A former corrections officer took his own life over the weekend after being found guilty in a case involving marijuana-infused butter, his attorney said.

Attorney Matthew Newberg told MLive.com that 49-year-old Timothy Bernhardt’s life had come to a “tragic” end on Sunday.

Bernhardt and three other Kent County Sheriff’s Department corrections officers werecharged earlier this year with making marijuana butter. Although three of the men had medical marijuana cards, Michigan law does not protect patients who use edibles.


Bernhardt, who spent 22 years in law enforcement, had pleaded guilty to reduced charges of maintaining a drug house, which carried up to two years in prison.

Defense attorneys had argued that the men were doing the best they could to follow the state’s poorly-written medical marijuana law.

Attorney Bruce Block, who represented one of the men, insisted to MLive.com in March that “this was medical use beginning and end.”

“My understanding is (authorities) only found out about these officers because the caregiver that was supplying them was their registered caregiver like they were supposed to do under the law,” Block explained. “The cops apparently raid the caregiver, they see the cards and then the witch hunt begins.”

“They were trying to follow the act… they didn’t apparently do it quite right because the law, in my opinion, has been twisted and warped,” he added.

Newberg on Monday said that Bernhardt’s family was “understandably devastated” by his death.

He recalled how proud Bernhardt was of his law enforcement career, and the way that his former co-workers embraced him outside the courtroom the day that he pleaded guilty.

“That speaks volumes to his character and his legacy,” Newberg pointed out.

In a post on Facebook, Bernhardt’s wife called him “the most honorable man I ever met in my life.”

Unless its for medical reasons, I got no symphony for those who kill themselves. He also wasn't found guilty but plead guilty and this dude was a cop or worked in a jail, he was employed by a police agency, he should have followed the law or knew the law better.

His freaken job was looking after those folks in jail for breaking the law, I did not even know cops could use MM off hours, I guess Wally World drug test its employers but jails don't test the jail officers, that makes a ton of sense, talk about double standards. He got paid much more then min wage as well. If had that freaken job, I would either quit it or not use MM.

Its a gift almost that us medical users have a right to use MM, with that right comes certain conditions. Did U know that if a MM user even passes a joint over to a non medical user, that is a 2 year felony for sharing your weed with a non approved person? That does stink but that is the law, that other person ought to become medical, IMO .


As for edibles being illegal, well one good reason not to use them, I wonder if he went to work under the influence of weed ? Why not just stick with smoking it unless ones worried about the smell of it by their co workers.

I'm sorry but thats just how I feel about these cops using weed..make that MM

i also believe this is more then one officer just using MM in the form of edibles, they were accused of much more, just what, I'm not certain but it was more that having a pot cookie in his pocket, this was a big time operation using MM as a cover, IMO

Im sure his past service was a huge factor in taking his own life. Prison if I'm not mistaken is for over a year in time. Prison being full of people who would love to get hold of any officer and take out frustrations on them. He probably saw his options as taking his life or taking a dick or beating daily. Tough call for anyone who values the virginity of their asshole and hopes to keep their insides from becoming outsides. I got to defend all my brothers in the weed war, even this guy and Bob. Don't have to like em. But I got to stand with em. Rip, call it another casualty, it is. Weed never causes the damage, it's legal status wrecks lives.

I get your point tho, I just can't sit here on the porch of my glass house and act like I never broke a law. Course I wouldn't and couldn't sign up to be the professional tattle tale I see cops as either.

Thats a pretty serous offense and it was a reduced charge from what he first was charged with....hes got a law badge and he was in big time doing who knows what, certainly not just treating himself medically so he could live his life in peace without much pain.

Well Mic Jagger said it best, we don't have a problem with drugs, we have a problem with the police. But this case was far more then a MM user with some edibles for his own personal use.

I also believe cops who go to prison get put in a cell by themselves or with others just like them and the max was 2 years and with no past record, he been out in under a year....I love to know if he was on any anti depression meds, those can make the depression worst, not better.

By the way is that you Mr. Harris????? Edited to add dont worry they will be coming after your form of medical use next. Maybe then YOU will CARE and maybe someone else will not have any SYMPHONY for YOU...............

"According to Section 333.7405 of the Michigan Public Health Code, a person shall not knowingly keep or maintain a dwelling, vehicle, boat, or other place that is frequented by drug users, or that is used for keeping or selling illegal substances. In order to convict you of maintaining a drug house, prosecuting attorneys must first prove that you had knowledge of the drug related activity occurring in a building or vehicle. Next, the prosecution must be able to prove you keep or maintain that structure or vehicle. In order to be convicted of drug house charges, you do not have to be the legal owner of the building or vehicle in question, it just has to be evident that you keep or maintain that building and are aware of drug use, storage, or sale related to that place."

I believe every MMMA caregiver in this state could be found guilty of this crime if the court refuses to respect/acknowledge the law. The state's assumed right to forfeiture trumps a patient/caregivers legislative right to immunity at will and without warning in this game. It's their ball (and court) and they have no intention taking it home when they can still making it rain with impunity ...

boy, what are some of my patients going to do with out making their own medibles. oh wait, they CANT TO ANYTHING NOW!!! one has lung cancer and CANT smoke, only ingest medical mj. the laws are FVCKED!!!! and will stay that way until all the asshats that wear suits and tell others how to live their lives wake the fvck up and realize that this herb only hurts when being dictated how to use it for a specific MEDICAL condition.

They might as well go door to door then and arrest everyone, oh wait then they'd be broke. Everyone I know has some type of drugs in their house! Remember, the US is the biggest users of opiates on earth

Maybe I'm letting the fact this person worked in LE get to me. If it was some poor simple man just trying to help others get by in life, I believe I would look different at it. Sometimes its hard to be unbiased
