Patient-to-Patient Agreement's / Waivers

Hello Team RIU - have any of you that have done Patient-to-Patient Exchanges required your patients to sign any type of agreement / waiver. When i first donated money to acquire meds legally in AZ i was asked by the gentleman to sign a general waiver stating that i was legal etc.

Here is some language that i have used in the past and wanted to get some feedback from the group.

Do you use an agreement?

If not, why?

What do you like or dislike about this language - how could you improve upon it?

Arizona Proposition 203 Patient-to-Patient Agreement

Date: 9/15/2011

I MARK XXX acknowledge under penalty of law that by signing this Patient-to-Patient Agreement that I am a valid Arizona MMJ cardholder and am currently authorized under Arizona Proposition 203 to receive, use and possess medical marijuana as recommended by a licensed medical doctor.
I MARK XXX also recognize that I am not paying money or anything else of value for my Medical Marijuana; however I have chosen by my own free will to make a donation to help cover the fair and inherent costs of marijuana cultivation done legally under the statutes associated with Arizona Proposition 203.
I MARK XXX also agree not to provide medical marijuana to others who DO NOT possess a valid Arizona Medical Marijuana Card.
I MARK XXX also agree not to drive a vehicle or other heavy machinery while under the influence of Medical Marijuana.

Never will, have no need to, but the law was written to require dispensaries to track how much you use. I hate paper trails & will just follow the law as written which only requires I verify the person I am exchanging with is a card holder.

I realize since peeps don't know me they may be reading my posts as smart ass or know it all, I'm just hoping to help, no a-hole agenda !:joint:

Hey Wolfhound - thanks for the feedback. Let me ask you this, to what degree of validation are we held under the letter and the spirit of the law? Certainly there will be fake and or fraudulant AZ MMJ Cards - to what level of scrutiny are we required to inspect a card and how do we cover ourselves from a legal standpoint.

In no way am I arguing with you - I just want to debate this to make sure we are all covering ourselves to the best of our ability.

The law only reads that you both must have a card. I would not be able to verify if it was a legal card or not if it is a perfect fake. Since we are not law enforcement I think we are safe as long as the card is there.
If I had any suspicions I would tell them NO & walk away, fast. There has been at least one person busted donating to a LEO without a card ! You could be setup, as this person was, but inlikely. Just make sure the card looks good & you only donate, never sell or buy. Remember just one guys opinion & reading the law thoroughly is your best defense !

I recommend NOT showing anyone your card... If someone wants you to email your card info or anything move along... I take you for your word and when we meet if we meet I ask to take a quick look at card... Done... Do not give your info UP no matter what..

My big problem....
If you try to join a club they want you to email a copy of your ID and MMJ ID card... Do NOT do it... There is no true way for someone to verify your card unless they are law emforcement or an employer...

I don't think many will donate or trade with you if you don't show your card, I wouldn't want to be busted donating to someone without a card. Clubs etc & websites that want your card number should really be passed & only in person let others look at your card, sorry if I wasn't clear.:joint:

You could even go with dropping the Intial here and just go with the single sig @ the bottom.

I'm no lawyer...just a suggestion

Some people may feel they don't want to give out their MMcard number... But, that is up to you.
For me I would feel it is necessary.... All ways cover your ASS!
