i got hert at work...... and they gave me a drug test....... and i fail.... no shit huh..... but the thing is there policy is they fire u if fail....... i read that in wis. u can get 15% less for wrkmens comp...for a failed drug test but i cant find anything on unemployment....... would that fall under the "miss conduct" because i keep reading about people getting deied for misconduct.....

Pretty sure if you get fired you can't collect EI.

no if they fire you u can still get it but just files for it worse case is it is denied, not sure how its affected by workmans comp

get the wizinator and contest the test. When you contest the test ask for another one. Make sure you get the temp correct and be prepared for someone to keep an eye on you b/c its your 2nd test.

some places give it to you some dont for drugs they probally have a clause in there somewhere

Don't ask for advise from stoners. And if you are out of work you have prolly been gettin stoned and watchin the tube haven't you noticed all the workmans comp lawyer's. Should have been the first call you made or the next .

thats some shady shit you get hurt and they drug test you on the off chance they can get out of paying you workers comp. i woulda refused to take the drug test

If he passed the test he'd have kept his job even though there was an accident, but he failed and was fired that's the only difference. You'll still get unemployment and workmans comp just the same as anyone else, no less.

File a claim. You will probably get penalized a few weeks for getting fired, but you should still qualify for benefits.

It sucks that if you get hurt at work because of last night's binge drink hangover, that won't show up on a drug test, but having smoked some pot in your free time at some point in the last month is enough to shaft you. Now if you were high at work, then yeah, you deserve to lose your benefits, but otherwise you need to get yourself a lawyer. At the very least, go talk to a lawyer if you are denied benefits.
