Federal agents want Michigan to turn over medical marijuana records as part of an investigation in the Lansing area, a sign that voter approval won't stop federal authorities from enforcing their drug laws.

Michigan voters agreed in 2008 to legalize the use of marijuana in treating some health problems.

But "the cultivation, possession and distribution of marijuana remains illegal under federal law," Assistant U.S. Attorney John Bruha said in a court filing last week.
The U.S. attorney's office has asked a judge to order the Department of Community Health to comply with a subpoena for records of seven people with medical marijuana or marijuana caregiver cards. The state has been resisting turning over the information because of a privacy provision in Michigan law, Bruha said. No names or identifying information about the seven are included in court documents, nor are details about the Drug Enforcement Administration's investigation.

DEA spokesman Rich Isaacson in Detroit wouldn't comment about the case Monday but said agents generally are "not targeting people that are unambiguously following the state medical marijuana law."

"The DEA targets large scale drug trafficking organizations and does not expend its resources on individuals possessing 'user amount' quantities of illegal drugs," he said.
The federal government apparently hasn't been in a rush to get the information: The subpoena was given to the Department of Community Health in June.

More than 45,000 people in Michigan are registered to use marijuana to ease the symptoms of cancer and other health problems. They can have up to 2 1/2 ounces of ready-to-use pot and up to 12 plants kept in an enclosed, locked facility. They could also choose to have a registered caregiver grow the drug for them.

Law enforcement officials have panned the law as poorly written, and an appeals court judge has called it a "maze." The American Civil Liberties Union is suing cities over anti-marijuana policies.

Yeah, wouldn't really trust a guv that destabilizes and coups other countries goverments for a living. :twisted:

I try to keep off as many of the government's lists as possible.

What if things changed and there was a push back against medical mj and some states got rid of their programs. What would happen to that list of patients?

It's unlikely IMO, but still scary.

Unlikely?????? It looks like it's starting to happen! We people in "legal" states often forget that it's still illegal under federal law. Federal law trumps state law, although I don't think it should. This is complete and utter bullshit but it should serve as a reminder that we have a lot of work ahead of us in order to get it legalized or decriminalized at the federal level. Don't think that just because you are "legal" under state guidelines that you have nothing to fear. Odds are they won't fuck with you but they could. That's not a comforting thought.:evil:

Not many people around here (where I live) get the California State Sanctioned Card.

Our law states that all that is required is a recommendation from a Licensed Medical Doctor.

Many people feel safer with the State Card, because it is basically a show your card and "Don't Get Arrested", if you only grow 6 Mature Plants.

The California MMJ is a little different from the other states.

there will be strenght in numbers.......... 45,000 aint shit for a state with a population over 10 million....... its gonna get huge in michigan!!!! theres over 100k mmj patiants in colorado!!!! and the state population is like half michigans.... they had there law since 2001....... michigan only since 2008.... there is strenght in numbers..... just keep making noise when the feds get on some bullshit... eventually they will lear... 30% of the nation lives in states with mmj!!!!! and that number is growing!!!! if it comes to illinois this january add another 13 million to that!!!!

This has happened in the past in other states. Same as this situation feds wanted records for some
individual patients records. They are not looking for all patients information just those they are after.
Regardless the medical marijuana should have nothing to do with their case and if the defendants say it does then they can introduce the information. And if the defendants do not then there is no claim to medical marijuana and thus no medical marijuana patients information needed.

from what i read they had alot of plants and usable product,if your going to have over 99 plants in any state your gunna get in trouble with the feds. if 2 caregivers get together and grow the max(144) plants your asking for trouble. just gotta be smart and not get greedy.

It was a grow co-op divided into locked indivdual grow rooms and no one had the keys to all the rooms, 40 plants were taken in the raid, hell one person can have 40 plants under michigan law. The person that owned the commercial building questioned the DEA during the raid about Obama's memo and was told Obama was a joke and he wasn't their President. The worst thing about this whole deal is the State Police went to a local judge to get a warrant and the judge denied it!!!! Then they went to the DEA with it and they jumped all over it. People said it looked like they were taking down an Al Qaeda cell, all over 40 plants. This is a wake up call people!!!!!!!!! The State Police went around the State law and used the feds for the dirty work. January 12th is the Federal hearing before a Federal judge to have the State open up the medical Marijuana records to the 7 people involved. Lets get everyone that can march on the Federal Building that day!!!!!!! There is Strength in Numbers......................This will never end untill we all Stand Together and say enough is enough!!!!!!

Hand Off are Medicine we the People Voted on this!!!!!!!!!!
