I was looking something up in the law for pellet in another thread when I dug out the pdf and looked at it. I noticed that whenever it talks about the grow area, it says "enclosed, locked facility". Then it has a definition for that:
3. Enclosed, locked facility. "Enclosed, locked facility" means a closet, room, building, greenhouse or other enclosed area that is equipped with locks or other security devices that permit access only by the individual authorized to cultivate the marijuana.
Clearly, they mean an area with something that constitutes a roof, i.e. more than just a fence. Agreed? Sure, you can argue that "other enclosed area" is a little vague, but the series of examples preceding it lays it out, imo.
