Can MMJ patients/caregivers own GUNS

I read in the Colorado thread that they can not obtain a CCW/CPP permit.

Do we have the same problems they do in getting concealed weapons permits? If so, I could kick myself in the ass for getting a card.

When applying for a permit will the sheriff search the MMJ database?

Will it inhibit my ability to purchase another handgun?

Hey guys, what else am I forgetting to ask?

I do not think it will be a problem and noone can just scan the mmj card database. You should be good.

The only thing is you need to be a lot more careful if you own guns and grow you really need to stay within your limits with the MJ and take maximum safety precautions with your guns, if your over your limit and have guns its another felony you could get, although highly unlikely with all the protections afforded to us it is something to think about. Don't have loaded guns laying around and keep your guns locked up and your ammo locked up in another location.

and Ozz is right, they cant just scan your name and find out you are MMJ participant, they need your card # from your card to see if it is valid.

I agree with you about safety, but... if you keep your ammo separate from the weapon what good is it when you need it. That being said what I'm really going to do is carry when I go down into the D. FYI, I have no children and when I have visitors (adults or kids) I put everything under lock and key.

I was afraid that I would not be able to have a CPL. I have had a few hair raising stories from work about being in the wrong place at the wrong time in the D.

Deprave, I will take everything you tell me and put it to good use, because it is good advice.

right but what I am saying is that possessing a controlled substance in addition to a gun is a "crime" in itself, so be very careful to be within your limit if you have a gun on you, your best off not to have both at the same time, better safe than sorry. Example If you have a gun and 3.0ounces on you and are only allowed to posses 2.5 ounces you could be charged with 2 felonies, if that will hold up in court is a different story but PD just wants to charge people with crimes you know how they can be.

I've paid attention to your posts and few others here that I consider 'pros' and I listen well. I understand what you meant and I intend on following your advice. I will try to always be under limit and not transport. But, if I have to transport I will not carry. I don't think that I'd like jail.

I used to work down in Eastern Market and would be there by myself 3 pm until 6 pm. Some very strange people would hang out there even with the police mini-station (that closed at 5). A robbery there got me to get a gun.

Nope, I am from Oakland county. Sorry, but I love driving through the Hills. Sometimes when I'm heading to Chicago I'll take Michigan Ave as far as I can go. Love it there.

I have a disagreement with that line of thinking. Being in possession of a firearm is a felony only if you are in the act of committing another felony. If you have a card to grow and stay within your limits, you are not committing a crime, you are simply protecting your meds. :)

By law (federal) if you are growing even 1 MJ plant you are in the act of a felony.

So with a gun present in this act by federal law again you are in violation of two concurrent felonies.

I'm really surprised you are having a problem understanding this concept as it's
black and white,cut and dry.

You'd really struggle with the grey areas if you are not seeing these facts, imho.

I think this is the best (or only) option given this situation. I am legal even tho not technically a card carrying "MMJ Patent". Fortunately my state's laws allow me to use and grow cannabis in my home.
Another cool thing about the 49th state is we are allowed to carry concealed - no permit required.
I love this country !

When it comes down to it, I believe that a case could go to the state appellate court and maybe the Supreme court regarding state's rights. I believe if you already have the weapon and permit and THEN obtain a MMJ card, you have not lied or falsified documents and you are abiding by state laws in good faith. Any good lawyer will get the possession of a firearm in the commission of a felony thrown out of court for a MMJ card patient.

However, I am no lawyer and I'm not providing legal advice, only my opinion. :)
