Trump loses bid to enforce Omarosa Manigault Newman's NDA
The arbitrator, Andrew Brown, wrote in a decision dated on Friday and handed down on Monday that the definition of what kind of comment was protected by the NDA was so vague that it was rendered meaningless.

He also reportedly said statements from Manigault Newman were hardly included in privileged information.

The decision orders Manigault Newman to receive legal fees from the Trump campaign.

“The statements do not disclose hard data such as internal polling results or donor financial information,” Brown wrote

“Rather, they are for the most part simply expressions of unflattering opinions, which are deemed ‘confidential information’ based solely upon the designation of Mr. Trump. This is exactly the kind of indefiniteness which New York courts do not allow to form the terms of a binding contract,” he added.

Brown also ruled that the agreement “effectively imposes on Respondent an obligation to never say anything remotely critical of Mr. Trump, his family or his or his family members’ businesses for the rest of her life,” adding that “such a burden is certainly unreasonable.”

“I gave Omarosa three attempts at The Apprentice and she failed. At her desperate request I gave her an attempt at the White House and she failed there too, people truly hated her. At least now I don’t have to let her fail anymore,” Trump said.

“Nobody in her life has done more for Omarosa than a man named Donald Trump. Unfortunately, like certain others, she forgot all about that — which is fine with me!” he added.

I guess the uber-businessman knows how to write a contract to cover everything. I guess the gloves are off for all the other NDA's that are floating around out there.

Manigault Newman’s victory could embolden others who signed NDAs with Trump. The former White House staffer says that’s already happening.

She told this column in a Tuesday evening phone conversation that “people have been reaching out even in the last 24 hours wanting to tell their stories and wanting to consult with my legal team.”

The attorneys who worked on her case agreed.

The implications of the arbitrator’s findings should be “scary” for Trump, according to Manigault Newman’s lead attorney, John Phillips.

He added that he believed the wording of Manigault Newman’s NDA was essentially the same as for many other former Trump staffers.

“I believe it is effectively over for this NDA,” Phillips said.


J. Wyndal Gordon, a trial lawyer also on Manigault Newman’s team, said: “There are many others who signed this agreement and have, to their knowledge, been bound to some secrecy because they were afraid of the wrath of Mr. Trump. However, this case really frees a lot of those who really wanted to have something to say but felt muted” by the NDA.

Manigault Newman was fired from her White House role by then chief of staff John Kelly in 2017 and the following year published a book titled “Unhinged.” Among other details, she alleged that Trump was bigoted and mentally diminished. Soon after the book was published, Trump’s campaign filed the arbitration action.

At around the same time, Trump savaged Manigault Newman on Twitter, referring to her as a “dog” and a “lowlife.”

But the New York arbitrator said the provisions of the NDA could not stand up because they were so “vague and indefinite.”

The arbitrator, T. Andrew Brown, added, “There is no way here to tell if a breach has occurred, since the determination of whether there is a breach is left to the sole determination of Mr. Trump.”

The former president may in part be sore because his campaign is now on the hook to pay the costs and legal fees for Manigault Newman — fees that are bound to be substantial given the length of the case.

“Everything I learned in the boardroom from ‘The Apprentice’ to the Oval Office, I was able to apply in this situation,” Manigault Newman said. “I was able to be victorious and now he has to pay potentially millions in legal fees and costs.”

Asked about future Trump presidential ambitions, she is scathing.

"Donald is threatening to run again, not because he wants to make the country better or to strengthen our democracy. Simply put, he wants revenge,” she said.

Phillips, her lead lawyer, pays tribute to her courage in seeing the legal action through.

he'll assure you it's not..Stephanie Grisham new tell-all is really that..he wanted an aide 'brought to him' so he could admire her ass at which time he told her it's really not the MarioKart mushroom that's been reported. this goes against what Stormy Daniels said which was 'he knows it's different'.

After Bill the precedence had been set. Trump can whip it out (maybe whip is too strong a word) in the Oval Office.

Trump asks judge to force Twitter to lift ban
Trump’s attorneys on Friday filed a motion for preliminary injunction against Twitter and its CEO Jack Dorsey. The filing states that Twitter had been “coerced” into banning Trump.

“Coerced by members of the United States Congress, operating under an unconstitutional immunity granted by a permissive federal statute, and acting directly with federal officials, Defendant is censoring Plaintiff, a former President of the United States,” the filing reads.

Twitter declined to comment on the filing.

Trump, who regularly communicated via Twitter throughout his campaign and presidency, was booted from the platform after the Jan. 6 attack on the U.S. Capitol, which saw his supporters storm the building, delaying the certification of the 2020 election. After the riot, Twitter determined that Trump's posts posed “the risk of further incitement of violence.”

The former president is also suspended from Facebook until at least 2023.

Trump sued Twitter and Facebook in July, arguing that the platforms were silencing conservative viewpoints.

In Friday’s filing, the former president’s attorneys allege that Twitter “exercises a degree of power and control over political discourse in this country that is immeasurable, historically unprecedented, and profoundly dangerous to open democratic debate.”

The filing also argues that Twitter had selectively enforced its policies, noting that the Taliban appeared on the platform in August.

“Over the weeks that followed, Twitter allowed the Taliban to tweet regularly about their military conquests and victories across Afghanistan. The Taliban’s Twitter account is active to this day,” the filing states.

this is a great definition for rightie..vague and indefinite..once you give them what they wish? they move the goal posts. that's why Schumer had Manchin sign his name to his 'top line' months ago because they try to get out of what they pledged.

this is why Manchin and Sinema are Republicans and not Dems yeah so they give us two seats.

Why is Trump even bothering to hide shit, it won't make any difference, he committed multiple federal crimes in broad daylight and Garland is ok with him being above the law. Garland has almost reached the point of being an accessory after the fact and a partner in Trump's crimes himself. He is suppose to be the sword and shield of the US constitution inside America and aggressively defend it and the country. I believe he still thinks he's a neutral judge and not the nation's legal warrior and defender. Trump is above federal law, that much is for sure, 9 months after he's been out of power and all the low hanging legal fruit dropping on Garland's head every fucking day!

NY is taking it's time and Garland is doing nothing about Trump or his corrupt regime, there are a dozen Trump cabinet official who should be on trial by now. Why hasn't he brought back a couple of thousand retired FBI agents and DOJ officials to clean up the back log and go after the 1/6 insurrectionist, thousands are getting away scot free after trying to destroy the country and attacking the US constitution. I see poor regular folks getting slammed by the law in America every day of the week over minor things, but some people can do no wrong, it would appear.
