Cardholders...Have you ever been stooped yet by the police?

I am just wondering if any of you have been stopped with your meds by the police? If you were all legit (Card or p-work in hand). Walk us through what the cops did to you? Did they let you go...Or did they rip your car apart or home anyway?

Just wondering how LEO is handling their side of the law...

Please share if you have a story to tell.

Thanks

Dale

Sorry I'm not in a medical state but I had a friend who used to live up in Breckenridge, CO and he said him and his sister were pulled over by the police. They had an ounce of medical in the car but they simple showed the cop their medical card and they were free to go, aside from the speeding ticket of course. He told me the cops didn't really care much for the people with med cards but they didn't hassle them as there is apparently a pretty big meth problem over there which is a bigger concern. Sorry if I offended any Coloradans this is just from word of mouth from my friend. I'm pretty sure the cops can't do anything as long as it's medically prescribed to you and you have proper identification for it, especially if it's medically legal on a state level even the state troopers can't do anything. You might be able to get charged with DUI for driving under the influence of mind altering prescription medication, people get charged for driving while on their prescriptions of xanax and oxycodone so I doubt they wouldn't pull something like that on med. patients. An that would give them consent to as you said "rip your car apart". I doubt they could do anything to your home unless your growing over the normal amount for self use and you are not a qualified care giver.

One time when me and a friend were pulled over by the police they searched out car and found nothing cause we had nothing and he apparently smelled "faint marijuana fumes" coming from the car...stereotyping pigs... before he let us go he said "Look I know everyone wants to smoke a joint now and then but don't do it in your car."

I had the cops to my house and was in possession of a few ounces drying and about 60 plants and at the time had only mine and 1 patients cards, the rest was paperwork and seeing the first two cards sufficed and he really didn't over react over get giddy like he had a bust. He did nothing that was a few weeks ago. But I was not driving.

I do carry stuff but never more then 15 ounces and dread for the day when Im pulled over, but when that bridge comes Ill have to cross it and will hope for the best, really that's all you can do if your in this business.

I wasn't pulled over, but was walking to pick my son up from school. Walking down the sidewalk with our dogs. Came to an alley and, lo and behold, there sits a motorcycle officer. He gave me a double-take, I pulled my card and flashed it, and he smiled and waved. Wasn't driving, but I really don't think he would've messed with me.

He was just curious about the smell. I used to be a cop so I can understand. Back in the day, I would've gotten more than a smile.

So let me get this right. You were walking your dogs (plural, meaning more than one) and some bike cop smelled vapors off you from the corner over the smells off your dogs, and so you flashed him your card ?

Wait..... and now you are saying you used to be a cop so you understand ?

Understand what ?

That innate sense of smell that nearly every law enforcement officer seems to have when phishing for a bust when it comes to weed, but what baffles me is if all law enforcement officers have this extra sense, we'll call it, and the bike cop had it, why didn't you ?
Since from your story, you were obviously able to be smelled over dogs from a street corner.
Do they throw you to the side when you lose your sniffing abilities ?
Just wondering, since your retired or whatever.

you do know this is for Michigan patients, and you have your location listed in Cali.,
are you sure you are not under the influence right now ? :leaf::sleep:

