Conservative Senator Denise Batters says that regulations allowing Canadians to grow up to four cannabis plants at home are a loophole that will be used by organized crime to fill houses and forests with cannabis.
In an interview this week with CBC, Conservative Senator Denise Batters told the host that her party is looking at amendments to Bill C-45, including raising the age limit and targeting home grow “loopholes” which she said have allowed Mexican cartels to fill homes and national forests in Colorado with cannabis.
The Cannabis Act, the legislation currently being debated in the Senate, allows Canadians to grow up to four pot plants per household, pending provincial approval. Colorado has a similar allowance of up to six plants per person (12 per household), with up to three flowering at one time. The Senator says that “criminal organizations” like “mexican cartels” are using this “loophole” to “use homes and public lands as massive grow ops” worth tens of millions of dollars.
Of course this is ridiculous because the allowance for a handful of plants in a home (and in Colorado it’s required to be locked up to keep it away from kids) clearly has no connection to organized crime filling an entire house or a national forest with tens of millions of dollars of cannabis—not any more than allowing Canadians to drive is a “loophole” that allows for souped-up street racing.
Obviously organized crime grew cannabis in Colorado before they legalized six plants, and there is actually zero evidence that the six plant allowance is connected to large scale grows. Large scale grows will exist as long as there is a black market to sell the products in, which leads to another absurd point she made, which was that this black market cannabis in Colorado is making its way to other US states.
Cannabis makes its way from Colorado to other US states because of the schizophrenic and disconnected nature of continued US federal prohibition on the plant, even as some states make it ‘legal’. Canada is not proposing such a disjointed system. And the current system of prohibition in Canada is already leading to exports from Canada into the US. You know, because that’s how markets work. I thought the Conservatives understood basic market dynamics.
The black market in Colorado does not exist because of legalization, it exists in spite of it. And the circumstances surrounding state legality and federal illegality in the US and Colorado are clearly VERY different than the issue of full federal legalization in Canada. Of course, this is the same Senator who thinks the warning label on cannabis is a secret plot to use hockey branding to get kids hooked on the devil’s weed, so clearly we aren’t dealing with a person who puts a lot of thought into her outdated prohibitionist rubbish.
Unless, that is, the Conservative Senator is suggesting that Canada wait for permission from the United States to legalize. Surely a supposed “Conservative” would not be arguing that Canada must bow down to the United States, would they?
So there you have it, folks. Conservatives in Canada continue to fearmonger around legalization, showing a greater allegiance to Jeff Sessions and Donald Trump than they do their own constituents. It’s clear that they are likely going to try and add an amendment to ban home grows, just as they did in the House, and possibly even try to raise the age of access in Canada.
Of course, the same person who brought that proposed amendment in the House, MP Marylyn Gladu, also stated in committee that the Conservatives would “not bring any amendments. It would be hypocritical for us to pretend to try to fix a bill that we wish didn’t exist.”
Hopefully more sober heads prevail in the Red Chamber and the Independent Senators seek to put the interests of Canadians before those concerns of Jeff Sessions and Donald Trump.
