Snipes - tax evasion and fraud, not failure to pay.
lol really?

tax evasion IS failure to pay

although it is an inconsistent law. Geitner was guilty of tax evasion and fraud and Obama put him in charge of the IRS

sorry canndo, your guy is a mobster only enforcing laws when it's convenient. It must get tiring defending him.

evasion is attempting to misrepresent your financial situation in order to reduce your stated obligation. There is no "my guy" and I mavel at the right's assignment of people to other people. Was Geitner convicted of evasion?

no, that's my point. His own accountant came out saying Geitner tried to get him to leave December off his filing and when he told him it was illegal and he couldn't do it Geitner used Turbo-Tax and did it himself. I thought this was common knowledge. His story was oops, I goofed.

His appointment was defended loudly and consistently by those blind team cheerleaders.

I think the bolded would be an example of sweet irony.

We know that the Feds expect dispensaries to file and when they do and they pay, the principles are not jailed for tax evasion. We also know that the IRS disallows standard business deductions for what is labled criminal endeavors. What is your point here?

I am neither defending Obama, Obama's choices or Geithners.

So where does that leave us? oh, tax evasion.

you still haven't been able to convince me that not paying taxes is different than tax evasion, but I'm open minded, give it a shot.

In both of those phrases, you're not paying taxes.

Tax evasion-telling the IRS that you make less than you do so you don't pay taxes on that extra money.

Not paying taxes-well, you're not filing a return. So you're not paying your taxes.

I can see they are different situations, but they both end with taxes not being paid.

Noun:

  1. The action of evading something.
  2. An indirect answer; a prevaricating excuse.

Could we assume not doing something, is indeed evading a responsibility?

failure to file a return is an infraction with a fine, and late fees, plus a fee for the "secretary" (one of his lackeys) filing the return for you with their own data. the bill is then assessed and sent to you making you liable to pay.

deliberate refusal to pay taxes that are assessed by the tax payer or the secretary is tax evasion and it is a criminal offense

filing a deliberately false or misleading return is tax fraud. this is a delightful felony.

these are the actual definitions from the tax code as i recall them from last year. the new code is not available yet as congress is currently spending the summer anally raping us for the campaigns.

thanks doc, so not filing is not evading, not paying is. I get the difference. You are not evading until you actively refuse to pay.

So in the gun recall if I don't admit to having a gun, it's not the same as admitting and not giving it back.

So if they say "gimmie your gun" and I say "what gun?" they can't arrest me, but if I say "no", they can. Lesson from the government, it's better to lie.

Yeah from what I have read if you don't file but you know you have had taxes (like getting a home mortgage) or depositing money in the bank they can use that for tax evasion.

If you are guilty of tax evasion, the statute in Internal Revenue Code section 7209 clearly states the consequences:
Any person who willfully attempts in any manner to evade or defeat any tax imposed by this title or the payment thereof shall, in addition to other penalties provided by law, be guilty of a felony and, upon conviction thereof, shall be fined not more than $100,000 ($500,000 in the case of a corporation), or imprisoned not more than 5 years, or both, together with the costs of prosecution.
What’s worse than not paying your fair share of taxes? Not filing income tax at all. There are too many people who evade taxes, so the authorities don’t want to put everyone of them in jail. But not filing income tax is sure to raise their ire even more than underpaying on a filed tax return. Make sure that you hire a financial attorney to assist you with this. Here are some of the consequences of not filing income tax:
Fines and interest will be assessed. You can also get prison time, more for each year of not filing income tax.
The IRS will file a substitute return for you. So you’re thinking, who cares, they do the work for me. The problem is that their return is based only on information that the IRS has from other sources. Therefore, it will not include any additional exemptions or expenses you may be entitled to and will probably overstate your real tax liability. Even if the IRS has already filed a substitute return, you can file your own return to make sure you take advantage of your exemptions and deductions. The IRS should adjust your account to reflect those correct figures.
Once the tax is assessed, the IRS will start the process of collecting. This can include placing a levy on wages or bank accounts or filing a federal tax lien against your property.

Also you might want to look at this....

[h=4]Tax Crimes and IRS Charges[/h] Criminal Investigations can charge individuals with a number of crimes, all of which fall into four major crime categories:

  • Legal Source Tax Crimes
  • Illegal Source Financial Crimes
  • Narcotics-Related Financial Crimes
  • Counterterrorism Financing

nope.

if you do not file your tax return and the IRS feels you are worth the trouble they will prepare the return for you, and asses your tax bill or refund (its always a bill) plus 5% per month (yikes) compound interest on the balance owed plus late fees and a filing fee.

if you fail to remit their monies after they file your return for you, THEN you can face tax evasion, but usually only after the fees have reached a point where they are sure you aint gonna pay.

if you under report your income, or falsify your returns (including using "treadmills" as a euphemism to conceal your nascent dope empire) or deliberately fail to file a return with the intention of not paying taxes, then you get the tax fraud beef, and that my brothers is one MEATY charge.

the correct employment type for homegrown selling weed in a state where medical use is legal would be "Agricultural Income" or "Hobby Income" you ill need receipts for outlays and income so diligent and deliberately vague record keeping will be essential

Mostly true but based on assumptions, they can charge with tax evasion if they can prove you willing not filed for whatever reason, and also get you got evasion within a month of doing your taxes for you. Sure most cases they wait until your so far in the hole from penalties its impossible for you to pay then slap you with evasion but I am sure its at the agents discretion.

Please show us the statute that shows that failing to pay (not failing to file) is a criminal offense and show us further what the punishment is.