Anyways, a few months ago there was a power outage and severe weather issues, and at about 4 in the morning after the storm settled, there was a pounding on my friend's door.
Since she was sleeping, and I just fired up the bowl, I walked over to the door, and in my best tough guy voice yelled, 'Who is it?'
I heard back immediately that it was the police. I walked out the other door, around the side of the house in a compassion club t-shirt, and a pair of hershey kiss pajama bottoms over to the front of the house where they were at. I asked the officers what they were doing or needed. They told me there was a 911 hang up made from this address. I looked at them, and then at what I was wearing, like c'mon, it's the middle of the night. I then was told that they needed to come in to make sure everyone was safe. I told them the phone wasn't even working so how could a call have been placed to 911 from here. The other cop chimed in and mentioned there were problems with the phone due to the storm. I then, once again, reiterated, that if this was the case there was probably a false call sent out that way. The cop that chimed in agreed, and his partner shot him a dirty glance. At this, I began to worry, as I wasn't trying to be argumentative or get one of the cops to side with me, but I could clearly see the other cop was beginning to get upset. The cop that was beginning to get upset said to me, 'we really need to make sure everyone is safe, then we can get out of your hair. If your worried about that marijuana I can smell all the way out here. Don't worry, I don't care about that. I just need to check on the safety of everyone in the house.'
I explained I had a card and that wasn't any concern of mine to be frank with him.
At this, I decided to give them entrance, as they entered this door through the kitchen, there was a freshly packed bowl of some crazy organic fire laying out, with vapors just filling the kitchen. Both officers looked at each other, probably in agreement that this was indeed the fire. :fire: lmao.
They proceeded into the front hallway while I tried for 5-10 minutes to wake up the other person at the house. While they waited, the angry cop started shining lights on the art on the wall, and asked me to explain some of it to his partner, in particular a promotional poster for Rubber Johnny by Chris Cunningham. lololol
Since it was 4 in the morning and this other person wasn't getting up quick enough, the angry cop starts to fish. He asks me for my card. I said to him, 'I thought you weren't concerned about that, and were just checking on the safety of the occupants of the house.' He replied, 'yeah, just get it.'
I got my card out of my pants on the floor and show it to him. He studies it for a minute, and then asks what it's for. I replied that's registered with the Dept. of Health and Human Resources. He shot a glare at his partner, and said to me, 'really, what's it for ?'
As I was tempted to reply HIV or something else he would probably run from since he was obviously fishing and at this point disrespecting my privacy and kind of being a dick. I told him one of my conditions that I received my card for, and he responded 'that's all I asked'
He then asked why the address on my card didn't match the address he was at, and I explained because 'I don't reside here.'
At around this point the other person poked there head out of the door, and said they were fine. I guess this was enough info or harassment to secure the house, since the angry cop handed me back my card, and then without saying a word turned around and started leaving the way he came in with his partner following him. I tried telling them, 'thanks for coming and checking on the safety and security of the house, officers.', but the angry cop seemed angrier now, and was walking off muttering. not sure what the deal was with that, but no probs with this experience other than a nosy muttering officer that I extended every courtesy on my part other than offering up an toke.
btw, to others reading this, I was being nice. I didn't have to be. In fact, I didn't have to even answer the door let alone give out privileged confidential information that is really between just me and my doctor.
I have checked with several law groups and have also spoke with someone from the ACLU. Everyone told me the same thing. You are not allowed to be grilled over what your MMP card was issued for, and to do it continually in a harassing or threatening matter, under certain pretenses opens up grounds for me to sue for harassment. Law enforcement or not.
Law enforcement are only allowed to check your card by verifying your # on your card with the record on file. They call a number, and check it, and that is all the information they are given. You do not have to give them any more information than handing them your card and id. As far as budlover13 goes, whether you are a cop or not, previously or otherwise, there are stop and check procedures that law enforcement goes through that you don't even have to participate in any way. It is very similar and basically the same police procedure that dictates you try to self-incriminate the person being pulled over in a traffic stop by asking them immediately, 'do you know why I pulled you over'.
Everyone should become familiar with laws in general, not just in your area. and legalese, for sure.

Hell uva story there ktwister. I was walking on the sidewalk and he was stopped in the alley, around the corner, looking for speeders. Yes, I was walking my 2 dogs, and I was SMOKING my joint. It doesn't take a cop to have a nose for weed. As a matter of fact, most smokers have a better nose for it than the cops. Been smoked out that way more than once. And as for smelling my smoke over my dogs, I wash them regularly. It's called hygiene. I walked within 3 ft of the front wheel of his motorcycle. I TOTALLY understand him giving me a look like WTH? He was as surprised as I was, but it seemed that as I took the situation in and started to pull my wallet and card, he realized what was going on too.

As for not being a cop anymore, I couldn't bring myself to play the political games that cops have to play. MOST cops are good people with good intentions. The rest make it hell for those good cops.

And as for living in Cali, yes I do realize this is a Mich. forum. You do realize this IS the internet right?

It is against our law to smoke in public here. Pretty sure that your incoherent ramble of a post never actually said you were smoking in public.

Your friend met a very good cop. I am not in a legal state but have a CCW. One of the questions to get it is one is addicted or using an illegal drug or other controlled substance. To me, that means if my state goes legal medical, patients would not be able to hold a CCW as it is still against federal law making the CCW null and void. Just like mine as a restriction on being in places that serve alcohol or while consuming alcohol.
Great outcome, but tell them not to get to cocky about it as each LEO thinks differently.

exactly. I wonder if budlover13 actually even knows what political games are, cuz I'm already confused by this one. At least I'm not being pulled over by this stellar shining example. :bigjoint:

Are you asking or making an interpretation on your local or state laws regarding this topic ?
Not really fully understanding your question I think.
I am confused as to why you are posting about a CCW permit in a Michigan patient forum area. You said your state hasn't gone legal which means you aren't even located here. Confused ? :?:
Regardless, it is not illegal to hold a card and a CCW permit at the same time.
Even if it were, you apply for your firearm/CCW permit through the state which is defined by state laws, and if medicine in the form of cannabis, is deemed legal in your
state, it will also be defined by state laws, so possession of a card or legal medicine wouldn't make anything null or void.

Huh ?!? I wondered why this damn thing was broken. I think I need fresh batteries.

Wow, didn't think so many people got so little love when they were kids. You're right, I failed to mention I was smoking in my first post and yes, this is a Michigan forum. I was simply trying to give OP an example of how it is in Cali now after 15 years. As for the "politics", well, if you don't understand, you were never a cop. Good for you.
