"$14,000? What $14,000? Oh yeah, THAT $14,000. OK, just say he was money laundering, threaten him with the DEA, and we'll keep the cash."
​Here's a scenario which, unfortunately, could become all too familiar in the near future. A pot-phobic local police department, still angry and in denial over the legalization of medical marijuana, steals -- I mean, "seizes" -- cash from a dispensary owner, accuses him of "money laundering," and threatens to call in federal agents if the owner squawks.

Sound unlikely? Guess again. And welcome to Colorado Springs, Colorado. :finger:

A medical marijuana dispensary owner said he intends to sue the Colorado Springs Police Department over what he said was the illegal seizure of $14,000.

"No, you're not under arrest. Just give us all your money... because you were 'money laundering'! Yeah, that's it! 'Money laundering!'"
​Doctor's Orders and dispensary co-owner Robert Pooler plan to ask for $120,000 in damages from the city, reports Carlyn Ray Mitchell at The Colorado Springs Gazette. The money, proceeds from Pooler's medical marijuana business, was confiscated from him during a traffic stop.

Pooler said his car was illegally searched on June 30 after an officer saw a near-collision between Pooler's car and another vehicle, according to Pooler's attorney, Sean McAllister.

Pooler parked in a lot and got out of his car. When the officer asked for Pooler's license and proof of insurance, Pooler told the officer it was in the vehicle, at which point the officer went to the car and discovered the bank bag of money, McAllister said.

Many national banks are closing the accounts of medical marijuana dispensaries in order to avoid moving "marijuana money" across state lines, since cannabis is illegal under federal law, McAllister said. Pooler's bank account in Denver had been closed, and Pooler was moving his money to a Colorado Springs bank at the time of the incident, the attorney said.

Attorney Sean McAllister: "It's not money laundering if it's legal under Colorado state law. This is basically theft."
​Pooler wasn't arrested, but a police sergeant who called McAllister after police seized (stole) the money told McAllister police were "investigating Pooler for money laundering."

"It's not money laundering if it's legal under Colorado state law," McAllister said. "This is basically theft."

The officer also threatened to get the federal Drug Enforcement Administration involved, despite the federal government's current policy of not pursuing medical marijuana cases in states where it is legal, McAllister said.

Police have also seized Pooler's bank account, according to McAllister, making it impossible for him to deposit money from his marijuana dispensaries in Denver and Colorado Springs.

"This is legal money," McAllister said. "It is legal in the state of Colorado. This is a city police officer that should be enforcing the constitution of our state and not enforce federal law."

Pooler's notice of intent to sue gives the city 90 days to respond to his demand for repayment.

"If they don't see the light here, my client is willing to litigate his rights," McAllister said.

"Our hope is that they will see the light and resolve this short of a lawsuit, but if they don't, I think my clients are willing to teach them a lesson and show them how to comply with state law," McAllister said, reports Bryce Crawford at the Colorado Springs Independent.

The Colorado Springs Police Department, predictably, declined to comment.

Tensions between Colorado Springs police and dispensary owners have been very high in recent months.

In May, police searched seven medical marijuana dispensaries, supposedly as part of some unspecified "ongoing investigation."

Medical marijuana advocates said they were blind-sided by the raids, and that the searches were politically motivated.

No arrests were made in those searches, either.

This quote continues to be incorrect.

They used a battering ram to open the doors of know med grows in industrial areas. Then counted everything, took pictures and left.
One of them had been burglarized a couple weeks prior and reported to them. So they knew...

Searches are not the same as forced entry raids.

That's a lot of money to lose, and freezing his bank account??? Shit, he deserves not only his money back but to hit the CO Springs PD so they can return the money they took, plus pay his legal fees, PLUS be awarded a high dollar amount. True justice would be him getting his money back plus the cops involved having to pay his legal fees out of their own income, that would burn their ass bad. I lived in CO Springs for 9 months, and found out quick that most of the people there are too old fashioned , pro-war, and many still anti-MMJ. The Denver area is not without it's problems but is still a better place for MMJ people than CO Springs.

Hows about a full investigation into the Colorado Springs PD??? I am sure if they are fancied with extortion those criminals in blue have a whole slue of shit they need to be investigated for.
Better yet, just lock em up and throw the fucking keys away. There is no worse criminal than the ones that think they are vacinnated from it. I think for every crime committed by a criminal in blue we should be able to just blantly kill any random cop to even the idea of justice. I mean if we had a sanctioned gally or department that literally killed one random cop for every injustice commited by cops...Im willing to bet that would solve alot of police bred crime.......I know it sounds a little irrational, but I am positive it would be effective :)

By totally random I mean any cop, anywhere. Whenever 1 cop gets convicted of even the smallest of crimes...WHOOOPSSYYY there goes Sergant Morris or Trooper Davis...see where this could go...really make cops....be cops...not cops and criminals :)

thats why they made it ok for the despensaries so they could collect the fees for the city who is broke....thats why they are stealing money

Its not illegal for anyone to have $14,000 in their car...I got $7,000 on me right now..its not illegal

Actually i thought it was anything over 10k had to be accountable. if a cop stops you and you have 7k its cool but if its over 10k they can seize it till you can prove where you got it.

10 k is all you can have on your person if you are entering the USA without paying taxes on it

If banks are unwilling to take your money (banks are closing despensary business accounts because threats of federal penalties)... alot more store owners will be having the same issues

It is not illegal to carry any amount of cash, but quite imprudent to do so......The money would be suspected illegal and seized and then you have to hire a lawyer to fight for its return.

It is illegal to cross the borders of the US with more than $10,000
So its not illegal to have $100,000 on you.... in this case ....the money $14,000 came from a legal, registered, tax paying medical marijuana store

The cops who took the money had to give him a receipt for the $14,000 now he has to pay the attorneys fees & court costs to get it back...probably going to cost him more than $14,000 they took from him.

If the Cops lose the case and have to return the money.... they should have to pay all the costs involved in the case.....I bet there would be alot less of them if this were the case!!

This is how the city of Colo Springs Judicial system makes extra money.....false cases that cost people money

To those of you who are proponents of the city being "taught a lesson" by having to pay more than was stolen: where do you think that money is going to come from? The guilty cop's salary? Wrong. You and I get to pay it (assuming you live here too). I would rather not pay this MMC owner $100k in tax payer money just because the cops here are dicks. Give him his $14k back and punish the cops for their misbehavior. Leave me out of it.

I can see your point, but this is all about accountablilty. If you just let crooked cops or politicians (same things, really) do as they please, then you are part of the problem, not the solution. In today's money grubbing world the only effective way to punish evil doers is through the pocket book. And yes, most people relaize where lawsuit settlements come from. Now how long you do think it would take the general public to wise up and fire some dumb cops or remove bad politicians from office if they had to keep paying for their mistakes? Hopefully not long. Leave the jackals alone and they will continue to feed. Same as Wash D.C. People are sick and tired of the same old same old, and we continue to get robbed by the government.

It is under FED law if you cant show legitimate proof, its tax evasion, unless theres a loop hole with the state law and dispensary owners, but yeah fed law it is illegal, everything we do is illegal under federal law, shit just walking down the street, ASSHOLES took over everything or are trying to. F@CK Em!!! lol
