Renting and growing medicine?

We have just moved into a really nice rental house, and it has a spare room downstairs that is unfinished. Both my fiancee and I have our red cards, and we have our 6 plants each. Fort Collins has a rule that you can't have over 12 plants in a residence anyway, so we will just keep the legal number. What I am wondering is if it is legal to grow in a rental house. We rent from a small time agency that is run by one or two people, and they are really nice and friendly. The lease does not specifically say if we can or cannot grow, it just says we have to abide by all rules, laws, and regulations. Including City, County, State, and FEDERAL laws. Now technically Eric Holder and Barack Obama said they will not interfere with patients rights in states that already have laws, but that doesn't mean it is federally LEGAL, Am I Right? I am just worried that this clause could screw me over.
I have a 7 foot monster just put into flowering today, and 4 2 footers, and a few seedlings in the veg area. I have a key lock on the door and my red cards available, and no one is allowed in there except me or my fiancee. I am going to get a LARGE carbon filter for smell, but I am still worried.
Now as far as the landlord finding out, he did say he will do a 60-90 day walk through just to check up on the house and make sure we are keeping up with cleaning and yard work stuff. He tried to make it not sound scary, but it still worries me that he can evict us if he finds out. Does anyone have any experience with landlords and growing medicine or should I consult an attorney before the walk through?
Just looking for someone to ease my mind or give me good info, Thanks!

thats a great question, i ve havent thought of that one yet, i would also like to see some replies about this one, thanks for asking dread.

Honestly I'd ask them how they feel about it once you've finished this round.
I know you risk exposure but there's no way you're going to be able to hide
a 7ft tall plant, especially when it's just entering flowering at that height.
How do you plan on managing that height btw?

It just doesn't seem worth it if they're against it and doing checkups
to get kicked out abruptly because they find out. Sounds like it could
be a real headache, and killing a crop early is a terrible feeling.

I,d just finish the flowering plants . Renters that are scared usally closet grow . Landlords don't have any business looking in closets.Just closet grow till u find out if they are going to walk through your house or not.

It is hard to closet grow with a 7 ft bush that is tied down and taking up 15-20 sq feet under a 1000w HPS :( She has 5 main tops that are tied down to about 5-6 ft, still 2 feet under light

i grow in an apartment in a tent, all i do is not talk to anyone, and dont call maintenance for shit. im adding 2 more lights and another tent to my setup as well...

edited to add:

just make sure you keep your grow area clean and arent damaging anything. then if they do come by, let them know you are growing legally.. that its for your medicine, and it is no different than growing other plants in the house.

Yes they could evict you based on that clause if they wanted to.

Yeah I'm willing to bet they could definitely evict you.

I had a friend who was growing in her apt legally, just
12 plant. She came home exhausted from work one day
to find a note on her door and several messages on her
answering machine stating that she had 12 hours to get
everything out of her apartment. On top of that she had
to break her lease, cost her 2k for that alone. She also
got charged for a lot of repairs in her apartment since
everything had been tainted by her "drug lab", nothing
else but those plants were in there.

Long story short, she had to kill her week 4 flowering sativas,
pay almost 5000$ in lease/repair fees, and had to move into
an over crampt apartment with some friends unable to grow or
get her own place for months to come. And she had her med
card out in Cali.

Point is other people own the property and might not like the
idea of "drugs" being in their property. It's better to find out for
sure and not have to deal with the problems that could ensue
from being caught. While jail time probably isn't a worry, I'm sure
having to listen to your fiance bitch would be enough to not make
you want to go through that.

Regardless, good luck on your endeavor.

ring the renting agency pretending to be someone else and say you are thinking of renting one of their houses and you are a mmc holder and want to grow your medicine there and see what they say

it's a legal grey area, unless explicitly stated in your state's medical marijuana amendment. i guess it depends on how willing you are to (potentially) fight in court.

a friend's landlord recently discovered all of their plants. he called the cops, they said that he had to deal with the problem himself. i'm not sure if he can kick them out. it didn't seem like he had the legal authority to do so. im sure he won't allow them renew their lease though

Still probably sucks living in a property owned by someone who
knows you're growing and hates it. I'd be very nervous that he
would go beyond his bounds and do something bad.

I like the anonymous call idea, just to see if they're 420 friendly.
Who knows, maybe they're looking for a caregiver and you could
grow bud for rent?

We tried emailing him about a property from an anonymous email, stating that the said person was a medical cardholder and wanted to grow her own medicine. We got an email back that simply said that property was rented, nothing about the medicine. I will have to wing it and hope that he doesn't want into the locked room in the basement, and hope that my carbon filter setup I am buying REALLY takes care of the smell.

As you requested, here is your tall plant porn. Here she is already tied down to control her height, but the light is almost flush against the 10 foot ceiling, and yes that is a 30 gallon trash can she is in, and the stalk is about the girth hand grip on a baseball bat. I should make some lumber out of her afterwords lol. She WILL be kept for decoration after harvest

Ok I looked into this also. Best bet is make you landlord aware of it before you move in. There is free legal advice in California pertaining this. Million dollar lawsuits have been won for evicted tenants. End of the day you will have made no friends from your landlord and they will find something else to get rid of you.

First off, they can't just enter the property unannounced. Many states have laws that require notification before entry, of at least 24 hours. Check your state laws on renter's rights. Most of the time, they enter only to do maintenance. It's possible that you'll never request that something be fixed.

I started a post about this same thing the other day...I saw a news report where this landlord was saying he and many others are not going to rent to any MMJ patients due to them being at risk of legal problems if the patient uses the property to grow/consume meds and possible commites a crime in the process.
And then there are some who say they simply refuse to rent to smokers, any smoke inside or out, and the law allows them this right.

I guess from a homeowners point of view...there are alot of things that can go bad by having someone growing on your property...you need to trust that this person is not an idiot for one, and honestly I'm not sure if I would feel comfortable with that going on in one of my houses without me there ( well I personally don't have "houses"..lol)
maybe if the state can come up with a way to keep the landlord out of Federal Court if the tenant fucks up...and they won't seize property, then things will change, we hope.
Good Luck...and nice plant! happy growing
I just realized this is Colorado...I'm in Michigan..lol...oh well, same shit going on here too! Peace
