DEA Raids Ypsilanti Dispensary

Early this morning The Shop, a medical marijuana distribution facility in Ypsilanti, was raided by the Drug Enforcement Agency with help from city police officers.
The raid was unannounced and no official statement has been issued by the Ypsilanti Police Department.
One individual involved with the raid was wearing a shirt with DEA emblazoned on it.
At least one car was towed away from the scene. Speculation about other warrants for the residences and businesses associated with ownership of The Station has been expressed in the community.
The Ypsilanti Police initially said they knew nothing about the raid. When pressed, Ypsilanti Police Sgt. Yuchasz confirmed, “Ypsilanti police assisted the DEA in an investigation this morning.” He could not confirm arrests or seizures, referring all questions to the DEA Field Office in Detroit.
Special Agent Rich Isaacson confirmed that the DEA did execute a search warrant at 513 W. Cross Street in Ypsilanti. He stated that agents served a “state warrant” on that address but would provide no additional information. Isaacson said they typically have no comment for media on ongoing investigations.
The raid comes on the heels of newspaper stories of the potential for a petition drive to either secure the status of the city’s 6 distribution centers or to decriminalize marijuana in Ypsilanti, perhaps as early as 2013 but more likely as late as 2014. Current city rules restrict distribution centers, or dispensaries, based on zoning requirements determined by city officials after extensive deliberations in 2011; some residents and Council members have suggested discarding the zoning-based restrictions and institution an artificial cap on both licensed marijuana gardens and distribution centers in the city.
Ypsilanti City Council recently voted down an emergency moratorium capping the number of marijuana distribution centers at six, but has passed an ordinance accomplishing the same effect through on a first reading. That ordinance is due for a second reading in early August, where it faces final approval.

How dare Ypsi talk about MJ normalization in their own community :(

  • White House Office of National Drug Control Policy's include ensuring:

"(12)...that no Federal funds appropriated to the Office of National Drug Control Policy shall be expended for any study or contract relating to the legalization (for a medical use or any other use) of a substance listed in schedule I of section 202 of the Controlled Substances Act (21 U.S.C. 812) and tak[ing] such actions as necessary to oppose any attempt to legalize the use of a substance (in any form) that-- (A) is listed in schedule I of section 202 of the Controlled Substances Act (21 U.S.C. 812); and (B) has not been approved for use for medical purposes by the Food and Drug Administration...."

Obama could go down as the worst POTUS ever (second only to Nixon maybe) when it comes to drug policy.

What a dink

I'm sure that these asshats see "no Federal funds appropriated ... relating to the legalization (for a medical use or any other use)" as a justification/mandate to spend like mad in the opposite direction, regardless of the 10th Amendment or the the fact that MJ considered Class I in Controlled Substance prosecutions is simply absurd today :(

I wonder what percentage of this administrations drug war budget is spent in MJ legal states pursuing MJ related "crimes"? Low hanging fruit if you will :(

Obama was an avid weed smoker back in the day. He's admitted as much. I wonder if he realizes the turn his life would have taken as a young black man if he was busted when he was younger?

it being a "state" warrant doesn't smell like DEA lead.

with all the politics in the area id almost be willing to be the owner of the shop is being targeted for whatever reason.

lets see if any more in the area go down or if any pop up to replace them.

try to find out who's to gain.

With a state warrant here the DEA/Feds cannot seal/hide the facts of the matter as easily as they have with say GrowGreensMI and others this year.

--note the DEA is monitoring these places......
smokin on the job eh?

so if 'we' as pts cant 'share'...?
--how are the dispensaries doing it?

with brownies too?

--seems like there is a bigger 'plan' waiting in the wings to make these folks stand their ground.....

--yes soon the 'state card' will allow you to 'purchase' medicine[sic] from state sanctioned dispensaries for 5-700$oz.....legally

guess these dispensaries will have the 500,000$ for set-up costs and licensing fees.....

Ypsilanti suspends dispensary's license for 60 days following DEA raid

City attorney John Barr said the suspension was a result of city inspectors finding roaches, rolling papers and loose marijuana in and around an ashtray during an inspection of the business after the raid.

