HALIFAX - A Halifax-based law firm has launched a class-action lawsuit against Canopy Growth and its subsidiary Mettrum over recalls of medical marijuana that contained unauthorized pesticides.

In a statement of claim filed with Nova Scotia's Supreme Court, Wagners alleges that Mettrum breached its contract with consumers and that its development, distribution and sale of medical marijuana was negligent.

Canopy Growth, Canada's largest publicly traded medical marijuana producer, purchased Mettrum earlier this year.

A spokesman for Canopy Growth said Tuesday he couldn't comment immediately on the lawsuit because he hadn't seen it.

Lawyer Ray Wagner says representative plaintiff Neal Partington, a house painter from Nova Scotia, says he suffered severe nausea and vomiting over the six months that he was taking Mettrum products to deal with symptoms of an injury.

Wagner says it could take six to eight months before the court decides whether to certify the class-action lawsuit.

The allegations in the statement of claim have not been proven in court.

Canopy Growth CEO Bruce Linton has said that the use of unregistered pest control products was "inexcusable" but that Health Canada had determined the pesticide wasn't likely to cause any adverse health consequences.

geez HC is so far from anything resembling reality.
if someone from their family smoked that poison and got sick, they sure would be saying different things!

Actually the problem here is Mettrum broke a federal law and used pesticides off label. Its illegal in Canada to use pesticides off label. So if the crop is not listed on the label is illegal to use the pesticide on it.

How exactly did they 'determine' that? I want a copy of that study and report...or are they lying....? Everyone needs to flood HC and your MP with demands to see that report. Either they have proof that the chemical is safe to inhale....or they have issued false statements to protect the LP system over the safety of patients. Given enough attention, this has the ability to blow the LP - government scam wide open.

Considering the manufacturer of said chemical, DOW has stated the harms associated with its use on combustible crops such as Tobacco and Cannabis which is why its BANNED for those uses PERIOD, it is easy to see HC is trying to help minimize this class action which is a black eye to their "infaliable" program.

Only problem being that DOW being a multi billion dollar company, wont be so quick to rollover on the matter. They have NO vested interests in this fight. And have already stated that that product was not for combustible crops, with Cannabis being stated specifically. So how is HC or any LP to prove they know better than the chemists who created it? THEY CANT

We know that, but HC just claimed otherwise. Our national health agency is protecting the corporate business interests of an industry with questionable political connections over the safety of Canadians. Given that their sole reason for existence (and feeding at the trough) is to protect Canadian consumers from dangerous products, they need to be charged and fired.

Once the case gets into Discovery, all HC communications with said LP will have to be disclosed. HC will be called to testify, and would be considered a hostile witness....while DOW executives may very well be subpoenaed to testify on behalf of the plaintiffs. This lawsuit is like throwing an unopened can of baked beans into the fire...when it blows, it's gonna get messy!
