They took my plants

Hi I live in Spain and had a visit from the police in July and they made me chop my two plants down.
They had just started to flower there was some debate as to whether they were male or female. However, their evidence shows a bag of well manicured buds weighing 800 odd grams with laboratory results showing THC and CBD content.
The police took a photo of the plant but have not included it in their evidence ( which would confirm my plant didn't have any buds on it).
I have a photo of the plant taken 9 days before dated and timed on my phone.
I have been charged with growing to sell which again is not true.
I am wondering does anyone know at what stage of the plants growth would it produce any THC or CBD that could be picked up in any laboratory test.
I am trying to prepare my evidence of a not guilty plea.
Any advice would be appreciated.

The plant has amounts of thc in it from the get go. Albeit in very minor amounts. If your plants were starting to flower there would 100% be thc present.

Post the pictures you took 9 days prior and it will be much easier to make a determination.

You got some balls to grow a plant that big outside in a country where it is illegal. I can see why they charged you with intent to sell. And yes that is a female plant and yes it had thc.

It is not illegal to grow. its just got to be out of public view.
I knew it was female but the police were unsure because it had very little bud growth.
Thanks for telling me it would of had THC.
I just need to work out my defence whether to question the police evidence (seemingly incorrect) or just work on the fact I had no intention of selling or for any part of it to leave my premises.

Was not aware you could legally grow in Spain. My mistake. Should have kept it out of view then haha.

Nice plant also. Looks really healthy. That is a shame. Easily a 2lb plant if the flower went without a hitch.

It would not be possible for that plant to produce mature bud in 9 days. In 3 or 4 weeks it would have buds but they would need another 4-8 weeks to ripen.

Cops are saying they pulled bud from that plant? It would look absolutely awful if they did. It would not look like anything you have seen that was called weed.

Yeh .. Ya fucked . Go guilty , take a slap on the hand , give the judge a drink and crack on with ya life .

Get a lawyer.
That’s not marijuana good for anything at that stage but yeah we know it would’ve gotten huge and full of thc via trichomes.
I think if you can go by trichomes, it ain’t weed.

I did go guilty in the primary hearing but the charge is now growing to sell. That is not the case and to go guilty is a tough one to swallow considering I have never been in a police station before let alone a criminal record. they have recommended 18 months prison and 8.000 euro fine

Hopefully you have a lawyer and he can contest the evidence as there is no way they could get buds unless they grew those plants out for another couple months then harvested and cured it themselves. I'd be fighting that intent to sell BS hard. Year and a half in jail is serious shit.
