From my understanding you would not have to be tried under the prop 19 clause even though yes you could be.
so "yes" i can be arrested under the laws of 19?

that's a fail, in my opinion. it is adding a new law that WILL affect current medical laws.

Prop. 215 contains a provision ensuring that "conduct that endangers others" remains illegal. Such conduct is likely to include driving under the influence of marijuana, operating heavy machinery, or other similar activities, in which there is a realistic risk that a person's marijuana use could impair judgment and lead to harm to other people. Courts would probably also consider smoking marijuana in public or in the workplace to be a danger to others, permitting sanctions against anyone for doing so.
But what about in the privacy of our homes...and our children???...Is this Dick really making me a criminal??? Is the wording so loose that the interpretation will be left to Barney Fife???

Interestingly...I just got my voter guide...In the rebuttal to the argument against prop 19...in bold caps...

THE CHOICE IS CLEAR: REAL CONTROL OF MARIJUANA, OR MORE OF THE SAME...

I thought this was about ending prohibition????

In public or private? I'm pretty sure there will be child protection laws about blowing cannabis smoke in other childrens faces in public that is against the law. If there aren't, then that society is fucked right up :)

You mean all this time I've been holding my daughter down and forcibly blowing every single exhalation in her face...I've been breaking the law???? I'm not sure I can support a law that is going to force me to blow my few puffs...not in anyone's face but as naturally as involuntary breathing...oh wait...that is what I do now...but prop 19 makes this a FELONY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

CPS has enough evil sh!t to worry about...they do not give a sh!t about MJ being smoked by the parents in the home.

my bad prop 215 does not address smoking pot in front of kids, the california health and safety code is is does regulate on those things. it will be illegal to do under both propositions simply because you cannot do something that might endanger a minor

If this were true it would be illegal to smoke tobacco...

Lol, you guys and your morals, you crack me the fuck up :) And that's not avoiding the issue any more than you guys are :)
I sure hope you understood that I do not blow smoke in anyone's (well sometimes the cat) face...you seemed to be missing the point...and do you think that smoking MJ in the same room as a minor is immoral??? (just trying to cover both possibilities of your moral humor)

why does prop 19 make a point to address it if it already exists?

how come you all don't get it?

At the present time a medical patient can smoke in thier own house in front of their kids or while thier own childern are present in the home... without fear of a fine and jail time

If 19 passes that will be illegal...so will a person 21 and over passing a joint to another ADULT between the age of 18-20... old enough to die for our country.... penalty under 19.... six months in jail and a $1,000 fine. [8] (NORML's Web site reports that the current penalty for a gift of marijuana of 1 oz. or less is a $100 fine)

19 will not distinguish different applications of the law between medical patients and everyday users

If you live in a house with other medical patients say 3-4 of you ...all will have to share a 5x5 area.... even if you live on a 5 acre parcel with 200 people everyone would have to share that same 5x5 area....

If you rent, you will be required to obtain permission from your landlord—which they may be unwilling to grant since doing so will/may subject them to forfeiture by the federal government.

I have no space restrictions as a medical patient under 215.... I grow my plants huge... I can mabey get 2 plants in a 5x5 area

Thank you RUINER!! The only problem is that the yes on 19 folk don't necessarily care about what the bill says because they are convinced that 19 in LEGALIZATION which is the fault of the media. i've seen interviews on CNN where even the opposition refers to this bill as LEGALIZATION. THATS what so fishy about this debAte. The HUFFINGTON post prints a completely bias article for prop 19, even ending the article with yes on prop 19, for what? If our officials were really concern about or health and safely the current argument would be about whether or not to regulating alcohol the way mmj is regulated now.... with a doctors recommendation.

If this were true it would be illegal to smoke tobacco..
not true, culture is just so ingrained with smoking cigarettes that its never going to be outlawed even if it should be. you dont think you shouldnt be allowed to smoke cigs in front of youre kids? because i honestly do. they seemed like just as much a gateway drug to me. obviously it is a way more toxic smoke than pot but the govt will never push that point of view. either way its in the health and safety code i dont care what your opinion is. its there

for limits on growing the verstise guy has already said told you and shown the case where legal precedent was set to defend all of that. there will be no plot restrictions to your plants, plain and simple, sometimes our system works in the peoples favor. the fact that prop 215 is its own laws why would they be restricted by 19? medical and recreational use are completely different terms and theres a reason 19 doesnt use medical and 19 in any way shape or form. theyre leaving it alone.

and once it passes anyway it can simply be amended down in penalties if and when the people get pissed so i hope you all vote yes and stick it out with the rest of us. we really might not have another chance, and the non smoker and NON-STONER demographics are really pleased with 19. please note the difference in smoker-stoner. its pretty big. and contrary to stoner belief the smokers outnumber us a shitload. im talkin about your dad who smokes maybe every 2 weeks and my dad, and friends. ETC
