Yes, and they need 60 votes. Not too likely is it. Even with the republican Senators from legal states: Alaska , Montana, Maine, Mitt, etc. So they go with decriminalization. Then the state can confiscate and fine. And I suppose that means they could take your fancy grow lights, and your $500 piece of glass. So can Biden just deregulate with just his signature? Not that I expect the old anslinger to do that.

It's gonna be hard to even get a decriminalization bill across the line without some arm twisting/having to make some concessions to Republicans in the senate. I doubt Cory Booker and his vision of the the bill having social equity/justice would get any support from Mitch and Co.
