There's a difference. Maybe not a lot, but it is a little different to hop over a fence than to break something, like a lock or a door or a window.
 
actually attempted to have an employee, and they got a letter back with voided check saying governor is not allowing this at this time. Called Thiele and he said that was still in the works, and they are not accepting applications for employees. That was a few months ago, not sure if its changed
I can't find the part of the law that says caregivers can hire one employee to assist with cultivation.

The only thing I can find is the mention in the program bulletin.

Where are you seeing that, jujubee? I suspect that you are looking at an old version that was later amended. The current law reads:

2423-A. Authorized conduct for the medical use of marijuana

2. Primary caregiver

H. For the purpose of disposing of excess prepared marijuana, transfer marijuana to a registered dispensary or another primary caregiver if nothing of value is received. A primary caregiver who transfers prepared marijuana pusuant to this paragraph does not by virtue of that transfer qualify as a member of a collective.

The state may still have versions of the law on the legislature web site that were subsequently amended. Very confusing.
 
Tet - As Juju said out, it's about compliance not security. I have a pair of 140lb dogs that take care of security.

Juju - as Tet pointed out, that is the from the original text of 1296, which is the first result when you google LD1296. You need to find the Final Disposition - this has the text that was enacted into law.
 
Yup, I realize the discussion is somewhat academic and about compliance. It just baffles me that the law would consider an outside fence with a padlocked gate as secure as a room inside a building.
 
btw, it is a little encouraging to me that they at least considered allowing CGs to sell overage to a dispensary. Maybe it will change, especially if dispensaries can't keep up and/or a dispensary gets caught getting meds where they aren't supposed to.

The origninal version looked a lot better.Caregiver were allowed to have 5oz per patient too.

For a minute I thought the current version had changed. My problem is that I am trying to find anything in the law about caregivers being able to hire someone to assist with cultivation, and can't find anything.

On the bright side, the laws seem to be changing for the better. I have time.
 
Actually, it once said 10 ounces per patient. Look in that old version again, there may have been something about employees there, or perhaps the original 2009 version that established dispensaries and caregivers. Or maybe the adopted rules from the 2009 version. I know what you mean though, I recall such language myself. I do not believe anything in the law currently allows it. If/when they adopt rules for 1296/407 maybe there will be something there. I also don't believe we've seen the end of amendments to the law either.

if you jump a fence you get unlawful entry, if you jimmy open a window (as long as its not broken) you get the same charge. the law doesn't define what secure is other than that you amde a reasonable attempt to stop people from entering. ie a gate/door and a lock. hell could be a luggage lock.. the problem is they can't redefine all the laws for this one.. so we fall under the same laws for private property. I think its a good thing, last thing some CG needs is some asshole to say a plastic wall isn't secure so your green house don't count no more.. :/

I was looking something up in the law for pellet in another thread when I dug out the pdf and looked at it. I noticed that whenever it talks about the grow area, it says "enclosed, locked facility". Then it has a definition for that:

3. Enclosed, locked facility. "Enclosed, locked facility" means a closet, room, building, greenhouse or other enclosed area that is equipped with locks or other security devices that permit access only by the individual authorized to cultivate the marijuana.

Clearly, they mean an area with something that constitutes a roof, i.e. more than just a fence. Agreed? Sure, you can argue that "other enclosed area" is a little vague, but the series of examples preceding it lays it out, imo.
 
My understanding is that they were arguing about wording on this and other issues (vegging plant limits, in particular) but, with the session coming to a close, the desire to get something passed outweighed desire for the percect wording. They passed it the way it is figuring that they could fix it in rulemaking. Then Cathy Cobb quit and they couldn't do anything until they got a new Director. They have a Director now but i've been hearing that rulemaking for 1296 is not a priority right now.

At the moment, the only thing we have to go by says that any enclosed area that can be used as long as it locks. It won't stay that way forever, though.
