growing as a homeowner

i have been toying with the idea for ages now about growing pot.. i own a home and wonder if the feds can seize property for any size grow or just if they can prove you used money from "selling illegal drugs/the grow" to pay for the house.. something i am obviously considering before starting anything up. any help/info would be appreciated. almost to the point of selling the house and just renting a house from someone. hopefully someone has some knowledge or experience in this matter. please don't post guessing or assuming.. i am hoping just people that actually know will chime in. i live in Wisconsin. I was going to wait to see if we went medical, but that is dead in the water AGAIN!!!

assuming it falls under this: The Comprehensive Drug Abuse Prevention and Control Act of 1970 permits forfeiture of property used to commit or facilitate the commission of a violation of the Controlled Substances Act.
was hoping folks on here know/knew someone who grew under 10 plants that got busted and didn't lose the house :p

Check out the NORML.org website for you states laws. I won't begin to say that I know the laws for a certain state but I do know that I have read a multitude of news articles about cultivation and federal laws. From what I gather, you are pretty much f-cked if federal gets involved and at that point you obviously were not growing for personal use. If they can prove that money from the sales and cultivation of the marijuana purchased your assets (car, home etc.) then those assets can be siezed as evidence for your trial. That's all I got for you. Hope other people can chime in and help out.

just talked to an atty. here in town. he actually said the state or federal government can put in action to take your house if you are found doing anything illegal.. guess that answers my ? right there.. fuck being a homeowner.. selling the house this spring... going back to renting lol..

Just becuase you RENT a dwelling that does not exclude you from the confines of that law. If the feds get involved, the home can still be seized and the homeowner(once cleared of any wrongdoing) can then sue the renters for loss of rental property income, loss of personal property, etc. You can check with your lawyer but that's how it works.

I admire your determination, but it seems to me you would be safer in your own home, as long as you paid your house payment you wouldnt have to worry about getting caught by somebody else stubling upon it. If noone knows about it or cant see it then you wouldnt have to worry..correct?

But if you rented you chance the heat/ac or other applience going out and then have the landlord needing to get to pipes or where ever in the house, and the fans that cool HID lighting are hard to keep real quiet, so renting would be kinda risky in my opinion.

I'm on a simliar fence, im thinking about renting a home and having a small 250w hps set up, but im not sure if renting is too risky, not to empede on your thread in any way, but could you shed some past experience on renting a house and as to how involved the landlords are when it comes to accessing your whole house once you'v moved in? if you could conversate on that i'd be a big help to me, and i hope someone swoops in w/ valuable input to your situation, cheers

most times when you rent a house, the "home owner" comes by once a year for the yearly check up (that is of course barring any water pipes breaking etc) to make sure you haven't trashed the place etc. i do agree though, it is probably safer doing it in your own home w/ no one knowing.. just the fact, i don't like to pay taxes, pay off extra on a house just to have it raided by some odd 1 in 100 chance and the feds get it.. i have on the other hand NEVER heard of a home getting seized because a renter grew there.. why so many ops have a home buyer buy the home and rent it to a grower and split profits.. as long as you aren't renting to a family member who is growing i think they would have a hard time seizing someone else's property because i chose to grow. i could be wrong, but again from every bust i have seen in this state, the landlord never lost something due to the renter..

if i had to cough up a few bucks to cover some lost rent, that is np.. i have a BIG prob losing $20-30k i have paid off on my house already though (not to mention the $120'000+ house that is in my name free and clear. i am sure the mother fuckers would be licking their chops over that one).. also, from working with landlords on a daily basis, at least in this state, the laws protect loser tenants.. i have seen places get DEMOLISHED and the landlord can't get anything other than the security deposit. crime pays, as long as you don't have anything to do with drugs.. the union, the business behind getting high stated it best. america is putting forth one message. smoke a joint and get caught you lose any chance of financial aid, gov loans etc. get arrested for rape, murder, robbery etc, you can get your loans, grants etc. damn the potheads.. they will destroy our nation!! i guess the rapists and murderers just improve this country :)

so much depends on the state your are in
simple answer if it's a misdemeanor, then no problem, not for most states anyways
you are not going to be federally charged for a few plants, not going to happen
i'm in the same boat you are, own my house free and clear

As for me ill be growing out a rented house, trying to get a distant landlord, like the bank, and just pay my bills

There have been plenty of busts that involved grow houses, and the renters were the operators of those grows. The home is still seized if the feds prove the landlord knew about the grow or didn't do anything to report it. If you think about it, if they didn't then landlords could rent out any number of houses as grow ops to people and then when they got busted, claim ignorance. That would only fly once if you were lucky.

The Vietnamese, Chinese and other foreign nationals literally cram every space in a home with grow equipment. The feds could seize ANY home whether you own it or not. All they have to do is prove the mfg and distro claims against you with assets paid for by the grow op proceeds. In short don't grow anywhere it is illegal or outside your growing limits...or you are set up for a fall!:sad:

Your better off buying... just dont get too big and dont get busted. But have 10k stashed away for a lawyer either way.

This take the house if you renting is rather crazy maybe the city you live in, we own several rentals, over the past 20 yrs trust me we have had just about every walk of life in our places. We had a situation about someone using the house for making powder, that was a long process to get the house back, but we got it back after they had everything they needed for the case, we even had a situation where one of our rentals ended up being taken over by a crack dealer because the guy who rented from us owed him several thousand dollars, the house was raided and they found everything in that house, all the way to hookers doing their business in the rooms while guys did what they had to do, both times no problem at all getting the house back, go in clean it up etc, i can tell you when they do the raid and kick in the doors and windows they wont fix those, so thats on the owner.
