Merrick "Oklahoma bombing" Garland said flat out he's going after them for the capital hill insurrection and I believe him, after he is confirmed I expect to hear a lot of shoes drop. Wray the FBI director got to keep his job for a reason and I'm wondering what impressed Joe or his DOJ people so much, Wray must be doing something right. Donald will have a hard time whining about Wray, since he appointed him to his job.

Back to normal at the DOJ means trouble for Trump and a lot of other clowns who have run amuck these past 4 years.

Prosecutors say Jessica Watkins should remain in detention because she’s been “charged with a federal crime of terrorism.”

In the days after Jessica Watkins stormed the Capitol on Jan. 6 with her fellow Oath Keepers, prosecutors say, the Army veteran’s allegiance to the far-right paramilitary group only “calcified.”

The 38-year-old, who is accused of preparing and training for at least two months to “fight hand to hand” to take over the Capitol, was worried about the optics of the Oath Keepers after the insurrection—and talked about suing anyone “class-action style” who spoke out against the group.

“If he has anything negative to say about us OATHKEEPERS, I’ll let you know so we can sue harder. Class action style. Oathkeepers are the shit,” Watkins texted after a media report “portrayed her conduct and that of her fellow Oath Keepers...in a negative light,” according to a memo prosecutors filed Tuesday in support of her detention.

“They rescued cops, WE saved lives and did all the right things. At the end of the day, this guy better not try us. A lawsuit could even put cash in OK coffers. He doesn’t know who he is playing with. I won’t tolerate a defamation of character, mine or the Patriots we served with in DC. Hooah?!” she added.

Prosecutors believe Watkin’s continued loyalty to the Oath Keepers and the “federal crime of terrorism” she’s been accused of justifies their request to keep her detained pending trial.

During her Tuesday detention hearing, U.S. District Judge Amit P. Mehta remained skeptical about the government’s allegations that Watkins was a flight risk who committed a “crime of violence.” He asked prosecutors for more information on whether the destruction of government property charge qualifies as “a federal crime of terrorism.” The request delayed his decision on her detention to Friday.

“These are issues that are not going to affect only Ms. Watkins but potentially dozens and dozens of others that are coming down the pipeline,” Mehta said.

Watkins is one of several members of the right-wing group who’s been charged with several crimes, including a conspiracy to disrupt Congress on Jan. 6 as they met to certify President-elect Joe Biden’s electoral victory. She allegedly trained recruits to get them in “fighting shape” for another attack at the inauguration and vetted people interested in the Jan. 6 riot to “ensure the right people” were affiliated with the Oath Keepers.

Federal authorities have described the Oath Keepers as “a large but loosely organized collection of [the] militia who believe that the federal government has been co-opted by a shadowy conspiracy that is trying to strip American citizens of their rights” and who heavily recruit former military, law enforcement, and first responders.

The memo comes after Watkins’ lawyers argued their client should be released, as she has been “treated harshly” and is at “particular risk in custody” because she is transgender. That filing also insisted that she is not a threat to the public because she only stormed the Capitol because she believed “that the president of the United States was calling upon her.”

Her lawyers also filed a letter from one of the Oath Keeper’s friends who downplayed her actions as those of an “idiot” whose “feelings outpaced her brain.” The letter, written by a longtime friend identified as Zach H., insists that Watkins is not a terrorist but someone who was just unfortunately “brainwashed by those deeply entrenched in conspiratorial beliefs.”

“I don’t believe that she is wholly unaccountable for her actions—nor do I believe she should or would want to be—but I urge the court from my humble place as an ordinary citizen to show the mercy that I know Americans are capable of,” the letter, which was filed Monday night, states.

Prosecutors note that Watkins’ defense ignores the many well-chronicled actions that she, along with other Oath Keeper members and associates, took in an effort to forcibly stop the certification of the 2020 Electoral College Vote.

“She further notes that detention rests ’on whether she is likely to commit other crimes if released pending trial,’ but still believes that the crimes she committed—the evidence of which is ‘concededly strong’—were lawful and consistent with her oath to support the Constitution,” the memo says.

As thousands of MAGA supporters stormed the Capitol, Watkins and her militia were clearly visible in photos and videos as they marched tightly in an “organized line up the steps on the east side of the Capitol, wearing combat helmets, bullet-proof vests, gloves with knuckle protection, and radios,” prosecutors allege.

“Me before forcing entry into the Capitol Building. #stopthesteal #stormthecapitol #oathkeepers #ohiomilitia,” Watkins captioned a photo she posted of herself on Parler, the memo states.

While Watkins insists she did not “intend to destroy property and even told others not to engage in such conduct” she has not provided an explanation for videos that show her with the rioters breaching the Capitol or the months-long planning she undertook to have armed militia waiting nearby.

Prosecutors deem Watkins a flight risk because she’s suggested she’s willing to go “underground if this coup [Biden election] works.”

