Drug testing at check points in LA!!!

I was reading an article about how the LAPD is now not only testing people for alcohol at check point now there using drug test kits to test for marijuana use and other drugs but mainly THC.
Now i've also read articles in medical journals on how they say saliva swab tests aren't reliable for testing for THC, what would happen if you get a false positive? what if you smoked earlier or the day before will that count against you?
I'm not sure how they are supposed to differintiate between someone who smoked just prior to one that smoked lets say 4 hours ago then drove.
It blows my mind how they are doing this and all these question's haven't been answered seem's to me they are going to have a lot of lawyer's having a field day in court with this one that or a lot of people gonna get screwed.
What you all think?

With the way that drug tests work, at least the ones I'm familiar with, there is no way to do a quick test, roadside, that can tell the difference between if you smoked recently, or are currently under the influence. I can see them possibly doing something similar to a sobriety test, ie. walk the line, abc's backwards, etc, but to check for current THC levels, I was under the impression that it took a blood test.

I don't want stoned people driving on the roads. But I don't want people being done over for a joint they had 3 days earlier.

Not in Cali, but I was pulled over and for whatever reason was transported to a hospital to submit a urine analysis. Failed and was booked in on DUI. There was no way for me to refuse the test - the consequences for refusing the test were higher (still go to jail, lose license for longer period of time). Only probable cause was needed - officer stated he smelled marijuana in the vehicle. He found nothing when I gave him permission to search and so that led to me being drug tested. Same as you can't refuse a breathalyzer, you can't refuse to take UA. He waited 3.5 hours for me to piss, as well. Hard to pee when you know you're gonna fail.

I was not high, I hadn't even smoked in the car that morning. I'm nearly certain that he didn't actually smell anything, there was nothing to smell. I believe that when he ran my license, they reported back that I had been previously arrested for possession of marijuana and that led to the chain of events that resulted in me getting a DUI. If you cannot pass a drug test and drive, you are committing DUI, at least in my state.

How are hard is it to spot someone high driving? Going 14 MPH in a 45 on the way to mcdonalds! Lol with white skin looking like a Asian! No racial Pune intended! :wink:

idk man...if you're caught in a burger king drive thru with taco bell wrappers all over the seat i think the gig is up.

Damn, bro sounds like you got a shit deal you lawyer couldn't fight it? What did he say? say I mean this can't be constitutional that would mean I can never smoke at all and what if the cops a dick and does it just to be a dick im still getting screwed.
Its time to move to Colorado can't be dealing with that.

It sounds like the authorities anticipating a lot more stoner's on the road and figured hey let's make some money off of this. That's what this about money there going to milk it for all it's worth.

Not true unless you have had alcohol and are checked. Calif does not Per Say (sp) so they can't arrest you unless you fail a sobriety test for cannabis only.
