Perhaps The Most Outrageous Story Yet? --- Seeking Advice!

FYI, this is lengthy.

I live in Ontario, Canada. I have no priors, sell only to select close friends, barely grow (4 plants), don't text about bud movement/sales, and have what I would assume would be a GREAT social reputation in the event I was somehow being surveilled by the police.

The other night at about 5:15am, I was raided. Kind of. It wasn't intended for me. A neighbour sells blow, and lots of it, and was the intended target.

5:12am I got a knock on the door. Didn't answer. 5:15am another, more forceful knock. I looked out the peephole to see a DARK shadow (the hallway light burnt out earlier that day) of what looked to be my sister's boyfriend. I assumed he was stranded downtown and needed a couch so I opened the door. Before the door was even an inch open an officer came rushing in, tackled me and verrry thoroughly restrained me. He was at least 6'4" while I'm about 5'9"...I got manhandled. Probably for the best though. I didn't see anything signifying they were cops until I hit the ground.....I was ready to fight for my life and then some. Finally, a use for 18 years of Kung Fu training haha.

I was being read the usual schpeel (of which I didn't hear clearly when the name was said) "_______ _______ you are under arrest for posession and trafficking of cocaine. You will be detained until we can verify our information. Are there any weapons, tools, or dangers pres-" and I cut him off mid-sentence as the other officer proceeded towards my back room, where the weed is growing. I yelled over and over all frantic "Where's the warrant? I need to see your warrant!!" and the cop stopped instantly. After hearing my voice and getting a better look at me, they clued in that I wasn't their target. Their target was verrrry dark (you know the African Canadians who are so dark they're almost silver? Yea.) and had a similar sounding last name.

They let me up, apologized and then got back to business. I had $900 of cash wages visible from a snow plowing contract I had just landed at like midnight and sadly, 3oz of FANTASTIC bud (OG Kush x Green Crack x Black Widow). They took both items, filed no paperwork and simply said not to worry about any legal trouble coming my way and that they're sorry for the mixup. (Mixup?!?! Holy, understatement!!)

Now, as far as my limited knowledge tells me, everything that occurred in my apartment is off the record. No documentation of anything at all. This was an unwarranted search and seizure, right? B&E? Assault? Theft?

Is there any way I can reclaim my cash (which again, wasn't documented at all) without turning myself in for posession? I'm guessing I can't and have accepted it, but if I could somehow bring the assault on me, theft and more or less a B&E to the public's eyes it would be great. Our local police are beyond crooked, and it's almost common knowledge even.

I'm hoping for Canadian responses specifically, since our laws are different than the US, but I certainly won't turn away any insight anyone else might have.

And a sidenote:
The intended guy heard it all, flushed what I would guess was like $50 000+ of product and got off scott-free as far as I can tell.

Forgive the impatience, but I am out $900+ (about $1400 total) and have rent to pay very soon.....if anyone has ANY ideas, no matter how off the wall they may be, I'm all ears (eyes?).

If they failed to provide a warrant, i'd have put that martial arts to use, it's your right to protect yourself, they had no legal justification for being in the house let alone assaulting and robbing you. I would be making complaints to your local force, reports of assault and burglary. Also file a comcplaint with any external group such as the IPCc in the UK.

It would stand to reason that they have only two initial options, 1. agree that officers did visit the adress in which case you have a good place to start your defense from, or they can lie and say there is no evidence that any officers ever entered or aproached etc, to which just tell them fine, i'll be shooting first next time around. Also stick a sign on your door removing their implied right of access.

Just random thoughts i'm afriad, and nowt concrete.

Maybe you could lodge a report that you've been bugled and assaulted in your home but refrain from stating it was the police, they'll either say nuhhuhhh, we had officers around or they say oh really, we'll come and do some forensics and such, mayb they'll pick up something from the officers. That's an even more random thought though :D

My main concern here is that by pursuing legal or civil action in any way, will I just be making it easier for myself to get busted? The cops know all sorts of loopholes, so I'm very weary of going to court, period, or even talking with a "higher up" in the event I'm wrong and the evidence (after all, it IS illegal) can in fact be used to obtain a warrant.

