US Customs is confiscating orders from Attitude...

Here is Colorado MMJ is not illegal. I stand by my original contention, that Attitude should guarantee all orders, not just those that include the stealth shipping option. Because this is a rare experience for me, ordering seeds online, I did not see the guarantee aspect as including protection against customs stealing seeds. I read the FAQ on the website and saw that it covered replacement in the "...unlikely event that it does not arrive..." No mention of confiscated seeds. Since this happened I have looked at other seed sites and see guaranteed delivery is common.

Sure, if you are familiar with this customs problem you know about the need to have the guarantee, but for someone who is relying on their website to know this risk, it just isn't made clear. I wish they had been willing to work with me, maybe pay for the guarantee and have them reship, which would have ensured my doing business with them again. But I feel burned by Attitude because the risk of losing my order was not made clear when I ordered. Why the hell would I ask for stealth shipping? It is not illegal here and I don't live with my parents? The stealth options do not mention the crap with customs, it looks like it is for minors in Kentucky. This is my first experience with this problem so I admit that I should have paid for the stealth, but was unaware that it was needed. Perhaps my bitching about it online will help the next person. Doing a chargeback with the merchant lets them know that their customer is seriously pissed with their service. I hope they get that message because I am pissed after paying for something that I did not receive. This risk is not made clear when placing an order.

IMO, there's no way you're going to win when they have tracking info showing they sent you your gear..

I lost my order, got nothing but their stupid crush proof tin. The genius sender left ONE LETTER for a signature. I emailed them explaining the problem, they asked me to send pictures. After sending the pictures and them getting my hopes up I get a response email saying they won't be refunding my money because I didn't buy their stupid shirt. It was 100% there fault I lost my money and they are refusing to refund it. In my eyes that is a scam.
Same story, different ending. I sent back the t-shirt and op it came in. No letter for a sig, no letter saying they confiscated the order however Attitude resent the entire order. Came in with no problems the second time. Attitude's CS gives me a boner just thinking about them!!!

WOW you should use your brain. Another member just said he had the same problem. If they don't leave a signature it's there fault plain and simple!

Any seed, not just marijuana is illegal to import without a permit. It does not matter if you live in a legal state or not. All states can be legal and it will still be illegal to order seeds from another country without a permit from the Gov. It's a USDA rule about non native species. You not getting the guarantee was your fault for not doing your homework. If you didn't realize there was a risk of you not getting your order, not getting your order isn't your problem. Again don't matter if you order Tomato seeds, or cannabis seeds, No permit, no entry if customs get's them. As a judge told me one time, ignorance is no excuse.

Kinda hung up on that signature thing aren't you? They don't pick packages to open because they don't like the sig. I'm an Amazon junkie, I get packages from all around the globe. I have had packs with no sig, check marks, a line, etc. I am currently looking at two Sea of Seeds packages, and the signatures are an S on one and what appears to be a scribble mark on the other.

To minimize any problems you should be sure the following information is visible on all packages you send to the US. Please visit the US Customs & Border Patrol site for detailed explanations of each of these items:

  1. Seller’s name and address
  2. Accurate description of the item(s) in English (this is how duty is calculated)
  3. Quantity of each type of item being shipped
  4. Purchase prices in USD
  5. Weight of the item(s)
  6. Country of origin of the product (note: for supplies and vintage this may differ from the seller’s country)
Foreign shipments that are not accompanied by a U.S. Customs & Border Patrol declaration form and an invoice may be subject to seizure, forfeiture or return to sender. Bummer!

That other member also said Attitude made it right for him. Why didn't they for you? Because he got the guaranteed shipping.

If you count the increased number of confiscation reports on RIU and other forums it is clear that there is something going on with customs and the seed sellers. Perhaps they see the end of their MMJ jobs on the horizon and want to get in as many confiscations as possible before the law finally changes.

Not sure if killing the payment with the CC will hold, but it is worth a shot. I see it as the sellers responsibility to get the seeds delivered, otherwise I don't owe them anything. It is not my job to research the details of law it is theirs, if they want to stay in business. I sent a picture of the opened envelope with customs tape to attitude, so they know why I asked the CC to not pay them. The copy paste is nice to see here because it confirms my claim that they do not make it clear that theft by customs is a risk. The implication in their guarantee is that the package might get lost in transit, not opened by customs, which is not expressly covered by their guarantee. Fuck this nit picking, attitude should insure all deliveries because of this shit, like other companies in this business.

