Ok let me start by saying I do not smoke I have in the past but long long ago. Anyways Im working at a caregiving site who shall remain nameless and we have 3 people who have gotten their med lic for weed. The owner of the building wants us to move into the direction of supply for our clients and advertise to invite under this idea. I personally think its one of the stupidest ideas ever posed. The Owner doesnt even know the laws and is buying grow lights and now we are wondering the law on getting seeds for our clients that are listed on are care sheets?

Questions!

How does a medical provider go about getting medical marijuana for medical clients. Do we just walk in with their paper work and card?

What are the legal recourse for things like this of basically inviting people to come here under that idea? (I'm pretty sure i know)

He wants us to have a whole spare room to grow which is nice but makes what ive read about flowering seem hard to get no light through to the other side and still keep good air flow.

I'm not that big a fan of weed personally Im not trying to down you guys that dig it thats cool just not my cup of tea anymore. I have my BSN and not really looking to lose it so we can be different as far as homes go. And being less then a full year since this bill past seems stupid to start up since it could all change next year and I hear talk its already come up.

The other big factor is well.... its and elderly home. While some older more hippie elders might be into it (which is funny cause all our clients who have the lic were hippies with some pretty cool stories) there are a lot of christian backed people who don't condone what these people use and what they would consider a medical need. Not trying to start a war I personally think all drugs should be legalized and i dont think the us would just start on fire if something like this happened. But the fact is its still an banned except for medical use. And we have already had talk about smell bugging other people.

Just need some help here and what i can tell my boss thanks guys still have to learn how to grow since im pretty sure by the law we can provide for them. But I will be looking for other work if thats the route they are seeking.

OK 1st off, ur boss is asking for BIG trouble....Arizona is a police state and if he just tries to throw money at a co-op he WILL get fucked royally. The few Co-op compassion clubs that operate are being shut down quickly.... tell him to wise up asap.
he is about to fubar his whole shit.

What he COULD do to make it possible to get meds to people and perhaps turn a bit of profit would be do designate a few caregivers then have your elderly patients sign up to be their patients.
a full care giver can grow 72 plants, and if he wanted to he could make contracts or w/e and pay to set up PRIVATE caregivers setups to provide top quality meds to who ever needs it(legally) anything NOT patient to patient is pretty risky, but by laying low you can accomplish your goals.

There are also certain rules that care homes/nursing homes have to follow as well.. Not everyone wants to smell it or have it contact them in any way, so there are laws for them. Also, I do not know if your boss gets any federal funding or breaks on taxes for the service he provides, but he could be risking that as well. I do not think the MJJ laws were ever meant to go so business oriented and I think that is where people are bending/breaking the rules.

Stay within the parameters of the laws.. Make sure you cross every T and dot every i and you will be ok. You may also want to suggest to him to rent a small building or build a shed that can be locked to grow in, instead of a room where the patients are. I am pretty positive that would be a no-go according to the state. I believe each caregiver can grow for 5 patients each as well. I do not think advertising is a good idea. It will possibly bring the wrong type of attention. Its usually best to remain quiet and keep a low profile.

On the patient application they ask you if you have a caregiver and also on the DHS website, there is a application that a caregiver has to fill out.

Good luck!

I also have my BSN so I understand your concerns, I however have made peace with the possible consequences of being involved in the MMJ community. I am a caregiver for 2 patients plus I have my own card. The best way for you to obtain meds for your patients at this time is to grow your own. It is the only way that you are protected by AZ law, dealing with clubs right now could open you up to legal troubles and patient to patient sales are illegal. I dont fully understand your situation but it sounds like you take care of people in a house and not an actual nursing home. Either way I would want to do an offsite grow, less concerns regarding your patients and the government. You do need to separate your flower and vegging areas, the easiest way is to use grow tents.

Thanks guys really helpful info. I personally dont want to be involved in weed and weed for meds at all. I make cna's drive them to the places. I want as little to do as I can. I am the head RN and really the head everything at this place. So the owners 4th grade idea I personally feel would fall on my head no madder how clean my hands are. Ill let him know this info it wouldnt be for sale for to the med users however it would kinda be an activity they could do and I take it give a lot of them something to do. However we have a very nice garden as well as a hydro for fresh fruits and veggies that those who want to garden could get involved in. But ive read the law and im no lawyer? there seems to be a couple of spots about what cna/medical providers can do. I just want to be 100% before I present the facts as I havent been behind this idea from the start. I did want to note we have not gotten anything what so ever such as seeds or plants. Just getting info before we do something that stupid.

in a nursing home situation I would not recommend on site growing. too much risk if something were to go wrong such as a fire. also you would need to ensure that only those that had medical cards or those that were accompanied by a cardholder had access to the grow area. The easiest way I can see this working would be to have an employee that grew the product off site and just delivered it to the patients that needed it for free. this eliminates the onsite liability and also reduces the risks to the patients when dealing with unknown vendors. The grower can have it tested to ensure that it is free of molds, pesticides, and other issues to ensure safety.

personal plug: If you need an RN to come and do MMJ education or something similar send me a PM

you seem to be either law enforcement or just another idiot. if you want to find out about the laws and the program then go and read about it on azdhs.gov everything you need to know is on there. it seems like you should start at the beginning given your extremely limited understanding and background in the area. go read the laws and come back with specific questions. it is easier than you having no idea whats going on and start asking specific questions.

My friend...

You are committing a felony... If you are NOT registered as a caregiver for someone and are growing it for a Network... You will be arrested and put in jail... FACT

It is still in Arizona a Class 6 felony for possession... I would look into why your BOSS is making you break the law.. I would walk away now before you get caught up my friend...

People doing this shit make a bad REP on medical marijuana patients and caregivers... If you dont smoke you and you are helping a guy grow bud... Sounds fishy.. Are you a cop? are you a fed? What are you thinking my friend? Take your BSN and run...
