TRUMP CONVICTED

It's kinda funny, the 14th amendment appears to be a trap for republicans and should disqualify Trump from the general election ballot, aside from his trouble in court, eventual conviction and imminent incarceration. He is leading the republican field by a mile and his base seems impervious to reason or facts and ignoring his many criminal indictments, or they are making him even more popular among the miscreants. It kinda looks like Trump can run in the primaries because the nominee is not a federal office, but he will likely be disqualified for the general election. It might be very useful for the republican party to know this for sure ASAP, but there is a problem. Trump cannot be disqualified from the ballot until he applies in a state to run for president and that won't be until September of 24 and varies from state to state. He can only be challenged when he applies to run, just like the congress people and I figure it will take a week from denial and challenge to get in front of the SCOTUS and a decision will be quickly rendered, they are already thinking about it I'll bet.

If Trump wins the republican nomination, even from a cell, they can't dump him until he is actually disqualified, on the eve of the election, hopefully before the ballots are printed in the states. His appearance on the primary ballot will be challenged and they will probably lose, but the SCOTUS could do them a favor and declare Trump disqualified from the general election based on the evidence presented when they rule on the primaries. Trump should be convicted of multiple felonies by then, some involving J6 and the associated conspiracies.

That's the way I read the upcoming 2024 election, if Trump wins the GOP nomination, he will be a dead man walking anyway as far as the presidency goes and in a cell of some kind by election day where he will be largely muzzled except for visitor's day when Kevin and MTG arrive. I doubt his wife will visit him even once and those family members who don't end up joining him in prison won't visit either. If the republican base doesn't buy that he is a disqualified convicted criminal, the general election voters will.

Trump's political future will be decided one day after the trial that decides his personal future is set to begin.

Federal judge sets March trial date in Trump's election interference case

WASHINGTON — The judge overseeing former President Donald Trump’s election interference case in federal court set a trial date for March 4, 2024, a schedule that could have a crucial impact on the 2024 race for the White House.
U.S. District Judge Tanya Chutkan's decision sets the trial in the middle of the Republican presidential primaries and the day before Super Tuesday.

At least that's the day it's set to begin NOW. Of course, Trump's team will make objections and try to delay it. I'm guessing that this time they will not prevail. Trump's MAGA rogues have been making death threats to the judge. For the sake of everyone involved except Trump, his trials will have to be done expeditiously.

A 6 to 8 week trial the experts say, let's say there are some minor delays and the later date, the verdict should not be long in coming either. Looks like a verdict by June to me, or before the convention. A lot of evidence will be coming out in public during the trial, even though it's not on TV, we will see how well his Teflon coating holds out with the base.

12.8 million documents of discovery shared in Trump Jan. 6 case, prosecutors say
In the federal case probing former President Trump’s efforts to overturn the 2020 election, prosecutors have turned over 12.8 million documents to the former president’s legal team as part of discovery, prosecutors said Monday.
Trump faces four criminal charges in Washington, D.C., tied to his actions after losing the 2020 election, culminating in the Jan. 6, 2021, Capitol attack.

On Monday, U.S. District Judge Tanya Chutkan set a trial date of March 4 in the case — a date strongly objected to by Trump’s legal team, which argued that it would take substantially more time than that to get familiar with discovery and ensure the former president is “adequately represented.”
A quarter of the 12.8 million documents are associated with Trump’s campaign or political action committees that have supported it, according to prosecutor Molly Gaston.
Transcripts of grand jury testimony and accompanying exhibits make up 5 million of the documents, and 3million documents originated from the Secret Service, she said.

But Trump has had “access functionally” to about two-thirds of the total documents, Gaston said. Some 7.8 million documents are from “entities associated with the defendant,” from National Archives documents to open-source material like tweets, Truth Social posts or information made public by the House Jan. 6 committee that investigated the Capitol attack.
The government also produced 47,000 “key documents” to the defense, including an annotated indictment Gaston said is a “road map” to the government’s case.
The government originally proposed a trial date of Jan. 2 in the D.C. case, while defense attorneys suggested an April 2026 date.

Trump attorney John Lauro said going to trial on the government’s timeline would be a “violation of the oath to do justice” due to the “avalanche of information” turned over in discovery.

He said the March 4 date is “inconsistent with President Trump’s right to due process.”
“Mr. Trump is entitled to a defense that is reasonably prepared; it would be a miscarriage of justice if they don’t get that kind of defense,” he said.

“And they’re going to get it,” Chutkan replied. “I intend to ensure he gets it.”

Who is judge Steve Jones, who will decide whether to move Fulton County defendants’ cases to federal court
Federal Judge Steve Jones of the Northern District of Georgia is slated to hear requests from the Fulton County defendants who are seeking to move their cases to federal court.

Jones was appointed by former President Obama and was confirmed by the Senate in 2011 in a 90-0 vote. Before serving in federal court, Jones had served as a judge of the 10th Superior Court District of Georgia since 1995.

Jones was born and raised in Athens, Georgia and attended the University of Georgia for both his undergraduate and law degree, which he received in 1987.

