Hey all,

Here's a question that has a funny story attached...

I know that my paperwork becomes valid as my temporary card, after 21 days. But my question is...is that 21 days from the date of me mailing it, or the date of the MMMP receiving it?

The reason I ask is because the envelope mailed via certified mail was apparently 'misplaced' at my local post office...I figured out what had happened about 5 days after I mailed it...and complained immediately. They lose a CERTIFIED MAIL envelope with the most personal information I've ever mailed out enclosed inside it. Needless to say, I was pissed...but they found it and it was delivered the next morning.

It is my understanding that it is 21 days after they cash your check.

The Ann Arbor clinic that I'm working with told me yesterday that it's 20 days from the date of postmark. They will honor my paperwork on that date. But, I believe ganja girls responce is probably more legally correct. I wondered about delayed mail, holidays, etc.

its 21 days after they cashed your check or money order, its written right in the law. they had my application for 5 days before the check cleared.

from the law:

(b) If the department fails to issue a valid registry identification card in response to a valid application or renewal submitted pursuant to this act within 20 days of its submission, the registry identification card shall be deemed granted, and a copy of the registry identification application or renewal shall be deemed a valid registry identification card.
I personally think that once they receive the application it has been officially "submitted". That's why you send certified mail, so when you get busted growing or possessing you can bust out the paper work and say "look, the application was submitted on x-x-xx, and here is my proof they got it".

I have heard that once they cash your check you are automatically valid under the reasoning that they must have approved if they cashed your check because they wouldn't cash it if they denied you. There is nothing in the law about that though, so I would just stick with 20 days after they received the application.

I would also print a copy of the cashed check as soon as they cash it so you have the 20 days on your side AND the argument that they have cashed your check, because you won't receive your card within the 20 days. They cashed mine a month ago and i'm still waiting on my card. Been legal with paperwork only for almost a month now.
