The 24 plant/1 oz. Rule

I'm having trouble wrapping my mind around this, so maybe someone from Alaska can help me out here. How can it be "legal" to grow and own up to 24 plants in the privacy of your own home for personal use but you can only have up to 1 ounce. I mean... just 1 plant alone can produce more than 1 ounce on its own. It doesn't seem to make sense to me. :wall: I'm seriously thinking about making the move to Alaska from New Jersey by 2014 (to the Kenai in specific) and although I haven't smoked ganja in over 2 years, I wouldn't mind taking advantage of the lenient marijuana laws and starting again. :cool: Like I said.. it just seems a bit off to me that you are allowed to grow 24 plants, but more than 1 ounce is a misdemeanor crime and more than 4 is a felony. Is this just a trap type of law wording? And how likely is it really to have some sort police intervention if you are growing inside of your own home for personal use, and never ever for sale or distribution?

Enforcement usually doesn't start until around 4 ozs in your home. I know a ton of growers and none have been bothered. I fish with the Anchorage assistant DA and he hasn't filed charges on anyone for less that 1/4lb in their own home. It's definately a bizarre law but it is one that allows many of us to grow our own cannabis. If you aren't selling and aren't telling, there's no jailing.

Kenai gets busy in the summer for a couple of months. It's a great area to recreate. Good luck on your move.
 
That's about what I expected. I suppose if I just kept my growing to myself and my fiancé it wouldn't harm anyone. But it's still confusing to me in that 24 plants definitely yields way more than even 4 ounces. *scratches head* Thanks for the quick reply though

It's a pretty screwy law. There was a writeup about the law by UAA and it helped. The only folks who get busted are growing LOTS of marijuana and are usually busted by one of their customers getting questioned about possession. There are so few law enforcement officers in Alaska that the few here have better things to do than bother a personal use guy.

If you aren't turning major weight, don't be concerned. I have a bit over 4 oz in the house now and am not concerned in any way, shape, or form.

As for the 24 plants, thats for the cultivation charge. Anything greater than 24, goes to the federal level.

To be real honest with you, if you are smart and doing things right you should never HAVE To worry about the 24 plant law. Dont have idiots for friends, dont let friends over to your grow house. Dont grow in your own house do it somewhere else. If you get caught over 24, the feds seize your house. The #1 thing that gets people busted is peoples mouth's. NO ONE NEEDS TO KNOW. SWIM has grown in places you'd never imagine possible, like a dorm room..... No one knew, no harm no foul.

Alaska's pot law is one of the most fucked up out there. Look at the medi card... oh heres a card, you can legally smoke but we wont allow depsensaries so you gotta grow it or buy off the street. Buying off the street, you are STILL commiting a crime.

Its better to just light one up, forget about the laws and stick to yourself.

The feds seem to be the only ones who bust people up here and the charges usually don't stick too heavily. Obama had said they wouldn't be enforcing this, but he lied. They make their sweeps up here about the same time every year.

Me, I'm trying to find a doctor who will prescribe in Alaska as I have not been able to work since "company policies" don't allow for it. Really sad since I work very well if I can just sleep past the pain at night (which is why I use it).

Anchorage Neighborhood Health Clinic DID NOT help me. They tell me to take Tylenol, but not too much as it will hurt my liver. Well, I'm afraid I'd have to hurt my liver and I'd still be feeling the pain.

No docs will prescribe here you can only get the paperwork for the card. I got mine thru www.thehealingcentermedicalclinic.org with dr. sean cardinal he comes to anchorage once a month. the number is 717-9966. The clinic runs out of a lawyers office in downtown anchorage. The office visit is 300 bucks if you have medical records and 375 if you don’t have any. You have to sign him over as your primary care doc and mail in the signed paperwork. The address is 733 W. 4th ste.308 in downtown anchorage.
my problem is now that I have the card I can’t find any meds can anyone please help?

Go to the "clinic" the doc from California puts on in Anchorage. Prepare to be raped money-wise. $325 with your records, $375 without records. He advertises here but the last advetised one was July 20. He claims he has "helped" get 700+ Alaskans their medical card.

But does he not also force you to designate him as your primary physician in order for him to make the recommendation ?

Interesting. What does "sign[ing] him over as your primary car doc" entail exactly? Say I have insurance and a primary care doctor already, but don't want to even mention this during my visit. Then what?

Explain the concern about "vet". Do you mean veteran? Concerned about the VA? The VA here is dispensing Marinol to a guy I know right now.
I'll buy that, but the rumor mill says even mentioning MMJ use and they can cut you off from the meds that they provide.
Just what I've heard - anyone else ?

I have a patient under VA care. His oncologist there immediately approved Marinol and will consider MMJ. She just needs to find out all the regs. And the VA is dispensing it.

You don't have a clue. When the cops roll into your house and find some plants- even if it's way under 24 they look at them and if they even think there might be more than 4 oz in leaves and stems they chop them down, dry them and weigh them. The only thing they don't weigh is the main stalk. You are obviously young and naive. The AK law was made in 1975, long before you were born so I'll tell you how it was. There were no real buds on the plants like you have today to smoke. A chunk of seeds at best and people smoked the leaves. So that's what these cops bust you for nowadays leaves and stems and buds. You are obviously spreading your crap around the AK med forum because you are either cashcropping or dealing street baggies and don't want to have to go get a real job if it's legalized in August.

So how long have you lived in Alaska? How many times have you been busted for MJ growing in Alaska? How many years did you serve in prison and how many people convicted of MJ growing do you know from in prison? When was the last time the cops raided your house and busted you? I have a feeling the only thing you know is what you read. Unfortunately I know how it works from experience- inside and out. Peace
