Plume of pot smoke tips off cop at RIDE checkpoint
Driver eludes impaired driving charge after passing roadside test

Police were notified that something was amiss at a RIDE checkpoint when a driver rolled down his window and a “large puff of white smoke from a freshly smoked marijuana cigarette escaped.” (The Canadian Press)







A Hamilton man was arrested Monday after rolling down his window at a police stop and a huge plume of pot smoke billowed out of the car, police say.



Officers were conducting a RIDE checkpoint just after 10 p.m. when they stopped the car. When the driver rolled down his window, a "large puff of white smoke from a freshly smoked marijuana cigarette escaped."



The 19-year-old driver "showed signs of impairment," police say, so the officer administered what they call a "drug recognition evaluation" – a combination "motor skills and physiological responses" test that has the person do things like walk a straight line and count their steps.



"We have them touch their nose, stand on one foot … we also test pulse rate, look at their eyes, things like that," said police Const. Claus Wagner.



The driver passed the test, so he couldn't be couldn't be charged with impaired driving, police say.



"Even though there was some fresh marijuana smoke in the car, he wasn't impaired," Wagner said.

The 19-year-old was, however, charged with marijuana possession.

That's funny! Charged with marijuana possession? probably for just a roach, too.Fuckers. Same thing happened to my son last year leaving my place with his girlfriend. They were stopped at a check point looking for unlicensed off-road vehicles (I live in the boonies) and the cop smelled weed. His gf is a mmj patient so no issue with possession, but they did a road side sobriety test on him after he admitted he smoked a joint. He passed with flying colors, the cop even commented on his tolerance and sent him on his way.

I would have to be pretty deep into some wild sativas to not be able to pass any of these tests.
Maybe they'll learn that it's not an impairment.

Or at least realize any impairment dissipates in 20 mins for a daily user...less for a long time chronic like myself. Impaired driving seems to be one of the 'evils' the anti-pot side uses to scare the people...it'll be nice to prove them wrong...again.