The customer needs to get the seller's product or no money should change hands. I paid for delivery and did not receive the product. The details are for the seller to figure out.

Where to even begin with this mess.. my copy and paste clearly shows that they say if.you don't buy the guarantee, the risk falls squarely on your shoulders ..
Do.you get into a car accident then get pissed that the place is.going to charge you $5k because you failed to buy insurance for it?
And how's it not your job.to check any laws that may apply to anything you order.. 99% of seeed banks state right on the site that possession of.cannabis seeds is illegal almost every where, and by ordering you understand it's your job to make sure that what you're ordering is legal where you live..

and any way you look at it, cancelling a cc payment is such a lowly thing to do after a company sent you your gear, illegal gear at that, and that customs did their.job of.confiscating illegal gear being sent through the mail illegally..
And.of.course seed banks don't post claims that customs might snag your gear as I'd think that goes without saying..
What do.you.expect.them to say?? Warning warning.. possession of cannabis seeds is against federal law, and customs, who happen to be a federal agency whose job it is to catch illegal items in the mail might catch your.illegal seeds in the mail, being that they're illegal and all??
Do you see how silly that sounds??

and attitude did their part, they sent you the seeds you.paid.for, but now want to hold back payment for.. with your.logic, you.might as well try and sue customs while you're at holding back payment for seeeds that were sent to you.. :wall:

I would love to ask customs to release the seeds, we are very close to the legal threshold where that would work, but because they do not have a phyto-something permit, they cannot ship seeds without risk of interception, the seller is taking this risk, not the buyer. It is not incumbent upon the buyer to know that there is a risk of confiscation by customs, it is the seller's job to deliver the product.

If I sold you an ounce of weed, would you pay for it if I sent it and it got intercepted?

I Made My First Order With Attitude ForTheir October Special. After Twelve Days I GotThe Green Tape And No BEans. I Sent An Email With A Pic AndTwo Days Later I Got An Email Saying Order Was Being Processed. Not To Bad In My Opinion. Keeping My Fingers Crossed. On A Side Note I Ordered From Nirvana A Month Earlier And Got It With No Problems In 8 Days.

Yea. You sent it. I'm not a piece of shit. It is not up to the seller to get a permit to sell seeds, it is up to the buyer. Always has been. And if you didn't know the risk of buying, you are already in over your head. These arguments that they weren't clear about the stealth shipping insures against seizure doesn't hold water. The risk of confiscation is clear on their website. It says to check your local laws.
For your own protection we 'require' you to inquire about and comply with all local laws and international laws governing the purchase of marijuana seeds/cannabis seeds in your part of the world. In many countries, it is illegal to germinate these cannabis seeds. By ordering, 'you confirm that you checked your local and international law and it is safe to do so' and that the responsibility for that decision rests solely upon you.

So, as you can see, you are totally wrong. Not sure where you get your info, or if you understand what you read, but you are in the wrong. You did not do the part that Attitude requires. They take no risk. It is not illegal for them to sell the seeds, it is illegal for you to buy them.
You did not get one statement in this post correct. Actually, not sure how one old enough to grow would not know these things. I think laziness and lack of reading.

Attitude did their job. I hope they press charges on you to get the money if you stopped payment. You broke international law, not Attitude.

It is totally your job to research the details of the law. How is it theirs? They aren't in the USA. This is all on you. It is not the sellers responsibility to get the seeds delivered. It is only their responsibility to mail them. Which other companies insure all deliveries? Not Herbie's, or SoS, or Ali Bongo. Your thinking that everyone is supposed to do your work for you is fucked up. If I buy a car from you, pay you for it, and arrange delivery, do you give me the money back if something happens to the delivery truck and I don't get my car? Customer needs to get the sellers product or no money should change hands. So, I get my money back and you are out a car. Now you see how fucked your thinking is. When the credit card company investigates, they will rule against you. And then they will know you bought seeds.:dunce:
