Go to the Public Hearing on the 24th. Sign a Witness Affirmation Form stating you would like to testify in favor of HB 1491.

If the Clerk does not laugh in your face, the worst thing that will happen is that you will not be recognized by the Chair to testify.

If you fill out the Witness Affirmation Form dishonestly and state you wish to testify on one of the posted subjects, then start talking about MMJ; you will be asked by the chair to confine your comments to the subject.

If you persist, you will be removed from the hearing room by an armed State Trooper.

The committee absolutely DOES have the power to give the bill life. Educated is one thing I am, another thing I am is polite so I will let the rest of your crap slide. The main message I want to get across is that people have the chance to write these committee members and let them know they support MMJ. If it isn't read this session the next time it will be referred to the same committee. Don't listen to negative internet gangsters, do your part to promote legalization.

Well you are obviously not educated on matters related to the Texas Legislature. Asking members here to support a dead bill; and then insisting the Public Health committee has powers it absolutely does not have under House Rules or the Texas Constitution.

Once the Legislature adjourns Sine Die, only one person has the power to resurrect an issue - The Governor. Please note I stated ISSUE. Because the bill related to the issue died on Sine Die.

The Governor has the power to call the Legislature into a Special Session for a period of up to 30 days.

Specials are generally devoted to one issue only - usually an emergency.

And the old bill that is related to the emergency issue is refiled as a NEW bill.

So call the Governor's office and ask that he convene a Special Session devoted to MMJ and after the laughter dies down, see what the response will be.

Make recommendations to increase patient access to primary care and address geographic disparities.

Assess registry compliance with standards for the protection and transmission of registry data and identify any additional steps necessary to ensure security, efficiency, and utilization.

Monitor implementation of the federal Patient Protection and Affordable Care Act, including any changes that may result from ongoing litigation or legislative modification or repeal. (Joint with the House Committee on Insurance)

Identify policies to alleviate food insecurity, increase access to healthy foods, and incent good nutrition within existing food assistance programs. Consider initiatives in Texas and other states to eliminate food deserts and grocery gaps, encourage urban agriculture and farmers' markets, and increase participation in the Summer Food Program. Evaluate the desirability and feasibility of incorporating nutritional standards in the Supplemental Nutrition Assistance Program (SNAP). Monitor congressional activity on the 2012 Farm Bill and consider its impact on Texas. (Joint with the House Committee on Human Services)

Monitor the agencies and programs under the committee's jurisdiction and the implementation of relevant legislation passed by the 82nd Legislature.

Can anyone tell me where they see MMJ anywhere in those charges?

The Interim Charges are essentially research projects. The committee is charged by the Speaker's Office to study the issues and hold public hearings. The Interim Report is the result of all of those projects.

Now, is it POSSIBLE that the committee could hold a hearing on the ISSUE of MMJ? Yes, but that is HIGHLY unlikely.

Here is why.

The committee must complete the report based on its charges before the end of the year. They do not have the time to study unrelated issues.

Every time the committee meets, a significant amount of coordination is required. And each meeting is expensive because the members and staffers must travel from all over the state to the meeting.

The Chair of the committee did not set HB 1491 to be heard during the regular session. She let it die without a public hearing. The author of the bill is Vice-Chair of the committee, but he did not have the juice to get it heard. That should tell you something.

If she refused to hear the BILL during the session, why would the Chair commit committee time and resources to hold a public hearing on the ISSUE?

Take my advice and look to the next session. Encourage your elected officials to file a bill for the upcoming session.

Or you can continue to snivel and cry about how NEGATIVE mean old Johnnyorganic is.

Every Bill is assigned to a committee after its read and depending on how that committee reports on it is what determines the Bill's fate. That's why I urge Texans to write the committee and show their support for the bill. This committee absolutely has the power to give the bill life and in the case its not read this session you are still letting Texas reps know you support MMJ. What you are failing to understand is that the regular session is over. HB 1491 is dead. All bills not sent to the Governor by the last day of the regular session are DEAD.

HB 1491 was filed, had its First Reading, and referred to the House Committee on Public Health WHERE IT DIED on Sine Die, May 30, 2011.

He is not quite as smart as he thinks he is. The main purpose of this post is to email the committee that will handle any mmj legislation. Present or future. While it is a slim chance that HB1491 gets a chance to be heard any future bills will also come in front of this exact same committee. Unfortunately he is too busy being a dick to understand that sometimes people just need a reason to get involved and then they stay involved.

You keep insisting something that is IMPOSSIBLE could happen. You seem to believe that a dead bill will magically be resurrected when the Legislature is not in Session and is not scheduled to be in Session until the 83rd Legislature convenes in January of 2013.

Moreover, your fantasy extends to the Interim Charges of the committee. You desperately want to believe that a Chair who was hostile enough to HB 1491 when she had the chance to hear it in a Public Hearing during the Session, will suddenly have a change of heart and hold a public hearing on the ISSUE of MMJ.

It will not be passed this session because the regular session ended May 30, 2011.

I never said MMJ is dead. I said HB 1491 is dead.

I already explained why I believe the committee will not hold a public hearing on MMJ this interim.

Committees rarely exceed their charges, but when it does occur it is because some unforeseen event takes place during the interim. And it has the blessing of the Speaker's Office.
