It would seem the first ingredient would be an offer by a healthcare insurance provider and then acceptance or denial by the individual consumer. Then the terms of the agreement, if there is one, become enforceable.
Absent a specific agreement between the two parties, it is not a consensual plan, but more of a manipulated unilateral contract. Which is a nice way of saying a demand by one side of the other to do something whether they agree to it or not.
The plan itself could could be tailored to what the two parties agreed to. What you consider a luxury and another considers a luxury would be rendered irrelevant, since the needs of everybody may vary due to their wants and needs.
