This is an excellent opportunity to get rid of that particular Sheriff. He is in an elected position and I cannot help but think that Phelps is a bit more of a "hero" to his community. A vigorous campaign and I bet Phelps could walk away with the guys job!

mmmm....while i might agree to some extent i would have to say he has a god complex.

Update from CNN headline news this morning, no charges will be filed. Phelps never admitted to smoking actual pot and since there is no proof of what was in the bowl of the bong (if anything) there isn't enough evidence to file charges.

I wonder just how much time and money were spent coming to this conclusion?

Exactly. This is why I don't think it should stand up in court. They really should have no proof, or reasonable probable cause from the picture alone...

They can't, but thats for the court to determine.. Its for the Sherriff to choose which incidents warrant charges to be layed, and potential for success of a guilty verdict should be a factor considered..
But if this Sherriff was doing his job like he's supposed to, you wouldn't have international coverage of the story, and eventually the sherriff would die a pathetic death anonymous to the world..
