Commercial Property

Can two legally registered Patients, who reside together at a different residential location, use a commercial property to grow together? We will also be registered caregivers. Will this be an issue? does the "secure" area need to be at the residence to be shared between two people? We mean to share space only between the two of us and no more.






"D. Two primary caregivers who are members of the same family or household may share the same enclosed, locked facility."

"3. Enclosed, locked facility. "Enclosed, locked facility" means a closet, room, building, greenhouse or other enclosed area that is equipped with locks or other security devices that permit access only by a cardholder the individual authorized to cultivate the marijuana."

You can legally share a room(s) no matter where it is....

that might fall under "collective" depending how the state views it. But the law does say you can share a room..I say go for it

2 caregivers sharing a room is not a collective, no matter where the room is.....I know one person that rents rooms to 6 different caregivers, all inspected and approved by DHHS.....

2 caregivers can share the same room if they live together only. Read: members of the same household

Now someone can have a large commercial property with different rooms that have different keys and each caregiver/patient has they're own key and that's all well and fine. But for them to all share the same one space is not legal under our statute.

Not quite right. Two caregivers who have specific family relationships can share the same room.

"Member of the family" means a person who is aspouse, domestic partner, child, sibling, aunt, uncle, niece, nephew, parent, stepparent,grandparent or grandchild of another person. "Member of the family" includes a personliving with a person as a spouse and a natural parent of a child of a person."

It seems odd that you can share a room with your uncle but not your cousin. And the last sentence makes no sense at all.

LOL that's a riot MB. When you think about all the (supposedly) learned people who have to go through these things before they become law it's startling to see stuff like that. I know it's legislation not an essay but jeez, it ought to make grammatical sense.

I think it's trying to say that if you live you with your partner and have a kid together then you count as a family member. But it could also be saying that a polygamous relationship is ok, as long as there are only two caregivers and someone has a child.

I already have kids. I'm off to start a harem.

thats a tough one, not sure where you would advertise something like that.. MMJ friendly real estate agent would not be easy to find I would think. How did the upgrade go, I remember you just got a bunch of new equipment?

Yes, the upgrade went well, I'm more than pleased with those 1Ks , was my first time using them, will find out actual # s in few weeks but looks good so far...I have a real state agent that I have worked in the past with before and would use if that's the rout I would take, but considering security and everything else I would probably advertise and she would screen potential buyers...

it could be...I dont use them in the summer, got 2 green houses...
