it can not be so simple as to be vulnerable to easy legislative or judicial change. This is Draft A. Holes have already been found and plugged in Draft B, but there are a few other things to take care of in Draft B that were found in this draft.

The MMM Act was not too simple but it was simple enough it relied on the honor and integrity of the state itself to implement and uphold. Sadly it was still a bit too simple.

What does that have to do with the price of tea in china? The POINT, which apparently flew way over your head, is that if you negligently or recklessly left a bucket of oil out and a kid drowns then you cannot be charged. If a kid drowns in a bucket of water due to your recklessness then you CAN be charged.

Basically it doesn't matter if what someone does with marijuana even if it is reckless or negligent, you law would let the moron off scot-free. What the hell does a kid dying in a tub have to do with this??? Are you that dumb? If I left a 10 month old in a tub and he drown then I'd be hit with at least manslaughter. If the same tub had marijuana oil in it instead of water then the moron walks.

The issue here is who ultimately do you want to give authority of your bodies endocannabinoid system too? Big Pharma and the Government?
Or should you have authority of your bodies own systems?

Keeping in mind Cannabis is the only thing that interacts with your endocannabinoid system the way it is supposed to be stimulated?

Point being, Legalization of Recreational Pot gives the State, thus Big Pharma/Big Money the exact control over your bodies own endocannabinoid system, which they can not take for themselves.

The Language is nearly complete. I will be filing officially with the state within the next weeks, and the language will then be ran through the Board of Canvasser to clear out some superficial legal hurdles.

Once that is done, It will be on like Donkey Kong.
