I need some advise/help with an Ebay topic :)

I won an auction and payed for it right away but now the person selling the auction sent me the money back and won't return my messages. I know that Ebay is a contract system between the seller and buyer so if this person doesn't sell me the auction because the auction didn't sell for as much $$ as they thought it would do I have any options. I won't go into to many details but I did or would have got a great deal saving a few thousand dollars. The seller lives out of state and I'm wondering if I can sue them being this is a contract between to parties. If I was to sign a contract with one of my clients and renig on the contract do to under bidding the job the client could sue me for the amount out. So if there is anyone out there that knows let me know.


This is going to suck if they don't keep there part of the contract, I was so jazzed about the auction...... errrrrrrrrrrrrrrr:evil:

You should not take E-bay to seriously. I found half the people associated with it to be a joke. If it sounds to good to be true, it usually is.

Probably not man. All you could probably do is get them in trouble for future transactions. A lot of over seas people are just looking to scam stupid americans,.... and they do it pretty good.

I work for a check cashing/payday advance place and you wouldn't believe how many people I see getting screwed over that dont realize it.

All you can do is make sure they have GOOD percentage... If you have 1000 transactions you should have 98+ percent positive.

you cant "sue" them if he gave your money back..be lucky he didnt just keep the money and not respond..

I guess so much for a contract. And the seller lives in USA, just not in my state.

I guess I will hope for the best. I will update after I call the person tomorrow.

I know this mite sound dumb but I have watched the peoples court, I think its based in New York and people sue seller/buyer. I don't know?????????

hey logan. You can contact ebay and let them know.
Last december I ordered a dual spectrum light off ebay for a good price and the shipping was more than affordable so I bid and won the auction.
Turns out buddy calculated the shipping wrong so asked for another $50.
Now I didn't have to do this but I knew that the shipping quote was unusually low and did not wish to see the seller ripped off either.
Once I sent that to him he then refunds all of my money back and says that it is going to cost him $200 to send the light. Well at this point I tell him to keep it.

I don't give the guy any bad rep because it was an honest mistake. He should have looked inot it first before he put up the auction but he didn't.

I had made all of these transactions via paypal.
Months later it turns out that each accidentally transaction that got sent back cost me $37.75. So my account at my bank took it out of my account. I have yet to get the situation corrected but have to call my bank today because of it and this was back last DECEMBER.

Ebay is a good system Logan but you can contact ebay and let them know about it. Thye have a department just for that. I think I am gonna be contacting them shortly also and I have 100$ postive feedback and have been a member for years.

I called Ebay Help line today and the rep directed me on how to file a non seller complaint. I will hear something back in the next 72 hours.

I'm pretty sure the seller is not selling because I got it for 1400 less then he wanted.
