That really sux for you, but we all know what can happen when we started. We may not fully REALIZE just how bad shit can get, but we ARE engaged in an illegal activity, and that's just one of the possibilities we have to accept.
That being said, Canadian law isn't substantially different from ours. Both are base in English common law. The people involved aren't that much different either.
Sounds to me like you had the misfortune to get a cop who didn't get that blow job he wanted that morning, and is pissed at the world.
He CHARGED you with possession of over 30 grams. They can CHARGE you with anything remotely relevant, and let the judge decide if it sticks. Did he charge you with possession or cultivation? They will try to charge you with everything that those plants have the
potential to produce. But all you can really be CONVICTED of is possession of the amount you had at the time. They will weigh it wet, probably weigh the dirt and container too.
Are they saying you were gonna sell? Sounds like Canada is becoming like the US, where something that you
COULD do is illegal.
I know a guy who was charged with possession of burglary tools. He got pulled over in an area that was less than savory, and had the bad luck to have a pry bar (Tire Iron) and some other tools in the open bed of his truck. Cop said he
could be using them to break into homes. Case was dismissed, but he still spent time in jail, paid bond, and now has a record of arrest.
Bottom line... Get a lawyer!!! You'll be fine. They will charge you with everything under the sun hoping that it will scare you into admitting guilt on the lesser of the charges, and 99% of the time...It works!!!