“There are no conditions or combination of conditions that will reasonably assure the safety of the community or the [Watkin’s] submission to this Court’s authority should she perceive the actions of our leaders or this Court as contradictory to her understanding of her duties under the Constitution,” the memo concludes. “Release may be the norm, but the [Watkin’s] actions and the beliefs that inspired her are uniquely threatening to our democratic way of life.”

The apparent calculus prosecutors are using to determine whether they ask for jail time came to a head twice in court Tuesday, as they argued for the detention of a member of the pro-Trump extremist group the Proud Boys who carried an axe handle wrapped in a flag, and for an alleged conspirator among the paramilitary group the Oath Keepers who was suited up in armor at the riot and had said she was leading a group in response to the President's and others' signals.

Federal judges have landed all over the map in their decisions to keep alleged Capitol rioters detained, with many judges rejecting the Justice Department's initial requests to keep defendants in jail pending trial, and several appeals ongoing.

(Reuters) - A suspect charged in the Jan. 6 U.S. Capitol riot partially blamed the "right-wing media" for her actions, as conservative news outlets face accusations that they spread misinformation ahead of the violence that left five people dead.

In a motion for release to home confinement pending the outcome of her case, filed Saturday, Jessica Watkins said she "fell prey to the false and inflammatory claims of the former president, his supporters, and the right wing media."

She did not identify the media outlets by name or give more details about what the claims were that led her to take part in the protest.

Watkins, a leader of the far-right 'Oath Keepers' group, has been charged with conspiring to storm the Capitol to prevent Congress from certifying President Joe Biden's election victory. She has pleaded not guilty to the conspiracy charges.

Jail time usually bitch slaps many back to reality along with a long talk from their lawyer. Almost all of them are blaming Trump and right wing disinformation and that could be useful for future trials of ringleaders and hearings on new legislation. When this shit with Trump starts to break, it will be like a flood with a traffic jam at the prosecutors door, the rats will be running and squealing in droves, it will be epic. For decades to come Washington lawyers will fondly look back on the 'happy time" when they cleaned out these assholes for every dime they have*.

*For example: I believe it cost Scooter Libby $14 million in legal fees over the Plame affair, Washington lawyers are very expensive and these clowns will need a lot of lawyering before congress alone, not to mention the courts.

The part that worries me is that, because of the volume and expense and sympathy for "the blue collar working man(cough-caucasians-cough)", they're going to go really soft on the punishment side. The crimes are actually pretty gnarly and in any isolated incident, every one of them would be sentenced to at least five years.

The part that really worries me is that at the end of the day what is getting lost is how these idiots that busted their way into our capital are being treated the way we would hope that everyone in our society would be treated.

The reason behind all the protests over the summer is to have the same justice system for all of the people in our nation, and this proves that unfortunately this is not the case.

It might feel better to see them all nailed to the wall after the terror that them and their cult leader Trump caused, but not playing by the Republican rules of conduct is why they have to cheat and lie any way that they can to even have a shot at keeping power out of the hands of the Democratic party.

Feeling a bit sheepish and just wanna move on? The Don has other plans and court dates, so does the majority in both houses. Imagine, breeching and sacking the capital with an insurrection, disrupting the constitutional duty of the government, while a mob tried to murder elected officials and these clowns figure there should be no complete investigation!

The democrats should appoint some former republican patriot to head the commission, a real fucking firebreather who is howling at the moon mad about this bullshit.

WASHINGTON (AP) — Republican leaders in the House and Senate say a proposed plan for an independent commission to study the Capitol insurrection is overly tilted toward Democrats, arguing that the panel should have an even party split like the one formed to study the Sept. 11 terrorist attacks.

House Republican leader Kevin McCarthy and Senate Republican leader Mitch McConnell said Wednesday that a legitimate commission would be comprised of an equal number of Republicans and Democrats. A draft proposed by House Speaker Nancy Pelosi would create an 11-member commission with four Republicans and seven Democrats, three of whom would be chosen by President Joe Biden, according to one of multiple aides who spoke on condition of anonymity to discuss the details under negotiation.

Pelosi has not commented on the draft or said why there should be more Democratic members. Last week, she said the commission must be “strongly bipartisan” and have the power to subpoena witnesses. But on Wednesday, House Democratic Conference Chair Hakeem Jeffries said McCarthy hasn’t operated in good faith and “set a bad tone” when he supported former President Donald Trump’s efforts to overturn Biden’s legitimate election victory.

The partisan bickering before the commission gets off the ground is raising questions about whether lawmakers can coalesce around a thorough review of the Jan. 6 riot that interrupted the presidential electoral count and led to five deaths. Both parties support creating an independent investigation, but much of the consensus ends there, with Democrats demanding accountability for lawmakers who amplified Trump's falsehoods about the election.

The vast majority of Republicans stood by Trump as Democrats impeached him for telling his supporters to “fight like hell” to overturn his election defeat as Congress counted votes. And it is an open question whether the commission will be authorized to investigate Trump’s actions.
