Does not look very good for new comers trying to get started in CO with a business:

Check section (5) Regulation of marijuana.

Correct me if I'm wrong, but it basically says in (a) that they will set up the regulations by JULY 1, 2013.

Including:

1. regulations on the procedures used to issue the licenses.

2. regulations on how much it costs to get a license.

But in section (III) QUALIFICATIONS FOR LICENSURE THAT ARE DIRECTLY AND DEMONSTRABLY RELATED TO THE OPERATION OF A MARIJUANA ESTABLISHMENT;

That slightly sounds like you need to already have prior experience running a marijuana establishment just to be able to apply for a license, to be allowed to legally run a marijuana establishment...

ie: only the people who already have mj stores can legally have mj stores. No new comers.

Then, under (b):

IN ORDER TO ENSURE THE MOST SECURE, RELIABLE, AND ACCOUNTABLE SYSTEM FOR THE PRODUCTION AND DISTRIBUTION OF MARIJUANA AND MARIJUANA PRODUCTS IN ACCORDANCE WITH THIS SUBSECTION, IN ANY COMPETITIVE APPLICATION PROCESS THE DEPARTMENT SHALL HAVE AS A PRIMARY CONSIDERATION WHETHER AN APPLICANT:

(I) HAS PRIOR EXPERIENCE PRODUCING OR DISTRIBUTING MARIJUANA OR MARIJUANA PRODUCTS PURSUANT TO SECTION 14 OF THIS ARTICLE AND THE COLORADO MEDICAL MARIJUANA CODE IN THE LOCALITY IN WHICH THE APPLICANT SEEKS TO OPERATE A MARIJUANA ESTABLISHMENT; AND
(II) HAS, DURING THE EXPERIENCE DESCRIBED IN SUBPARAGRAPH (I), COMPLIED CONSISTENTLY WITH SECTION 14 OF THIS ARTICLE, THE PROVISIONS OF THE COLORADO MEDICAL MARIJUANA CODE AND CONFORMING REGULATIONS.

It sounds even more like you need to already be doing it just to be legally allowed to do it...

ie: no new comers.



Am I misinterpreting all of that?

I don't pretend to understand political gobbly-gook, but I would guess they want to keep the number of businesses in check, to an extent. There can only be so many dispensaries, or else half of them would just be sitting on product and looking for buyers.

If everyone over 21 is allowed to grow 6 plants, there will be a lot of underground selling. But they won't see tax money from that, so look for them to be scouting underground sellers. That's one part of it that could end up turning this into a headache...taxes.

Enh...it's all about supply and demand.

That's just it, it wont be "underground" anymore as long as it's an oz or less. Anyone can legally sell up to an oz at a time without a license. It doesn't specify whether the people who stay at or under that amount have to pay taxes on it or not...

That may be part of the regulations they are required to have set up and in place by JULY 1, 2013.

It mentions it has to be indoors, and even says something about being behind a *locked door*.

we are legal in washington....but they say because of federal laws the stores probably wont open up for atleast a year of rule making
It will also be at least a year before Colorado sees any retail stores. I expect the Beer Baron Governor Hickenlooper and his pot hating Attorney General to drag their feet getting things started.

No way will anyone just be allowed to sell to anyone. That is the whole point to get taxes. You will have to buy from a LICENSED dealer. Just as I can not legally sell a pack of cigarettes or liquor without the proper license, marijuana will be the same.

If you were able to sell the product, you would have to claim the income on and report it to the IRS or it would be fraud. The sale of marijuana will have a sales tax too, so you would have to operate it just like any other business and charge that tax. The bottom line is the state has to make money, and the sale of MJ to persons under the age of 21 will be a crime just like it was yesterday.

You will only be allowed to grow away from the view of others and it has to be locked up. Nothing changes from a legal outdoor MMJ garden. It's actually really shitty, IMO. Limit what we can produce so we have to go buy it, while still leaving it almost exclusively indoors so we have to pay for electricity and grow equipment. Hopefully a locked fence will be adequate to be in compliance with the law. If someone jumps my fence and steals my property, they are a criminal not me. It's really no different than breaking into someone's house and kicking there door down.

Ahh yes, I was 110% wrong on the selling part of that last post. I don't know where the hell I got that from...

Ahh, here it is, I must have been really high when I read it:

If you are 21 or older, you can "transfer" an ounce or less to another person 21 or older. Definitely NOT sell like I said in my post before this one. And what skunk said was 110% correct. There will be underground sales and sellers and that's who police will be going after.

Can you grow outdoors well up there? I have been curious.
Oh man, you've never heard of the legendary Matanuska Thunderfuck???? Until the huge raid back in the early 90's the plants grew to 12' tall in the summer here. We get about 22 hours of sunlight here in Anchorage; it's just crazy on the plants. We still have MTF but only females but fortunately some have kept the genetics alive by cloning them.

of course you have to pay taxes on it. If it's a patient to patient transaction, you're supposed to report the income on your 1040 tax return. We all know nobody is going to do that. That's why co is passing legislation in an effort to legalize it, in hopes that it'll eliminate black market. If the purchases go through "legitimate" businesses, then the state should see some tax revenue. Well, at least most (some?) of it....

Yeah. Apparently, remuneration is a synonym for compensation. When the decriminalization of MJ was passed the possession of an oz became a fine and the transfer of MJ to a consenting adult without payment became acceptable.

The bill that was passed states that we as adults can grow 6 plants (3 flowering), possess 1 oz or less, and even use it. I did not specifically see anything that says we cannot use in public =). Maybe we will be able to enjoy a doob with the cigarette smokers in designated areas. I kind of doubt it, but I didn't evben take this bill seriously in the first place.

It's still here but it's seriously guarded by those that have it. It's never sold commercially. I've only been able to get it once and man did that ever make an impression on me. :)

But you only get like 100 days to grow right? It must get wicked huge up there. I've seen the cabbages and pumpkins, always wondered about the grass man.

22 hours of light.....are you saying that the plants are flowering with 22 hours of light?

serious?!? you can flower 3 plants but you can only posses an ounce??? umm why doesn't that add up to me? any novice can pull an ounce per plant not too mention outdoors sheesh! okay i'll calm down now. thats just crazy though. -_-
