Ok I feel bad for what happened BUT I hope you never drink and drive again.
They shouldn't have searched your house without a warrant BUT under the circumstances: Can you blame them?
Don't drink and drive!! You can kill yourself or some other innocent party.
Sorry for lecturing but this is very sad.
I'm glad you didn't get seriously injured.

Last night i ended up getting really drunk and taking my mums car out for a drive (3rd time driving), ended up wrapping the car round a lamp post after getting chased by the police. They then went to my house because it was my mums car, without a warrant searched my room and found my plants
Kidnapped all 3 of my beautiful babies.

In the interview i said that the 3 plants were for my personal use so i dont have to deal with drug dealers and save money.

Got court next Thursday i think so ill let you know how it goes


Gutted about the plants, really wanted to complete this grow :(

the plants might get dropped , the cops searched my house once cause someone called and sed i was shooting a gun out my winow wen it was just fireworks , they found my setup and some leaves , i wasnt growing at the time but they coulda nailed me but sed the search was for a gun so they couldnt charge me for the setup

I've been reading this thread since the start and I have to say that's a bummer.

I'm not sure if the laws are the same in your place, but in the US they can't go into your house or confiscate anything inside without a warrant. UNLESS, that is, you let them in there. If they try and use the plants as evidence you can have it taken off the record since it was obtained illegally. Other than that all I can offer is my condolences.

Well today i had court for the plants.
I Pleaded guilty to cultivation of cannabis.
I was pretty much let pf :o
I was already on a 6 month supervision order (talk someone about not re-offending once every 2 weeks) and they just issued another one for 6 months to run along side the current one :)
The prosecutor also asked for a £150 fine to be issued
The judge said 'no it was only 3 plants'
The prosecutor then said '£70 fine'
The judge said 'no he does not currently have a job'
The prosecutor then sighed and said 'ok then a £35 fine'
The judge said 'no...we are not going to fine him ok!?'


Was pretty funny lol

Im pretty sure the judge was a toker as she was laughing about it and my solicitor said she was the strictest judge in the whole court today.
She said that she was glad that i had taken a intrest in growing but thinks i might have picked the wrong plant :)
She also said that she has seen the pictures and is impressed with me as i have clearly done allot of research and have grown some very nice plants.
at this point i was half expecting her to pull them out and say i could have them back lol


This is the first time i have come out of court thinking they have dealt with my case as fairly as possible...i mean i knew it was against the law and accepted the consequences, the police are the cunts who arrest you..the judges are the ones that try to make it look fair.

I'm glad to hear you got a cool judge. It's gotta be a huge compliment to have someone in that position say you were growing some good plants.

Also, big thumbs up on only getting 6 months probation with no fine for cultivation of marijuana. In the state of California, marijuana possession is decriminalized (if you have up to 1 ounce on you, they just confiscate it and write you a $100 ticket), but if you are growing even one plant, they can throw you in prison for up to a year and fine you a ton of money.

The only reason the police would go to your mom's house is to inform her that you had crashed her car... they would have no rights to search the house unless you were implicated in a crime that they would need to gather evidence for. As you were merely drunk, and crashed the car... the evidence is right in front of them...

How are the police, when this gets to court, going to explain how they came by your plants? What was the reason they gave to you for searching your home? To get a warrant, the police need to explain to a judge a good reason why they would want to search your home... now that they've done it without a warrant or search order, they would still need to explain to the court (or cps if you go guilty) how they came to be in your bedroom.

Since he let them in they can say he volunteered the search. Legally the police aren't allowed to seize any evidence unless they had a warrant or were allowed in the house by the defendant. If you allow the police in your house, they no longer need a warrant while you allow them inside. If they see something before you ask them to leave, they are allowed to take it. That's why you should NEVER allow the police in your house unless they have a warrant. If you let them in so they could talk to you about something (makes you look honest but can be a bad move if the cop is a real prick) ask them to leave.

Lol i didnt let them in...i was out my mum was asleep and the door was not locked.
When my mum was woken up they were already in my room.

In court they claimed that they was simply looking to see if there was anyone else in the house and saw that the cupboard was easily big enough for someone to be inside of it and checked...okay then....

i got 4 more seeds...they will have to wait a while, i might wait till i have a job and save up for a hps and do a stealthy grow....this one was not very stealthy, was more of a dont look dont see grow (dlds) :)

Hmm, I would have objected that the evidence was obtained illegally and called for a mistrial. But I'm not sure if the police in your country are allowed to do searches without warrants.

No they're not... but I believe you iToke, them mo' fo's walk through open doors all the time. they got more powers these days. It's a police state. All they do is drive around looking to cause trouble. Only interested in things that are easy. If it takes any investigating, they don't want to know.

In the US you have the 5th... over here we have the right to remain silent. Never, ever talk to the police except to give them your name and address... and always, ALWAYS ask for a brief/lawyer the instant you are in front of the custody sargeant. That way THEY KNOW they can't fuck with you.

Never let them talk to you until your solicitor is present.

Wow your lucky u live in the U.K. You would've got in way more trouble in the good ole USA. Well, first of all, you would still be waiting for trial because they don't have the sentencing phase of the trial for like 5 or 6 months after your arrested. But if you got a good lawyer u could get the plants charge thrown out of court. It's in the constitution, Evidence obtained by warrantless searches is inadmissable in court.

Also, if you ask for a brief/lawyer as soon as you get in front of the desk it stops them doing illegal searches in the first place.

Anyway, drink driving and running from the police is a bad thing to do... You should be getting charged with driving without insurance, no lisence, dangerous driving, evading arrest... maybe even damage to council property (for the post you wrapped the car around). Not to mention that you could have killed somebody... maybe a stint in jail wouldn't be a bad thing, help you reflect on your stupidity. If I did what you did, I'd get 3 years, no problem.

Well it was easier to just plead guilty in the end, if i had gone non guilty then i wouldn't have got sorted out there and then && i would have ended up with more court fees.

I think im going to get NFA (no further action) for the car due to lack of evidence, find out soon.

My mums work is paying for her to get a company car...so my mums happy.

The police didnt see me run from the car, i had lost them about 2 minutes before the crash.

Haha your crazy bro. I hope u learned your lesson...I did the same shit when I was 17, my parents let me drive there brand-new expedition for the first time and i crashed it into a mailbox and then into somebody's gate. I wasn't drunk tho I was messed up off xanax bars. I was lucky I made it home without killing anybody or getting pulled over by the cops. So the moral of the story is don't drive impaired.

what state do you live in?

im in california, and the the general concensus is that if you have an 0z or less, they let you off.

of course some cops are real dicks and fine you--which is just a misdemeaor in california. its about a 100$ ticket.

i know in texas marijuana has this zero tolerance mantra tagged on to it. las vegas is also harsh on pot.
