House passes 24 PLANT LIMIT!

Did our legislators just read Ravin v Alaska or what?! :clap:

Holy cow. The state House just passed today HB 75. Despite the initiative's 6-plant limit the new bill establishes a 24-plant per house limit ("to prevent lawsuits"), defines concentrates as marijuana, allows for mj "clubs" and does some other good stuff. Some bad stuff too. It moves now to the Senate, who's passed their own bill. I believe they go into the grinder and we'll get a law that's a "compromise" between the two.
According to the ADN:
"House Bill 75 clarifies municipalities’ processes for registering marijuana businesses; authorizes “marijuana clubs” where the substance could be consumed; gives municipalities power to establish civil and criminal penalties for businesses; defines what the term “assisting” means in terms of helping someone with their plants or marijuana; establishes provisions for communities to prohibit businesses; and establishes a 24-plant limit per household."

That's 24.
Per household.

and still be 3 under!
Anyway...

For me 24 would be just enough to do the hobby I love without sweating plant #s. I'd flower a few under a 600, while keeping any # of strains I like around in veg. I could still accidentally kill my norm of 33% of starts, while growing out a male or 2 to breed... while not sweating going over legal limit! Yahoo!

Hope it holds together.

But you're still a felon if you grow over 16 ounces
Only if you posess it away from your 24 plant grow, you're protected at home:

"not more than 24 marijuana plants, with 12 or fewer
being mature, flowering plants, may be present in a single dwelling regardless of the number of persons 21 years of age or older residing in the dwelling"

Can you read that and still say this would change nothing?

Here's the whole section. I'm way more optimistic than you.

11 Sec. 17.38.020. Personal use of marijuana. Notwithstanding any other
12 provision of law, except as otherwise provided in this chapter, the following acts, by
13 persons 21 years of age or older, are lawful and are not criminal
14 or civil offenses under Alaska law or the law of any political subdivision
15 of Alaska or bases for seizure or forfeiture of assets under Alaska law:
16 (1) possessing, using, displaying, purchasing, or transporting
17 marijuana accessories or one ounce or less of marijuana;
18 (2) possessing, growing, processing, or transporting not more
19 than six marijuana plants, with three or fewer being mature, flowering plants, and
20 possession of the marijuana produced by the plants on the premises where the plants
21 were grown, except that not more than 24 marijuana plants, with 12 or fewer
22 being mature, flowering plants, may be present in a single dwelling regardless of
23 the number of persons 21 years of age or older residing in the dwelling;
24 (3) transferring one ounce or less of marijuana and up to six immature
25 marijuana plants to a person who is 21 years of age or older without remuneration;

Actually its line 20:

"possession of the marijuana produced by the plants on the premises where the plants" (is not a criminal act.)

I really don't think any y'all give 2 shits :lol: but the ADN story had an error and they reran it, corrected. Here's the corrected version.

Alaska House passes bill clarifying municipal marijuana regulations
Laurel AndrewsAlaska Dispatch News
April 2, 2015

House Bill 75 clarifies municipalities’ processes for registering marijuana businesses; authorizes “marijuana clubs” where the substance could be consumed; gives municipalities power to establish civil and criminal penalties for businesses; defines what the term “assisting” means in terms of helping someone with their plants or marijuana; establishes provisions for communities to prohibit businesses; and establishes a 24-plant limit per household.

The 11-page HB 75 was sponsored by the House Community and Regional Affairs Committee. Chair Cathy Tilton, R-Wasilla, testified that the bill was “fix-it” legislation seeking to clarify processes for implementing the initiative at the municipal level. More than a dozen municipal attorneys helped craft the bill, Tilton testified.

Alaska’s initiative legalizing recreational marijuana went into effect Feb. 24, but the eight-page bill left many of the details of regulation up to the state. HB 75 will now advance to the Senate for further consideration. On the Senate side, the closely watched marijuana crime bill has advanced furthest, passing the Senate last week and now heading to the House.

An amendment offered by Rep. Bob Lynn, R-Anchorage, that would have reduced the number of plants to 12 per household was debated on the House floor.

Lynn argued that 24 plants per household is “just way, way too many. We don’t need to, and shouldn’t, legalize a forest of marijuana plants in a dwelling.”

Tilton testified that the municipalities had asked specifically for a 24-plant limit. Matt Claman, D-Anchorage, argued that 24 plants is a “reasonable compromise” that would avoid lawsuits and uphold Alaska’s constitution.