Per city ordinance, consumption of medical marijuana is not allowed on the premises at medical marijuana dispensaries or grow operations, which City Planner Teresa Gillotti said was to prevent a social element from developing at the businesses.
Barr said he and City ManagerRalph Lange met with The Shop’s owners and their attorney on Aug. 8 and their attorney suggested the punishment.
Although the city can revoke a license for violating the terms of a city ordinance, Barr said he and Lange found the punishment appropriate. He said it was the business's first offense and there was only strong circumstantial evidence that medical marijuana was being used at the site.
“I wasn’t looking for a pound of flesh,” Barr said.
The Shop must remain closed for the next 60 days.
“They weren’t happy, I wasn’t totally happy with it, and that means it’s probably a good compromise,” Barr said.
This is the first time the city has discovered a violation at one of its medical marijuana dispensaries.
Representatives from The Shop couldn’t immediately be reached by AnnArbor.com.
Neither the DEA nor the Ypsilanti Police Department have brought charges, and Barr said DEA officials told him their report will remain sealed for 55 days.
If the The Shop’s owners are charged and convicted of an illegal activity, the city could hold another hearing and revoke their license permanently, Barr said.

YPSILANTI: The Shop business license suspended, employees say they did nothing wrong

The Shop, medical marijuana dispensary on Cross Street, will be closed until Oct. 6 as part of a settlement it reached with the city of Ypsilanti at a hearing on Aug. 15.

City Manager Ralph Lange said the business’s license was suspended due to evidence that marijuana may have been smoked on the premises, which is a violation of city ordinance. The city agreed to suspend the license, rather than revoke it, because despite probable cause of the violation, there wasn’t enough evidence to prove it occurred.

“There were things that led us to bring the charges but there were also weaknesses in the case. It wasn’t open and shut,” Lange said.

Lange said the evidence of the violation was seen by two civilian city employees who were called to The Shop during a raid carried out by the Detroit Division of the Drug Enforcement Administration on July 30. The employees reported seeing loose marijuana and rolling papers, and the remains of a joint that had been smoked, what is called a “roach” colloquially.

Marcus, a manager at The Shop, said the business did not admit to violating the ordinances but settled on the 60-day suspension to avoid an indefinite suspension.

“No one was found guilty of anything, we just settled on it,” he said. “There was no admitting of any wrongdoing.”

The city recently passed a cap on the number of dispensaries that can operate within the city limits and as part of that ordinance, the city stipulated that any dispensary that was inactive for 90 days would lose its license. That ordinance doesn’t go into effect until Sept. 6 and by Oct. 6, The Shop will have only been closed between 60 and 70 days anyway. Furthermore, Lange said part of the city’s settlement with The Shop was that the business would be immune to that provision of the ordinance.

“At the end of the 60 days, if nothing else happens, all things being equal, they’ll get their license back,” Lange said.

But whether The Shop gets its license back also depends on what happens with the DEA’s investigation. The DEA has not shared any information about what it’s investigating or even on what grounds the warrant for the raid was issued. Lange said the agency hasn’t shared any information with the city and Marcus said no one at the shop was shown a copy of the warrant.

“I have no idea what they’re going to say and when they’re going to say it,” Lange said.

Marcus said the raid occurred around 11 a.m. He said officers seized “very minimal amounts” of marijuana and cash, and three SUVs, each of which he said were worth less than $4,000. He said no charges have been filed and no arrests have been made, and he insisted The Shop was operating in compliance with the laws of Michigan and the ordinances of Ypsilanti.

“We have done nothing wrong,” he said. “…We did nothing illegal.”

Although the license suspension will hurt The Shop financially, Marcus said he and others at The Shop are most concerned about the patients who depend on the business for their medical marijuana.

“We have at least two dozen cancer survivors, a dozen of which are terminally ill, who need their medicine,” he said. “That’s our biggest concern. We will do everything in our power to make sure they get their medicine.”

To those patients, Marcus said, “This is temporary. Be patient. We will be able to take care of you very shortly.”
