You left out intent.

It's extremely difficult to prove intent and it's the biggest qualifier for the charge of murder.

there were 4 police officers holding guns on a man who was already on his knees.
there is NO excuse for hitting him at all at that point, much less kicking him.
they should have grabbed him, and in the process, heard him say he was an innocent bystander. a quick examination of the area should have shown them what was going on, that he got out of a parked car, and that the person they were actually looking for was still in the other car.....which was on fire......
and these are the people charged with keeping our families and cities safe.....

This is why "WE" keep our familia safe......fuck the police.

Something tells me if they are charged with anything it will be violating department policy (always let a burning criminal burn) rather than actual crime.
