no its not.
Yes it is 100% against the law to grow cannabis in New York, it will be allowed a year after dispensaries can sell recreational. Estimated legal grow year should be 2023. So what are the repercussions according to the statue? Here it is:

Should be a fine of $125 no more than $200 and a possible infraction

S854A, page 87

A COUNTY, TOWN, CITY OR VILLAGE MAY ENACT AND ENFORCE REGULATIONS TO REASONABLY REGULATE THE ACTIONS AND CONDUCT SET FORTH IN SUBDIVISION ONE OF THIS SECTION; PROVIDED THAT: (A) A VIOLATION OF ANY SUCH A REGULATION, AS APPROVED BY SUCH COUNTY, TOWN, CITY OR VILLAGE ENACTING THE REGULATION, MAY CONSTITUTE NO MORE THAN AN INFRACTION AND MAY BE PUNISHABLE BY NO MORE THAN A DISCRETIONARY CIVIL PENALTY OF TWO HUNDRED DOLLARS OR LESS;



Couple pounds of weed for a 200 dollar ticket, it is up to the individual to determine whether spending ~2k per pound of weed or 200 on a ticket is a good value.

" Subdivisions one through five of this section shall not take effect until such a time as the office of cannabis management has issued regulations governing the home cultivation of cannabis. The office shall issue rules and regulations governing the home cultivation of cannabis by certified patients as defined in section three of the cannabis law, no later than six months after the effective date of this article "

Literally they changed up the dept info. It used to say, six months from the date of signing the law in NY STATE - but now they've taken it out entirely. They're saying that they have to pack up the department with employees before anything else happens. So... Anyone else in NY got some info regarding this???

Re: Recreational growing

Please be aware the home cultivation of cannabis plants is not allowed immediately. Pursuant to the MRTA, the home cultivation of cannabis plants may only be permitted after the Office of Cannabis Management issues regulations governing home cultivation of cannabis, which must be no later than 18 months after the first adult-use retail sale.

I've looked through the entire site. Could you link that info?

Either way, my original statement stands correct. It's still currently illegal to grow in NY.
It was in the DEPT site a few weeks ago. I don't know if changes were made, but, you're correct that it is currently illegal. It used to be stated differently for medical patients but somehow that changed.

I'll make an official NY growing thread at the end of harvest documenting my whole grow, with this being my first grow, general advice and guidelines. If your grow is indoor, you're very very safe. There would need to be a warrant to search your home, second if anyone smells your dank bud, it "can be" your legally permitted 5 pounds of weed in your home, and not from a plant. Same deal with growing in your backyard, we are protected from law enforcement from just searching your land without a warrant; they aren't your concern, people looking to swipe your plants are, so be smart and hide them among tomatoes and sunflowers

I've heard and know of people who grew way before the legalization in NY.

In short, if you aren't growing an entire farm - No one is going to bother you, at all.

Knew a guy who spent an entire five years growing, I'm sure the only reason they raided his place - Took his plants and ballasts, was because he let someone in the apartment and told on him.

It's been REALLY HOT the last few days!!! (90's +) Could the heat be causing the stems on my plant to look yellowish??
You're not joking.

I had jury duty in criminal court in my county. Left AC on et cetera, came back to find out that someone turned the AC off and opened the window slightly. Came back to something straight out of hell.