That';s kinda the idea, to rob you to an extent where you don't really want to contest it. Personally i'd say fuck the consequences if it means i can have a couple of cops arrested and charged for assault, tresspass etc. It's always good to remember that pretty much EVERYTHING about authority is designed to mmake you think you can't win, mainly through the use of fear.

To start with, you cannot be busted for the bud if it's found that the seizure was illegal in the first plce. the case has to be dropped against you. OPlice can't j7st break in a door, make a valid arrest without a warrant and then state that it doesn't amtter as they made an arrest. They need to arrest warrant else anything that results is void.

Hello fellow Ontarian....First off sorry to hear about your situation. Dirty cops...unless you are a clean cop you can't fight them, and even then its damn near impossible. They are a gang, albeit with the law on their side and as a gang they protect themselves. If you had everything on tape and could inconclusively prove that they pocketed the cash and the weed, then you may get somewhere. But otherwise, my advice is walk away and be happy with the knowledge that it only cost you as much as it did. Could have been time in your local crowbar hotel and or fines to pay on top of loss of property. The second piece of advice I can give you is to move.....Fast as you can cause as it is right now you have a bunch of crooked cops or those that turn a blind eye to it that know where you live. Trust me, you pursue this in any way shape or form and they will open up a 55 gallon drum full of police harassment, brutality and just plain "fuck your hat perp" attitude on you.

you're gonna need badge numbers, names, last names, or something of the sort for some sort of police report to go through.

and if you were trying to cheat on your taxes by taking payments as unreported cash, then the cops shouldn't help you get it back, and they won't. did you give your customer a receipt?? if not don't even bother......

unless you have a rock hard case against the cops, lay off.....

for real man the cops will fuck you unless you have a way of bringing alot of attention to the media, no one will know or care...(and you better have a lawyer that cost more then the 1400 you lost thats for sure)

and ya you better move too now those cops know you and where you live and what your about...... My bosses work got raided they jacked everything and then said theres no charges being filed agaisnt you just leave town and dont come back lol..........so they will and can jack you basically like a robber would bust in with guns hold you tell they jack everthing and then just leave...thats what a armed robber would do and thats what they did meaning they are armed robbers employed by the city......they even get a pention lol ......

I'd just be counting myself lucky not to be in jail. If they were real cops, yeah you could go after them, but would you really risk almost certain jail time to get back a measly two grand? I'd count your losses if I were you.

Talk to your landlord ASAP and tell him that your money was stolen, and if there's anything you can work out to catch up this month. The longer you put off talking to the landlord, the worse off you'll be. Take out a small loan if you need to keep your rent paid.

Yeah, cops hate media attention, especially that which mentions them by name or shows their picture.

It's a good strategy, but not one everybody can pull it off with ease.

I would count your blessings and forget about it. If you make a big deal, then all of a sudden the weed get mentioned. I dont know how it is in Canada, but if you were in the States a warrant is good "AS LONG AS THE POLICE BELIEVE IN GOOD FAITH THAT THE SEARCH/ARREST WARRANT IS VALID". Which means that even though they made a mistake, anything they seen in the course of making the mistake is open game. The other strikes you have against you is that A) the bud was sitting out in the open, and B) if it was an arrest warrant, they have the right to search the area immediately surrounding you.

now anything that happen or was seen after they realized that they made a mistake would have been an infringement on your fourth amendment rights, if you lived in the states that is.

I would again be happy because the rain of crap that this could have brought down on you would have been alot more than 300, and they know it.Just to pay a lawyer to get that evidence suppressed would be more than that. If you go to the media, it is only going to further hurt your wallet as you would have to take a break from 'sales'.

You got screwed, the sooner you accept it and move on, the sooner you can get back to your routine. But thats just my advice. Also I doubt that this happens to them very often so you may have just told a specific enough tale to be identified. You should be more careful on what you post ITF.
