Hey guys, whats up. I need alittle help here understanding what's about to happen to me. Wednesday night I wrecked my car and had been drinking, so I got a OVI. The thing thats really hurting me right now is that i'm 18, no job. Now this is my offense I've ever had so that could help me. I've looked stuff up and seen three days in jail is the minimum, or AEP ( Alcohol Education Program) which is still basically jail from what I've heard, it just a hotel room with no windows, T.V, and a bed...better than the floor I had to sleep on in jail I guess, and I have to goto a class during during those three days. Has anyone ever delt with this, what should I be looking at, is it possible that I can get off with fines, license supsion, and probation. I know what I did was wrong and am willing to deal with what ever the consequence is. BTW I live in ohio. TIA

Go to court yet? Be proactive and get in an Alcohol Education Program BEFORE court, and show the judge your paperwork. My bro got two DUI's and the lawyer suggested this to him. No jail sentence, both times, except for the initial lockups. This was in Cali

Prolly looks better if you've been in there for a couple weeks. Tomorrow they just may take your plea, innocent or guilty, and schedule another date for sentencing. If thats the case, go sign up so you got some time in the alchy class. Dont wait for the last sec. When in court, don't be overly confident, and use the "yes sir, no sir" shit that these authoritarian fucks love so much god damn them. Not sure about OH, but Cali courts are slow as fuck, clogged with illegals and interpreters.

btw, When you sign up for that class, they might ask you why. If the judge has not told you specifically to sign up for the class, don't tell them you are there because of court. This might end up on your paperwork and be read by the judge when you show him.

Also when in front of the judge, don't give him a bunch of excuses as to why it happened. That just pisses them off. I'd just look like the sorriest sombitch ever, terribly disappointed in myself. Might make it look like you were acting out of character.

Just use empathy.

haha, what's that suppose to me. But I haven't talked to a attorneys yet but my mom has a lawyer if we really need it. My plan for tomorrow is just to go in, plea guilty and expect the worst but hope for the best, give em want they want and go. Hopefully for this being my first charge ever, and being younger I can get away with the AEP thing (Services | STEPS at Liberty Center, Wooster; Wanye County, OH - Substance Abuse, Treatment, Education and Prevention Services not same place I'll go but same state) but if he decide he wants to be a dick he can just sit my ass in jail for three days...

You sure you want to go ahead and plea without even consulting with an attorney? I haven't got the balls to mess with the law like that, I always get an attorney (please note: I've never had criminal troubles, civil).

Seamaiden, your signature is rad. Making those babies crawl for freedom.

Yar its best to have an attorney. In your case, it seems pretty simple. You got in an accident, the cops showed, and you blew too high alcohol right? My brother had a lawyer, before paying for 40 grand in street signs he took out (yeah, just 4, imagine 10 thousand dollar stop signs), he had to pay like 15 grand to the lawyer.

Thats what I said, but after years of researching political corruption, it makes a whole lot more sense.

Ever seen how much a firestation pays for an axe? Check it out. Its not just axes and street signs either.

Typical stop signs, prolly the same you see in your neck of the woods. He did also take out 1 light pole, but the stop sign and some other street signs were about 10k each.

Typical politics. Whoever makes these signs is bribing the city planners. It's our punishment for letting them steal our money in the form of taxes without question.

I live on a private road, and the residents have to pay for our own signs and paving, etcetera. $10K bought us a big old piece of new road. A total of about $380 got us three new street signs, mounted on wood posts (which I thought was fucking moronic, who cares how it looks? I want the fucking thing to LAST and not fall over like all the God damned others! put that fucker on a metal pole).

Interesting op-ed piece was in our local paper last week (published 2x/week) regarding the county board of supervisors and how they want their salaries to be more in line with, get THIS, county superior court judges! They work PART TIME, are required to have no skills, no certification, no fucking EDUCATION, yet they want to be paid what a judge is paid. They're already earning close to $5k/month! Jesus, when I think about what I could do, what WE could do if I were earning even half that it fucking chaps my hide. And all this while the county has enacted a hard hiring freeze, zero cost of living pay raises, and has asked long-time employees to take an early retirement so the budget can be balanced. Yet these fucks, the board of supervisors, voted themselves a 21.5% pay raise.

What's fun about this shit on the local level is that, where I live, once I speak up, everyone will know about it and it'll probably make the paper. I've already begun writing (which is why I won't post a link to the story).

You know Dick Cheney's profiteering group, Halliburton takes 99 dollars for every load of military laundry they do? If a halliburton truck breaks down in Iraq, they set it on fire. Needs a new oil filter? Set it on fire.

Check out Cost Plus accounting. Nobody is going to win this war except for Halliburton and their buddies on the inside.

This is a HUGE upper middle class/upper class town in Orange County btw. Lots more corruption in big cities. Yeah even local government is fucked. They must be a whole shitload easier to bribe too.

Orange County, California? I come from La Habra (the Heights, but still, my old stompin' grounds).

And... don't get me started on Cheney. It'll get ugly if we get going on Halliburton, too. That company that Cheney allegedly divested himself from/of. Yeah, RIGHT.

Apply for the AEP class, and have your attorney file a motion for youthful offender status, which entitles you to expungement from your permanent record upon non violated completion of your probation.

And quit fuckin drinking and driving!!!!

well went to court today, and as you can see I'm not in jail! w00t, but I got off with the AEP course, some fines = to about 400, and probation for year, I believe I got very lucky.I went in there with no attorney, and plead guilty, and just took it like a man. I'm glad the whole things over with now, sucks it had to happen, but I'm kinda glad because I learned a very good lesson from all of this, dont drink and drive, and if im gonna play the game....i gotta pay.

That bs on the stop sign shit, I be like "where's the fuckin recpt for that shit"
