Interpreting Amendment 64

I was reading over the new amendment and I find it very unclear on seeds.

If I was to produce seeds from my own recreational grow would I not be allowed to sell those seeds through a licensed facility without having a producer license?

Anybody have clarification.

Could I sell something else and gift the seeds? Is that a legal loophole?

Well you can only gift without remuneration. So I can give any raw cannabis material away as long as it is not sold. Which Marijuana refereed as marihuana includes all parts of the cannabis plant.

Flower, Stem, leaves and seeds in the amount of one ounce or less.

I have a good understanding of legalese. But I am not a lawyer.

I'm just swashing my brain about trying to figure this out.

(f) “MARIJUANA” OR “MARIHUANA” MEANS ALL PARTS OF THE PLANT OF THE GENUS CANNABIS WHETHER GROWING OR NOT, THE SEEDS THEREOF, THE RESIN EXTRACTED FROM ANY PART OF THE PLANT, AND EVERY COMPOUND, MANUFACTURE, SALT, DERIVATIVE, MIXTURE, OR PREPARATION OF THE PLANT, ITS SEEDS, OR ITS RESIN, INCLUDING MARIHUANA CONCENTRATE. “MARIJUANA” OR “MARIHUANA” DOES NOT INCLUDE INDUSTRIAL HEMP, NOR DOES IT INCLUDE FIBER PRODUCED FROM THE STALKS, OIL, OR CAKE MADE FROM THE SEEDS OF THE PLANT, STERILIZED SEED OF THE PLANT WHICH IS INCAPABLE OF GERMINATION, OR THE WEIGHT OF ANY OTHER INGREDIENT COMBINED WITH MARIJUANA TO PREPARE TOPICAL OR ORAL ADMINISTRATIONS, FOOD, DRINK, OR OTHER PRODUCT.

(3) Personal use of marijuana. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE FOLLOWING ACTS ARE NOT UNLAWFUL AND SHALL NOT BE AN OFFENSE UNDER COLORADO LAW OR THE LAW OF ANY LOCALITY WITHIN COLORADO OR BE A BASIS FOR SEIZURE OR FORFEITURE OF ASSETS UNDER COLORADO LAW FOR PERSONS TWENTY-ONE YEARS OF AGE OR OLDER:
(a) POSSESSING, USING, DISPLAYING, PURCHASING, OR TRANSPORTING MARIJUANA ACCESSORIES OR ONE OUNCE OR LESS OF MARIJUANA.

You cannot transport more than one ounce legally.

(b) POSSESSING, GROWING, PROCESSING, OR TRANSPORTING NO MORE THAN SIX MARIJUANA PLANTS, WITH THREE OR FEWER BEING MATURE, FLOWERING PLANTS, AND POSSESSION OF THE MARIJUANA PRODUCED BY THE PLANTS ON THE PREMISES WHERE THE PLANTS WERE GROWN, PROVIDED THAT THE GROWING TAKES PLACE IN AN ENCLOSED, LOCKED SPACE, IS NOT CONDUCTED OPENLY OR PUBLICLY, AND IS NOT MADE AVAILABLE FOR SALE.

You can only have 3 mature plants and 3 immature plants at one time. (You can have 6 immature plants if none are flowering.)

One more thing you can have all the weight that you get from the 3 mature plants in your own home. **

(c) TRANSFER OF ONE OUNCE OR LESS OF MARIJUANA WITHOUT REMUNERATION TO A PERSON WHO IS TWENTY-ONE YEARS OF AGE OR OLDER.

You can give away one ounce or less, but only if it is not sold or traded.

(4) Lawful operation of marijuana-related facilities. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE FOLLOWING ACTS ARE NOT UNLAWFUL AND SHALL NOT BE AN OFFENSE UNDER COLORADO LAW OR BE A BASIS FOR SEIZURE OR FORFEITURE OF ASSETS UNDER COLORADO LAW FOR PERSONS TWENTY-ONE YEARS OF AGE OR OLDER:

Correction the state of Colorado will not seize your property for following these state laws.

So say if someone buys something from you. And after the transaction is completed a second person hands you a gift.

Dude, The Washington legalization is a joke. Growing for recreational use is not legal. You have to buy it from a licensed dispensary.

You can only get a license to be a producer and a processor. You cannot sell if yourself.

You either grow or you sell. The licenses are going to be $1,250 dollars a piece. Only 1000 refundable if you are not approved.

Growers are going to pay more fees than the people selling it.

The licenses are going to be limited also.

yes I was just looking at that earlier but remember something that tells me that may have changed. Things constantly changing here and there. hopefully everywhere.
