Colorado Medical marijuana Bill Passes; Governor Will Sign

Colorado lawmakers are finally sending a measure regulating the state's medical marijuana industry to the desk of Gov. Bill Ritter, and Ritter has indicated he's inclined to sign it into law.

The State House voted 46-19 on Tuesday afternoon to approve House Bill 1284, report Jeffrey Wolf and Adam Schrager at 9 News. The bill mandates that dispensaries are licensed and monitored throughout the state, but in a very controversial provision, also gives local communities the ability to completely ban them.

Individual caregivers would still be allowed to provide marijuana to up to five people in localities where a ban is in place.

Medical marijuana advocates argue that it would restrict chronically ill Coloradans from safely accessing cannabis, which is a Constitutionally protected drug under Colorado law since voters legalized it in 2000.

Predictably, law enforcement officers also criticized the bill as "legitimizing dispensaries" which they claim wasn't the intent of Colorado voters last decade. It's another case of the old "Yeah, it's fine to have marijuana as long as you don't actually get it anywhere" school of thought.

The measure regulates where dispensaries can be located. The shops are required to be at least 1,000 feet or more from schools, much like liquor stores.

Supporters of the legislation say it will help bring order to an industry that has grown exponentially in Colorado over the past two years.

Lawyers and medical marijuana advocates opposed to the bill say they will sue the state if the bill becomes law, partly because of the provision allowing local bans. They also object to excluding non-Colorado residents from opening dispensaries, and large dispensary application fees, which they say are excessive.

As a former prosecutor, Gov. Ritter was one of the main proponents of using a "law enforcement model" for Colorado's medical marijuana regulations, according to medical marijuana advocacy group Cannabis Therapy Institute.

"He helped Senator Romer craft a bill most favorable to police and prosecutors with no regard for patients, CTI said in a press release.

CTI urges Coloradans to email Gov. Ritter at [email protected] and urge him to veto HB 1284 and SB 109, "because the bills will harm patients by driving up both the price of medicine and participation in the program."

50K, thats insane. Small shops can barely pay their rent. That would end up being passed on to the patients cost and that isn't good.

this really hits home with me. I love to see lawmen making laws without input from those who it will affect me as a patient feel this as a strike against my salvation from my pain that rules my life. I grow my self but how long till they start saying thats not ok. Then it will come down to government owned facillitys so we can put more money in uncle sams pocket all they want is to take i medicate in my own home never buy for anyone else. So why does jonny law see us as the bad guy for using what mother nature gave us instead of there synthetic man made side affect causing pain pills. if they were smart they would do there job and let it be.

50k huh? That right there opens the bill to a legal challenge that will probably kill it. There are already rules on the books that deny he government the right to charge exorbitant licensing fee's that limit peoples ability to engage in a business, and with a 50k price tag I doubt any government defense lawyer could argue that the fee isn't exorbitant. It also opens them up to charges of racism, since the vast majority of minorities won't have the cash neccessary for the licensing, which will create a situation in which most of the owners of legal dispensaries are white.

The governor can sign the bill, but as long as it's tied up in court challenges it can't go into effect, and so far the courts have sided with the patients pretty much every time. It's time to stop writing and calling politicians and time to start hiring lawyers and organizing large scale protests in order to get this legislation thrown out/repealed by the courts.

i don't remember much from the weekend...but I do know that june 1st some shitfuck in the capital is going to fuck everybody over in colorado with mmj
 
I listened to Brian Vicente with sensible colorado explain HB1284 last night and what he said is the fee for a dispensary to open will be no higher than $5,000.

I hope that's the case, suby- my $50,000 quote was from another thread that was quoting Chris Romer, but then again what Chris Romer would like to happen and what the state decides are two completely different things.

I'll be going to the seminar that's been posted about where they're going to break down these bills and what they mean and I'll post my findings here. I'm in Fort Collins though, so that won't be until Thursday.

It is my understanding that without Gov Ritter signature this will go into law on 6/12. Rob Corry indicated that the fees associated with the new bill are unknown. I find it amazing that a bill that is unfinished is allowed to pass into law. We do not know exactly how this will effect the community because we do not know how much it will cost.

There are a great many gray areas, including that there can be no more than one caregiver per household or grow area. This prevents caregivers from combining their resources.

I am still emailing Gov Ritter daily asking him to veto this unfinsihed piece of crap. I urge all of you to do the same. It probably will do no good but atleast we can say we tried.

50,000 ?????? what the fu(k!!!!!!!!!! well there goes my idea out the fu(king window!!! i dont even live in CO but was thinking of opening a dispensary to start a new business and was going to have it be the best disp in the US but after hearing 50 f-ing thousand dollars is just ridiculous. Again i dont even live there and i wanna email that governor and tell him to veto that sh!t out of office and have the entire medical population and all those who are for medical cannabis to not only email him but protest this bill (peacefully that is dont want them to think weed makes you violent like the f-ing propaganda does) but yeah have everyone march up to the governor's office and stand out there with a crowd of 50,000 yeah thats right 50,000 people or more in protest of this bill and i guarantee that that will draw the media and show him he had better veto it and it will also send a message to the senate if it has to pass there first too.

if i do end up there in CO, i will lead it and lead the people there to peacefully stand up for what is right and to make ridiculous law making a thing of the past, theres one thing ive always wanted to do and it is to get rid of the bs and change this world for real and (not like the fake change that obama was puppeted into saying during the last election) but seriously for real... CHANGE this world for the better, and if i have to start in CO then so be it, but i cant do it alone so only time will tell.