Jones will hear from at least five defendants seeking to move their cases, who are among 19 individuals charged with attempting to overturn the 2020 election in Georgia: Mark Meadows, former President Trump’s White House chief of staff; Jeffrey Clark, a former Justice Department official; David Shafer, a fake elector and former Georgia Republican Party chairman; Shawn Still, now a sitting state senator; and Cathy Latham, the then-chairwoman of the Coffee County, Ga., Republican Party.

The judge has already weighed in on the Georgia election case by denying requests from Meadows and Clark to block their arrest in Fulton County last week. The co-defendants had argued that their arrest and state proceedings should be halted as they attempt to move their cases to federal court.

“As Meadows’s arguments and cases cited to the contrary are not persuasive, the Court denies Meadows’s request for the Court to decide its jurisdiction over his criminal case before holding an evidentiary hearing,” Jones ruled in Meadows’s case.

Meadows’s hearing on whether his case will be moved to federal court began Monday morning.

Jones has also made other significant rulings in the state. Just last month, he refused to dismiss lawsuits alleging that Georgia’s congressional and legislative districts illegally discriminate against Black voters, saying that he must hear the facts in a full trial.

He also ruled in 2020 that a six-week abortion ban in the state was unconstitutional, saying that a woman has a “constitutional liberty” to have “some freedom to terminate her pregnancy.”

Trump will be found guilty of conspiring to defraud the 2020 election by the end of April.

Those are the tastiest words I've ever written, so I'll just stop right there and savor them.

I'm being conservative in my estimates and accounting for delays, May or June works too, better in fact if it helps a disqualified Trump get the GOP nomination and start a civil war inside the GOP between the base and establishment over the 14th. The ones with brains can see it coming if the morons in the base can't. Joe is hoping for it!

I gave it a few extra weeks beyond the 8 that is needed to complete a typical trial. There is wiggle room to finish the trial later and still finish before the end of the primary season. But this indictment was written for a speedy trial. It's going to be over by end of April. That's my prediction and I'm sticking to it.

I don't care what that guy thinks. He is nobody to me. I no longer see CNN since that reporter gave Loser45 a wimpy interview. Well, two exceptions; Brianna Keilar, the only one I've seen to consistently call the defendant a liar, and Erin Burnett.

What happens AFTER Trump is found guilty, according to the Department of Justice:

Post-trial Motions
If the defendant is convicted, there are several motions that can be filed after the trial is over. Common post-trial motions include:

  • Motion for a New Trial – The court can vacate the judgment and allow for a new trial. This is rarely granted, but may be done “if the interest of justice so requires.”
  • Motion for Judgment of Acquittal – Court may set aside the jury’s verdict and allow the defendant to go free.

Sentencing of Defendant after Conviction
A few months after the defendant is found guilty (by pleading guilty or by trial), they return to court to be sentenced.
The judge receives guidance and assistance from several sources in order to sentence a defendant. The United States Sentencing Commission has produced a set of sentencing guidelines that recommend certain punishments for certain crimes while considering various factors. Further, the judge will look at a presentence investigation report and consider statements from the victims as well as the defendant and lawyers.
The judge may consider a variety of aggravating or mitigating factors. These include whether the defendant has committed the same crime before, whether the defendant has expressed regret for the crime, and the nature of the crime itself. At sentencing, the court can order imprisonment, supervised release/probation, restitution or community service.

What will be denied: Motion for a new trial and Motion for judgement of acquittal. That won't take long. Of course Trump will appeal and that will push back the date when his incarceration begins by a year or more. Won't affect sentencing, though. So, "a few months" means what? Three? May, June, July = 3 months. End of July/first of August, perhaps?

What happens before then? July 15-July 18. It would be a shame if Trump's impending sentencing were hanging over the Republican National Convention. Nothing cries louder than an aggrieved Republican. Be ready and have your ear plugs at hand.

For crimes like his, the cuffs often go on in court, especially if a long prison sentence is in the cards and he is on pretrial release in other jurisdictions, I think she will hold him in custody pending sentencing, sending him to Georgia and NY as required. Though if Trump continues his present course, he might get locked up pretrial.

You made a bet with the forum on this a while ago. You set terms where we were supposed to send you money if you turned out to be right. I'm not saying I accept but a bet can't be one-sided. What terms were you proposing for yourself if we turn out to be right?
I don't want anyone's money. I won't even be the "tolduso" guy. I just have ZERO faith in our system

If yall are right though, that may restore SOME faith. . ..

It's already for that. It's too late because you have already told us so. You seemed pretty confident a while ago. Are you losing confidence and now unwilling to make a statement of accountability if it turns out you were wrong?

Since you seem to be waffling now. I'll just put this out there with some gentle humor:

To everybody who felt Pops was targeting when them when he told us we had to give him money when it finally turns out that he was right in his prediction that Trump will not be found guilty and will not be sentenced to some form of incarceration. Make a note to let Pops know he was wrong after Trump loses and is sentenced.
