Appeals court rejects Trump’s bid to delay hush money trial over gag order
A New York appeals court on Tuesday rejected former President Trump’s last-ditch effort to delay his hush money criminal trial while he argues against a gag order the judge overseeing the case imposed.

Judge Juan Merchan’s gag order precludes Trump from attacking witnesses, prosecutors, court staff and the judge’s family, but doesn’t stop him from hurling insults at Manhattan District Attorney Alvin Bragg (D) or the judge himself.

During an emergency hearing Tuesday before Justice Cynthia Kern, Trump’s lawyers argued that banning public statements about those individuals is an unconstitutional prior restraint on his right to free speech while running for president and mounting his defense.

“The First Amendment harms arising from this gag order right now are irreparable,” said Trump lawyer Emil Bove, according to the Associated Press.

State prosecutors countered that Trump’s remarks threaten the “public interest in protecting the integrity of the trial.”

“This is not political debate. These are insults,” Steven Wu, appellate chief for the Manhattan district attorney’s office, said of Trump’s statements, according to the AP.

Trump’s lawyers had urged the judge to indefinitely pause the former president’s trial, which is scheduled to begin on April 15, via an emergency stay while they appeal the gag order. Kern declined to do so, meaning that barring further action, the trial date is set.

Trump’s lawsuit against Merchan over his gag order, which functions as an appeal, is under seal and not accessible to the public.

The former president previously employed the tactic in his civil fraud trial, when a different Manhattan judge issued a gag on his speech. Trump’s lawyers appealed the issue to the state’s highest court, which denied it.

Trump’s request to pause the trial while he argues against the gag order will now go to a full five-judge panel for consideration.

Merchan’s gag on Trump originally did not include his own family members or Bragg’s, but it was expanded after Trump took aim at the judge’s daughter, Loren. Loren Merchan works for the progressive political consulting firm Authentic, which has boasted clients such as President Biden and Vice President Harris.

In a separate effort to delay the trial, Trump’s lawyers have said that Merchan should recuse himself from the case over his daughter’s work, asserting that she has a “direct financial interest” in its outcome because of her work for Trump’s political opponents.

Trump is the 2024 presumptive GOP nominee who is expected to face Biden for the White House in November.

The hush money trial slated to be Trump’s first criminal trial and the first criminal trial of any former U.S. president. It was originally scheduled to begin on March 25, but was pushed back due to a last-minute document dump.

Trump faces 34 counts of falsifying business records in connection with a hush money payment his ex-fixer, Michael Cohen, made to a porn actress to keep her quiet about an alleged affair with the then-presidential candidate ahead of the 2016 election. He has pleaded not guilty.

I marvel at the silence from these same people about obtaining the recusal of Loose Cannon and Justis Thomas.
But he is getting an affirmative action pass because he is black.

Always remember that letting the bastards recruit your emotions is a win for the bastards.

The other thing is that that man is an effect of a bigger and more insidious program, a very long game (perhaps since the end of the Eisenhower years) run by the Federalist Society and allied organizations.

Chopping this particular festering head off the hydra does nothing to reduce the danger to the republic presented by neoliberal legislation and jurisprudence. They are confident enough that they are now showing their hand and endorsing Project 2025 — a roadmap for ending the republic by, of, for the people.

To go slightly deeper, there can be some confusion about the terms “neo-liberal” & “neo-conservative”: the two terms refer to the same ideological crowd.

“Neo-liberal” emerged sometime in the late ‘80s/early ‘90s (IIRC), when a group of ‘journalist/opinion-havers’ added a stiff right-facing crunch to their previously ‘respectably liberal’ (ie, not-very-liberal) POVs, which influenced the so-called “third-wave” democrats and the presidency/administration of Bill Clinton where domestic policies were ‘built to suit’ GOP.

With the advent of the Project for a New American Century, they morphed themselves into “neo-conservatives”…who, of course, eventually transmogrified into the MAGA mosh pit

Some names characteristic of this whole game of musical chairs include David Brooks, William Kristol, John Podhoretz, Paul Wolfowitz, & David Frum. To their credit, Kristol & Frum leapt from the traitors’ toboggan when it took its leap into “treason under color of bullshit”; Brooks has persisted as a ‘gadfly’ that stays close to TFFG’s stained trousers

The law does allow for some records to be considered personal property of the president, but legal experts have rebuffed Trump’s argument that the more than 300 highly classified records recovered from his property could in any way be considered personal.
I keep being surprised that no one ever mentions this, but:
Work-products produced by the government in the process of its duties CANNOT be considered “personal property” of ANYONE - *including* presidents, in office or not.

As an elected office-holder, the president functions as a “work for hire” employee…in exactly the same way that comic artists who created characters *cannot* own those characters: they - he - is hired to perform a job, the product of which belongs to the employer. In this case, said owner is the US citizen acting via the federal government.

Personally, I think comic artists should own a piece of their creative work, even if done for hire, but that does not apply to elected office-holders, who retain neither rights thereto, nor royalties therefrom.

The advocate for Trump claimed the Presidential Records Act gave Trump the right to take and claim any document as his personal property without following existing procedures for secret documents, which are, to first declassify them or at the very least telling NARA that he was taking them and claiming they were property. This makes zero sense from a practical point of view. But is something a criminal would want to be able to do.
Following up…in essence, the PRA differentiates between the GOVERNMENT’s work-product and the *office-holder’s* work-product.

A thing cannot be both, *by statute*…which is the POINT of the PRA

An appellate judge has REFUSED to pause proceedings as Trump fights his gag order in his New York criminal case.
(The appeals court denied a separate stay request yesterday.)

on a secondary front:
A five-judge panel will consider the matter further via written briefings. Trump's attorneys have a deadline of Monday morning to submit their final reply.
