another thing that i thought i should bring to the attention of the OP and the forum is that those roadside sobriety tests are generally not required and are simply a way for cops to collect more evidence. doesn't matter if you pass with flying colors, they can write whatever they want.

my story: i was pulled over by a cop for doing 77 in a 65. i had a beer earlier in the day and not brushed my teeth. i would have blown a 0.00 or 0.01 if i did take the test.

in any case, the officer told me that he detected the odor of an alcoholic beverage when he pulled me over. he asked if i would step outside of the car to try to "separate the smell" (yeah right). i POLITELY declined. i informed him that i was willing to submit to a breathalyzer of blood test if he wished and that was it.

he went back to his car and called for backup. backup showed up and they had a quick chat. backup drove away and he issued me a speeding ticket. end of story.

generally, you are only required to submit license, registration and insurance. you can hand them out the smallest crack in the window and refuse anything but a breath or blood test. i am not a lawyer, but that is what i have been told by lawyers in 4 west coast states.

This cop is so bold because he likely thinks this is going in front of a city/county judge that ALWAYS sides with the police. You have a right to be heard in state court because the ticket likely was for violating a state statute/law. Call the clerk of courts and ask to have the trial moved to state court for a JURY trial. NOT A BENCH TRIAL. This will make it very expensive and aggravating for the State to prosecute.

Through your lawyers office set up a hair follicle drug screen($200). These screens give a 3 month drug use history. The upside to this test is that marijuana has to be consumed massively to bind to the hair follicle. An occasional smoker will pass. If you fail, no sweat you made the appointment through a lawyer and the results are privileged. Meaning that the prosecution cant access the result and if they do they cant use them.If you pass, you walk on reasonable doubt.

If your State is one with open public records, make a written public records request (drawn up by your lawyer) to the LEO that arrested you. Request every DUI that the said officer has written in the last 5 years. This is mainly a scare tactic. You want the officer to think your coming to court with 115 ppl he gave bogus DUIs to.

As far as your miranda rights, they didnt read them but that only means they cant use anything you said AFTER the arrest against you. Everything you said before the arrest WILL be used against you.

If you do this it will cost you Major $$ but I would bet you will get your license back. I would dare say before trial the prosecution would offer you a online course for $35 and they drop everything. If they offer that, take it

The police can't just go around arresting people, slapping cuffs on them and just throwing them in the back of the fucking police car man. It doesn't happen that way!! THEY HAVE TO READ YOU YOUR RIGHTS!!! PERIOD!

I'm wondering though...... you need to apply for a work permit? And discuss this with your mom? Are you a minor? Meaning under 18yo?

Seriously timeismoney, no offense..... but you handled that situation like 100% wrong. Has nobody taught you, or have you never looked up your rights?

Have you ever actually been pulled over before? You don't seem to be too experienced with the police, as most are in this cannabis community.



Where i live cops are total assholes and they will literally harass you for 4 hours on the side of the road if you give into all their bullshit. It's happened to people I know.

Never to me though, I know my god damn rights. And exercise them accordingly.

. here are some tips i've learned in my experiences.



- When you get pulled over, remove your keys, and place them on top of your hood.... If you are on a bike, take your key out and TOSS it out of reach... on the road behind you.. this shows the officer you wont run.

- Always keep your hands visible. Especially in rough neighborhoods. Cops don't know what to think when they approach your vehicle, those steps let them RELAX.

- BE polite! It doesn't get you ANYWHERE to talk BACK to an officer when you are being pulled over. Don't use some bullshit reasoning to explain you actions, if you have a GOOD argument take it to COURT where a JUDGE is present. Arguging with a cop on scene gets you NOWHERE.

- If a cop wants to search your car, tell him "I do NOT consent to any searches".... Don't entertain him by answering any questions about why you don't want your car searched.

- State that it is your right, and that he needs a warrant to search your vehicle. It's that simple, you don't need an elaborate story. If he gets a warrant, I will laugh and comply. Let him search my car, call in 8 more cops, waste their time too. LOL! I do not consent to searches, even when I have nothing in my car. I exercise my rights and COPS hate it!

- After you get your ticket. Leave. Simply ask, "Officer, Am I under arrest?" If he says some bullshit & avoids the question, ask him again, "Am I under arrest?" When he says no, promptly get in your vehicle and leave.


story time:
I have had a cop follow me through backroads to Wal Mart. I made a wrong turn, and took the long way with the service roads. At night, SIMPLY by how CLOSE he was following me - I knew it was a cop. So I made NO illegal turns, I kept within 2mph of the speed limit, and I did full stops at stop signs for at least 3 seconds. Never ever breaking the law, never letting him have a reason to light me up. He followed me to the Walmart parking lot, and when I parked I got out, locked the car, and started walking away... He ran up in front of me, started asking why I didn't know where I was going because I lived in the area ( he ran my plates obviously)... I never answered any of his questions, I simply asked, "Officer, Am I under arrest?" He looked at me with a PUZZLED look on his face... Said, "No. Your not under arrest?" Then I told my friend who felt the need to stand and explain EVERYTHING to this cop, "Dave. We're not under arrest. You don't need to talk to him, Lets go." and we left. Simple as that. I turned around as I was leaving and he was looking all in the car with his flash light, looking for ANYTHING in plain view, to get a warrant to go into my car and search.



So kids, remember our key words we learned today!:

I do not consent to any searches.

Am I under arrest?

Not drunk, not stoned, but he pulls you over for swerving. Maybe it's a good thing you lost your license. can a lawyer not request to see the dash cam footage in order to ascertain that there was or was not just cause in pulling you over in the first place and for having his reason to think a narcotic was involved? I recall there was a case a litlte while back where a woman had her license revoked or some such because she refused to give the officers a breath sample, she appealed and it was decided that the officers had had no valid grounds to demand a test then arrest on failure to comply and she was back on the road

if they cant produce the footage, this makes the officers reason to pull you over look even worse. Especially if they found nothing, and you passed a breathalyzer in addition to OTHER field sobriety tests.... the refusal to offer a urine sample may sound even more logical to the judge. Though depending on your local laws, you could have forfeited your license automatically for doing that (not peeing in a cup)... As others have already stated.

Also- if your license is revoked or muddled up with pending fines, you cannot just move to another state and get one. The current state will contact the previous state to check your validity. And that last state wants their cut before they'll give you the go ahead.

There ended up to be some good tips in here. Be smarter than the dummy with the badge. Or at least catch him off guard with your knowledge and ability to excersize your rights.

Or smoke em :fire: Not the best advise but sometimes you gotta do what you gotta do. Having a quick 2 wheeler helps

haha, every time I see that commercial I'm like "why would I drink beer recommended by someone who 'doesn't always drink beer'? I rather take advice from an alcoholic, at least they have tried more than one beer in their life".

Pretend like you like the cop until he says you are free to go. It's always a nice zinger.

Well i just got my lawyer today ;-) 800$ initial cost :(

And got on subject i dont think i ever signed a fucking ticket when he took me in!!! LOOOOL i have no copy of me signing a ticket WOOOT!! So there might not be a case. However im not 100% sure but im at least 80% sure i never signed a ticket.
