-- A unanimous California Supreme Court has struck down a law that sought to impose limits on the amount of marijuana a medical patient can legally possess.The California Supreme Court ruled Thursday that the state lawmakers were wrong to change provisions of the voter-approved Proposition 215. The 1996 measure allowed for patients with a doctor's recommendation to possess an unspecified amount of marijuana.The Legislature, seeking to give law enforcement guidance on when to make marijuana possession arrests, mandated in 2003 that each patient could have a maximum of 12 ounces of dried marijuana.The high court says only voters can change amendments that they've added to California's constitution through the initiative process.

Wish things were working that way here in Colorado. The way things are set up now you can have 6 plants (3 veg, 3 flowering) as long as you have your card/doctors paperwork(state has a 3+ month back log issuing the cards currently), but you're only allowed to have 2oz of dried herb at any time. It's a bit hard to grow 3 plants and make sure that you don't harvest more then the limit, but at the same time 6 plants really isn't enough for anyone that's a regular user to guarantee that they aren't running out between harvests.

If you somehow managed to set it up as a perpetual 4 month grow you could theoretically harvest one plant right about every 20 days. Now, if you assume 1oz of usage per week that means you have to have a yield of at least 3oz per plant to ensure your supply, and if you have one die or yield less you're out of luck. You're also breaking the law, because you're exceeding the 2oz limit if you get a yield of 3 oz per plant. So anyone that uses an ounce a week or more either has to break the law to grow their own (either by growing extra plants or by having too much dried herb), gets to pay dispensary prices when they run out($450+/oz for top shelf), or can do without.

There are a few ways around the law, but they are kind of grey areas (though recent court rulings have favored care givers/patients) and the politicians are looking for ways to close the loopholes.

the story i read said that law enforcment was going to be incharge of determening what was an "adaquite amount" of medicine for each pactaint to posses.

Yes it will be there interpretation on wether you are doing something illegal. So If all your paperwork is in order and you are legit. I would not worry it will be the officers interpretation only. It will still have to fly in court so those same expert witnesses will have to testify. If you just ingest marijuana you will need to grow more for your medicinal needs. Now dont use this as your excuse then you got bongs all over the house.
