Got charged

So keep in mind I haven't grown any weed in close to a year now.....My room mate was at work one night and a police officer came in and he smelled like weed so they "detained" him.....while he was in questioning he said that he had smoked at our house and told them there was a bong and a pipe there so they went ahead and got a search warrant......

I get woken up at 1 in the morning to cops raiding my house. They had a search warrant for my room and his room, thats it......In my room they found less than a gram of weed, a pipe and a bong.....While "looking for his room" they stumbled across my old mother box that I had built, like I said, over a year ago, with a dead seedling in it, I can't stress enough everything in there is over a year old.

I was charged with possession of paraphernalia, possession of marijuana, and Manufacturing marijuana......

So my question to anyone is....is it possible for me to actually take the manufacturing charge even though the only plant they found was dead and it was probably 3 inches long?

I suppose it depends on a few things, like what state are you in? Some have draconian laws still on the books about pot. Also, how rough is the prosecutor, do you have or can you afford a top cxriminal defense attorney, etc.? Money still controls the justice system. With enough money, one can get away with most anything. Case in point, OJ Simpson.

you're roomie's an idiot. god knows how you weren't caught before.

it depends on how the prosecutor wants to proceed. if the seedling was super dead then just swear on you're life it's another plant. if they can prove it's a dead MJ plant tell them you know nothing about that, and the prosecutor might not want to damage his case by presenting a weak argument for that one thing...

other than that you're toast, they waltzed into your house and found you sleeping with a freshly cashed bong by your bed.

depending on your location, you could get probation and a fine. slap on the wrist...

you could face hard time in front of the wrong jury nd judge though.... thank god you weren't close to a school. that would've been mandatory minimum territory and you'd really be fucked......

get a good attorney... if you dont know any go to NORML they have a list of friendly attorneys...if there is such a thing as friendly attorneys

They would charge you with Rape and murder too if they could, Don't worry too much the police usually try to make as many charges as they can trying to make at least something stick. The DA will soon send you a plea agreement.

I'd ask for a jury trial and take my chances that the dead seedling will make the cops look like a bunch of idiots. What a waste of taxpayer money. Sad.

lol they got OJ.He's doing like 33 years now.I know it was a grudge for him beating that old case to.

the guys an idiot. instead of laying low, knowing everyone's waiting patiently to put him in jail, he goes and pays two thugs to shake down a memorabilia dealer who supposedly had OJ's stuff. even if it was OJ's stuff, the guy had LEGAL OWNERSHIP and PROOF OF CUSTODY for all of the items, if OJ wanted them back, he had to BUY them from him.

instead, he hired two tough guys, told them to have guns ready n shit, went to the guys hotel room (very "a la mob")... something could've gone very wrong and people could've died....

OJ's head isn't in the right place, that could've erupted into a crazy hostage situation....

i'm glad that nutjob's off the streets.

it wasn't a grudge against him. he wanted to get locked up..... there's no helping people like that....
