Washington state HB 2401 will effectively undo our states Medical Marijuana protection. Here is a link to the text of the bill
http://apps.leg.wa.gov/documents/billdocs/2009-10/Pdf/Bills/House Bills/2401.pdf

Go to SEC.86 page 74, start reading, notice where they strike out lines 14-26, the very lines that establish the affirmative defense , Also ,at the end of that SEC. they repeal most of the guts out of Medical Marijuana.
While most of the post I have read are all jazzed about being able to buy pot from the state , but I bet almost none of those people have read the whole document ...:-(

Perhaps it is because you wouldn't have to have such a defense?

If it is legal then it won't matter whether it is for medical reasons or not... therefore they can't do anything to you... because it is legal.

Remember the first couple lines mate... takes away all penalties. ;)

You should be ecstatic! This is the most progressive piece of legislature concerning marijuana that I've read in a while.

1 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
2 NEW SECTION. Sec. 1. A new section is added to chapter 9.94A RCW
3 to read as follows:
4 It is the intent of the legislature to:
5 (1) Legalize marijuana and its derivatives;
6 (2) Remove all existing civil and criminal penalties for adults
7 twenty-one years of age or older who cultivate, possess, transport,
8 sell, or use marijuana, without impacting existing laws proscribing
9 dangerous activities while under the influence of marijuana, or certain
10 conduct that exposes younger persons to marijuana;
11 (3) Raise funds and discourage substance abuse by the imposition of
12 a tax on the legal sale of marijuana, the proceeds of which will
13 support drug education and awareness; and
14 (4) Impose a set of rules and laws concerning marijuana comparable
15 to those imposed on alcohol.

All it says here is that they are legalizing it and taxing it to keep the money spent on it out of the black market. The only people that should be pissed are the dealers. If you are a medical user you can still grow your own. They struck out Lines 14-26 in Sec. 86 because they are unnecessary under the new law. they're trying to remove bureaucratic clutter. If Washington does this properly and the residents don't go apeshit then this could be the catalyst leading to legalization in other states and eventually the whole country.

Maybe I am just a natural born worrier (sp?) but I don't see anywhere in this bill that allows for personal cultivation being allowed.. PLEASE SHOW ME THE SECTION WHERE IT SAYS WE CAN GROW OUR OWN.... sure it says that cannabis will be legal to possess(adults) as long as we bought it from the government store, if you are caught with cannabis that does not have the state stamp on it you will get busted...
AS I SAID MAYBE IT'S ME? BUT I SEE THIS AS A DESPERATE GRAB AT THE POT INDUSTRY BY THE STATE, BECAUSE THE POLITICIANS SEE THE WRITING ON THE WALL, THEY SEE THE POLLS, AND THEY KNOW THAT IF THE INITIATIVE PROCESS WORKS HERE IN WA. STATE AND THE PEOPLE FORCE THEM TO LEGALIZE MJ ,THEN THEY WILL BE SCREWED OUT OF BEING THE NEW DRUG CARTEL IN WA.STATE. IT'S ALL ABOUT MONEY....
I JUST ASK MYSELF , DO I WANT TO HAVE TO BUY STATE WEED OR SHOULD I BE FREE TO GROW MY OWN? I AM PUSHING THE INITIATIVE AND I AM NOT FOR HB 2401.

Yeah, as long as you get a license from the state to grow....
I don't know, there is way too much legalese in this bill, I still say the best bet is to sign the initiative and then vote for flat out legalization in November.

There is hardly any legalese in there, Cultivate means to grow. It looks pretty good, except #4 where they will impose rules comparable to alcohol. Its kind of vague, it could mean they will have checkpoints where you piss in a cup and if it comes up positive, well its DUI time for you. Who knows.

I can easily understand, and approve of, imposing rules similar to alcohol. Some people just shouldn't smoke and drive, myself included. Even if you can drive like a fucking wheel-man stoned, you should accept the compromise they're offering. As for having to have a state license to grow your own, just go to your local courthouse, fill out the paperwork, pay the taxes, and go home and plant your seeds. It's the same thing they do with tobacco. If it's simply a matter of having to pay a tax to get the license, suck it up. I would pay five grand with a smile on my face (probably an illegal one!:-P) if they would give me a grow license in Alabama. Shit! I'm balls to the wall on our Medical Marijuana here in Alabama even though I'm a far sight from coming close to meeting the requirements for a prescription. I just know that change begets change and if your bill passes then Washington is in the final stages concerning marijuana. Be happy with what your given for now, see how it works out, and if you're still unhappy with it in a year fight for change then, but for the love of whatever God(s) you pray to don't ruin it before you even get it.

Senator - Patty Murray has already spoke on this piece of garbage legislation....
She states that she has absolutely NO intentions of working with legalization against the federal governments rulings. She put the big kabash on that Real quick... I read it in it's entirety the day before it was proposed.. it ain't goin' nowhere...

Really? Well, I'm still sending them letters anyways. It couldn't hurt.

Cultivation of 3 plants for ages 21 and up would still mean yields of over a pound if grown with quality equipment

NO DRAMA; You say " There is hardly any legalese in there"
What are you talking about ? I can't believe that you have read the entire text of the bill.
MR.RED; IF it is going to be legal for adults to grow, why did they feel the need to eliminate the lines in 69.51 that provide an affirmative defense for Medical Marijuana growers or their caregivers ?
JUNIPER #8; Why should medMar patients have to get a license to grow , they don't have to now.
JUST ANOTHER FRIED DAY #11 You should put your energies into the initiative that will soon be out, sign it , vote for it . The citizens initiative completely eliminates the laws against adult use, cultivation of Cannabis. As I believe, HB2401 just gives the state the total control over Cannabis cultivation AND sale. WHY WOULD ANYONE WANT THAT ?

Still, it's a step in the right direction and I doubt it will disappear. look for it to come up again next year.
We "the people" do NOT have to wait till next year , their is an initiative to sign and get onto the November elections, if it passes it will legalize Cannabis for adults.
Of course our weasels in Olympia will probably file a lawsuit against it (US) because it conflicts with Federal Law, and our politicians don't have the guts to go against the Feds,,,,,guess the 10th amendment means nothing.

But we the peopl have the right to vote out people out if they dont meet our requirements.

I think it will pass myself.

I know a lot of people that are going to meetings in olympia to lobby for this.

Patty Murray is concerned about the Boeing Tanker deal right now and that is where she is focusing her energy. She might fail in the mj arena, but her main agenda is getting jobs for her constituents and keeping jobs here.

I do not like the idea of pot being purchased in a liquor store, reciope for disaster. If dispensaries were open to everyone that is diffrerent.

What does Patty Murray have to do with it? I was referring to a state of Washington initiative.