Lynn’s amendment failed 10-27.

Under the ballot initiative, a person 21 or older may possess up to six cannabis plants, three of which may be mature at a time. The Alcoholic Beverage Control Board has said the six-plant limit is per household. If the bill were to pass in its current form, it would allow four times that amount.

Rep. Lora Reinbold, R-Eagle River, testified that she would vote against the bill due to numerous concerns with the legalization of marijuana, notably regarding public safety.

Rep. Tammie Wilson, R-North Pole, testified that she would vote against the bill because it defines a limit on the number of plants per household instead of per person. “I don’t know how many it should or shouldn’t be,” Wilson said.

The bill was the first to reach the House floor. It passed 36-2, with Reinbold and Wilson voting against it.

Correction: An earlier version of this article erroneously reported that Rep. Mike Chenault voted against HB 75. He voted for it. The article has been updated to reflect the accurate information.

Anyway, back to the politics...

I mentioned in the OP that the House bill would be sausaged with the Senate bill and that will be, some day, AK's new law. Well I looked into the wording of Senate Bill 30 and no surprise its all F'd up and full of horse pucky. For example, despite its responsibility to be nothing more than be

"An Act relating to controlled substances; relating to marijuana; relating to crimes and offenses related to marijuana and the use of marijuana; relating to open marijuana containers; relating to established villages and local options; relating to delinquent minors; making conforming amendments; and providing for an effective date."

it gets into unborn childs:

30 (a) A person commits the crime of murder of an unborn child if the person
31 (1) with intent to cause the death of an unborn child or of another 29-LS0231\T SB0030C -5- CSSB 30(FIN) New Text Underlined [DELETED TEXT BRACKETED]
1 person, causes the death of an unborn child;
2 (2) with intent to cause serious physical injury to an unborn child or to
3 another person or knowing that the conduct is substantially certain to cause death or
4 serious physical injury to an unborn child or to another person, causes the death of an
5 unborn child

Yes this is in the Senate's version of the AK MJ bill, as if they didn't have enough to fight about already...:wall::wall::wall:

Looks good for Alaska growers, congrats from Colorado!

Anything about outdoor up there? They get pretty grumpy about outdoor grows here, unless it's very secure- and usually you need a commercial license.

Thanks ttystikk!

The law's still in the meat grinder so we can't entirely say how it'll turn out but as it is outdoor will be legal- it'll need to hidden from public view and perhaps even locked but it should be legal to grow outdoors.

Obviously in AK our Midnight Sun and long summer days keep plants in veg til way late in the year- here in Anchorage we're at 61* North. That means autoflowering plants have to be the go-to choice for outdoor/greenhouse grower, and anyone trying to finish photos outdoors (without light dep) will really struggle to finish in our fall... what there is of it!

I have long wondered about how the high latitude affected ripening. Thanks for the tidbit!

Right? Its definitely a challenge.

But I think the breeders have us in mind with seeds like Sweet Seeds "Fast Versions", or Female Seeds "Semi-auto Grapefruit." Probably others too, although I've never grown any of them. These are in theory a way to grow non-autoflowering plants with fewer ruderalis characharistics but still able to finish outdoors in latitudes like ours. Here we veg like fools but then lose nearly an hour of daylight per week in the fall, so just when flowers are starting to pistil out things get cold and dark fast.

But "Fast" means something different than "Semi" tho, right? Fast implies quicker, semi regarding autoflowering implies... "kinda"? Bad word choice, maybe its the translation from Spanish or they're playing off "semi-auto." Dunno. I think both descriptions intend the same thing, a greater ratio of photo:ruderalis genes, but still enough rudi to affect their response to darkness, aka trigger to flower. Meaning these strains will flower earlier in the year, when there's still too few hours of darkness to trigger their full-photo counterparts to flower, but not after a set number of days from germ, like their auto counterparts.

Might have to look into these... :joint:

So fucking dumb. Politicians think they have the right to tell my wife what medications she's allowed to take while she's pregnant. This law is all sorts of fucked up. Alaska continues to try to punish cannabis users once again, this is sad...

I think until we see it legal on a Federal level the restrictions and handcuffs will continue to stick around. I agree though let it be at our own discretion and choice without the worry of prosecution. Alaska is making great strides though and I think when its all set and done our system of legalization will be unlike any other and it will thrive!
