Recreational use laws.

We all know there will be a vote coming up in November for us in AK to grow and posses MJ (again) for recreational use.

I hope it goes better than the last vote we had and I think it will.

Since I am out in the bush and don't have TV can anyone enlighten me on what the laws will be?

#1 How much can I grow for personal use?

#2 How much can I posses?

#3 Can we buy and sell it?

#4 what about selling or buying at a distributer? will we have distributers?

Any thoughts and ideas from anyone especially those in WA and CO that have some real experience on how it works there would be appreciated.

there are more stipulations than cut and dry yes and no....
 
Thanks I am new here and still a bit lost.

But I am an old Hippie and living out in the sticks without a TV keeps me kind of in the dark but now that I stumbled across this place I think that will be a lot easier now.

I would like to add that after the last election when the "Drug Zarr" came to Anchorage and threatened to take our highway funding if we all didn't vote to criminalize marijuana again.....and it worked!!!!

I have to say I lost a lot of respect for the average Alaskan voter that day and hope I don't see that again in this coming ballot measure it seams the average Alaskan has aged into an old hard right red neck and I will be pretty fucken pissed off if this gets shot down again.

Does anyone have an opinion on how this will go down I would love to have a bit of reassurance I would hate to have to move to Colorado or Washington after living over 30 yrs in this state beside they don't allow trapping there...the assholes :)

Thanks again FC so if we cant sell it how can we buy it? will we be able to get licenced to farm for dispensary sales at some point?

To expand on the possession amount, if you are growing your own plants at your home, then you are allowed to possess in your home whatever amount you can produce from your 3 mature plants. If you leave your home though, I think you are still limited to possess 1 oz

If you want to become a licensed producer you will need to apply through the state. There's not a lot of info out yet on this, but if I recall correctly BM2 stated that the fee could not exceed $5,000.
I think this is the part that has most people confused because in MMJ states any patient can donate their medication to dispensary.
 
Thanks Big Bud I was wondering how we could posses an oz and yet grow plants I think the intent of the prop was just to get the door opened up and go from there but I think it would be better to have sound laws right at the get go that are a little clearer than mud.

I as well think this is just to open the door. We'll have to wait til 2015 when an MCB gets established before the mud clears. 2016 before the first retail sale. and it wont be a "sale" as much as a "donation" for meds

From my understanding, the first retails sales could possibly happen in late 2015(9 months to establish the rules after the measure passes, and it also states that your application can take up to 3 months to get approved, so this would put the first stores in place as early as Nov'15)
Also since this will be recreational I believe they will also be called sales. The donation for meds method is used in MMJ states to avoid the issue of taxes as it's federally illegal. I see these rules changning sooner rather than later because Uncle Sam is going to want his cut too.
BM2 is also not suppose to change the interpretation of Ravin v State or the Alaska constitutional right to privacy, so there could be the possibility of you still being able to grow 24 plants depending how you interpret the law(it would be better to get a lawyer opinion on this if you were considering doing so)

Alaska legislators still have a lot to learn about cannabis, as I feel any law that limits your production by plant numbers is just frivolous. I could have a plant that yields 5lbs and I could have a plant that yields 1oz, yet in the eyes of the law they are still the same. The rules should be written according to canopy size, not plant numbers.

I agree most definitely that legislation needs to go with education. Weight limits not plant limits!
 
Good intel guys thanks for sharing.

I hope it goes through without a bunch of BS with it.

This could be a great opportunity for some folks in rural Alaska and everywhere to make a living growing at some point.
